The Board of Appeals held a regular meeting on Tuesday evening, November 9, 1999 upon the application of
Gertrude A.lannazzi, 10 Francis Street, North Andover, MA. Petitioner is requesting a Variance from the
requirements of Section 7, Paragraph 7.3 of Table 2 for relief of rear setback on an existing deck. Property is within
the R-4 Zoning District.
The following members were present:William J. Sullivan,Walter F. Soule, John Pallone, Ellen McIntyre, Scott
Karpinski.
Upon a motion made by Walter F. Soule, and 2n'by John Pallone, the Board voted to GRANT a Variance
(dimensional relief)of an existing deck, for relief from the requirements of Section 7, Paragraph 7.3 for a rear setback
of 9'. In accordance with the Plan of Land by Scott L. Giles, R.P.L.S.#13972,dated 9/29/99. Voting in favor:William
J. Sullivan, Walter F. Soule, John Pallone, Ellen McIntyre, Scott Karpinski.
VARIANCE:
The Board fmds that the petitioner has satisfied the provisions of Section 10,paragraph 10.4 of the Zoning Bylaw and
that such change,extension or alteration shall not be substantially more detrimental than the existing non-conforming
structure to the neighborhood
Furthermore,if the rights authorized by the variance are not exercised within one(1)year of the date of the grant,they shall lapse,
and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted under the provisions
contained herein shall be deemed to have lapsed after a two(2)year period from the date on which the Special Permit was granted
unless substantial use or construction has commenced,they shall lapse and may be re-established only after notice,and a new
hearing.
