electrical system need to be signed and work approved by owners of 146 Main only.Previously the town

Attachment to Complaint
Gregory Smith, individually and as Trustee of the Stone Mill Realty Trust, submits this
complaint to the Town of North Andover with respect to the permitting violations committed
by Sutton Pond Condominium Trust and its agents.
Stone Mill purchased this land in or about 1998. However, this permitting issue and sewer
pump station issues dates back to prior to Stone Mill's purchase of this real estate.
In or about the 1992, the developer of the Osgood Mill Project that eventually became the
Sutton Pond Condominiums, applied to the town of North Andover for a special permit in
order to develop the former factory that was constructed on the site of the condominiums. On
the other side of the stream created by the dam of the pond was building that pre-existed the
development of the condominiums. This building, a three story structure that was presumably
a grist mill in the 19'' century, eventually became Stone Mill's real property. A copy of the
special permit is attached hereto as Exhibit A to this attachment.
At the time of development, this building had several previous uses, including offices that
were once rented by the town of North Andover. It was served by a poorly constructed and
poorly maintained sewer pump station that pumped sewage from below the sewer main up a
cast iron pipe to the street above some 640 feet. This cast iron pipe was installed at the
beginning of the turn of the nineteenth century.
The developer applied and was granted the attached special permit to demolish the existing
sewer pump station and construct a new and proper sewer pump station that was to pump the
sewage from 146 Main Street to the larger pump station constructed on the site of the
condominium complex. This required the sewage line to be newly constructed across the
stream to what is now Sutton Pond Condominiums.
Regardless of the change of ownership of the developer, the special permit concerning this
sewer pump station that served 146 Main Street never changed.
The developers of Sutton Pond Condominiums, eventually becoming Sutton Pond
Condominium Trust (hereafter "Trust"), did construct a sewer pump station that presently
exists, but never complied with the special permit. In fact, it was discovered even prior to
Stone Mill's purchase of 146 Main Street that the Trust never obtain any permit to construct
the present pump station that serves 146 Main Street.
When Stone Mill Realty purchased this real estate,it was subject to a ground lease that leased
land just larger than the footprint of the building to Stone Mill. Shortly thereafter, Stone Mill
purchased the ground lease,uniting the ownership of the land and building. However, as part
of the purchase, Stone Mill's building was serviced by the sewer pump station constructed by
the Trust, that was constructed partially on Sutton Pond's land and partially on Stone Mill's
land.
The Department of Environmental Protection even made it clear in correspondence that no
such DEP permit was ever issued for the present pump station that serves 146 Main Street.
What presently exists is at best a shoddy, poorly constructed pump station that is destined to
fail and cause contamination of the surrounding wetlands and soil. It was never engineered,
poorly constructed and improperly permitted. In fact, the sewer pump system—the heart of
this pump station—was never permitted.
On numerous occasions, Gregory Smith, on behalf of Stone Mill, and others reported these
facts to Town of North Andover officials. No action was taken by the Town of North
Andover, particularly its building inspectors. Instead, permits were given to Sutton Pond by
the building inspector to build a"shed"(in or about 2004 or 2005)on partially on Stone Mill's
land and connected to Stone Mill's building. No permit was issued for a sewer pump station.
In April 2012, an electrical permit was again issued to Sutton Pond for work to be performed
on the pump station. Again, part of the electrical work was performed on Stone Mill's land,
and the electrical work was actually performed and tied into Stone Mill's building. At no time
did the Town, by_and_through its inspector, ever question or seek authorization from Stone
Mill for either work.
In May of 2012, Gerald Brown agreed to inspect the present pump station, but summarily
cancelled his inspection and informed Mr. Smith that no inspections would be held,despite his
former agreement. He then refused to return any telephone calls.
The basis of Stone Mill's complaint is that the permits were improperly and illegally issues as
the permitted work was performed on both Stone Mill's and land Sutton Pond's land. In
addition, Stone Mill's complaint is that the improper permits have been issued, but there has
never been a proper permit issued for this present sewer pump system. Under the law, the
Town of North Andover is required to enforce the law as promulgated by the State of
Massachusetts through its agencies, such as the DEP. This is to protect both the private
citizens as well as the common health and welfare. In this case,the Town of North Andover
has failed to do so.
I am attaching evidence that no permits for the present sewer system were ever issued as proof
that this system was never properly engineered or designed and fails to comply with even the
most basic requirements that such sewer pump systems are required to have.
All Stone Mill requests is to have a pump system that services his building comply with the
law.
