RE: Request for Enforcement — Sewer Pump Station Located at 146 Main Street, North
Andover,Massachusetts
Dear Mr. Brown:
As you are aware,I represent Gregory Smith individually and on behalf of Stone Mill
Realty Trust concerning the above referenced office building.
As you are also aware,the above-referenced sewer pump station is in failure,once again,
and completely out of compliance with all applicable laws,regulations and permits. At present,
the pump station has been shut off due to another major leak in the system caused by the poor
work that has never been inspected or approved by the North Andover Building and Health
Departments.
On behalf of Mr. Smith,I am hereby requesting that you do your job to enforce the
law by enforcing the code,permit and regulations. In order to do this,you need to order
Sutton Pond to comply with the following:
1. Comply with special permit issued by the Town of North Andover in December
1992 with respect to the development of the Sutton Pond Condominium Project
and specifically order Sutton Pond to construct a sewer pump station serving my
client's building in full compliance to the special permit.
2. Order Sutton Pond to construct a proper sewer pump station in compliance with all
applicable State of Massachusetts Law, Codes,Regulations as well as in
compliance with all local(Town)rules and regulations. This new pump station
has to be properly engineered,designed and permitted in compliance with these
same codes,regulations and local permit requirements. A list of code violations of
the present pump station is attached hereto as Exhibit A to this letter.
3. Order Sutton Pond to have aseptic pumping service pump the pump station tank
(wet well)on daily basis until such time that Sutton Pond has fully complied with
the proper construction of a newly engineered,permitted pump station.
Contrary to numerous misrepresentations,my client is only seeking that which is
proper,legal and safe under the law,no more and no less. The present pump station is neither.
It was never properly engineered, designed and constructed,and therefore has been in a
constant state of failure since its construction.

Code Violations of Sewer Pump Station
Constructed by Sutton Pond Condominium Trust Serving
146 Main Street,North Andover, MA
Distance of Pump Station from Foundation Requirement - 310 CMR 211 (Title V
Massachusetts Environmental Code) - Pump Station needs to be a minimum of 10 Feet
from Foundation of Buildings and Property Lines. In addition, a variance is required if
Pump Station is constructed on another owner's land,not the same land as the building it
serves. (3 10 CMR 211 (5)).
Undersized Storage for Power Outages—310 CMR 203 requires that the size of the
wet well accommodate 24 hours of storage in case of a power outage in addition to its
normal size. According to this regulation, an office building has to have 75 gallons per
1000 square feet of additional storage in case of a power outage. 146 Main Street is 6000
square feet in size, requiring the storage (not just the wet well size) capacity to be a
minimum of 450 gallons. The present wet well is 200 gallons in its entirety. See TR-16
3.8 and 310 CMR 231(2) as well. See letter from Victor Olson of Stantec, page 4,
Section g.
No Functioning Alarm System—TR— 16 3.2.3.7. Alarm system was not properly
designed or installed. Operates on main power of pump station, but if there is a power
failure, no alarm and no battery backup. Also, alarm not audible.
Improper Electrical Controls and Components/Explosive Hazard (TR— 16 3.6.2)
Electrical systems not designed to be used in sewer pump system, especially heater that
Sutton Pond attempted to use (plug in room heater). No power ventilation for pump shed
and no separate ventilation for wet well. Sewer gases are flammable if not explosive.
Improper Force Main. (TR-16 3.7.1) Minimum size force main is 4 inches. Smaller
diameters acceptable only where cutter type pumps are used. Existing force main is 2
inches and increases to 3 inches on site and ties into a 4 inch, 113 year old cast iron force
main. See Olson letter p3, Section e.
Shed Constructed Over Wet Well is to be of Non-Combustible Material (NFPA 820
—Table 4.2 Row 19). Existing Shed is constructed out of plywood and standard wooden
studs with a base of pressure treated wood. Shed has no foundation, is poorly insulated
and has stone floor.
- No Study, Application or Permitting Concerning Wetlands or Pump Station. (3 10
CMR 211 and 310 CMR 220(4)(1)). Also See TR-16. All work in the wetlands will
require a permit from the Conservation Commission and maybe a study. Boyancy
calculation needed CMR 15.221(8) due to the flood hazards surrounding the property and
the high water table.
Special Permit Issued in December 1992 Violated. Permit called for pump station
serving 146 Main Street to cross the waterway to the pump station serving the
Exhibit A
condominium. Presently, this unpermitted pump station is tied into a 113 year old sewer
pipe. In addition TR-16 requires that any sewer system designed is designed for a
minimum 50 year lifespan. Connecting the pump system to a 113 year old main violates
this guideline of the 50 year lifespan as the 113 year old main is past its usable life.
Permit also required Grinder style pump. Current pumps installed are not grinder style
pump. Any change would need to be approved by the Planning Board (See letter from
Lincoln Daly.) There is also no Sewer Connection Permit.
o Main Issue Concerning Special Permit is 113 Year Old Sewer System Was
Not Designed, Permitted or Retrofitted to Accommodate Connection of
Pump Station at 146 Main Street as Follows:

• Watertight 20-in minium access manhole at least 20" MUST BE TO
GRADE [3 10 CMR 15.231(5)] Service components accessible (not too
deep with piping, disconnects accessible)
Inspections. Inspections on pump station must occur once per year for systems less than
2000 gpd or quarterly greater than 2000gpd good to note on plan [3 10 CMR
15.254(2)(d)]. Gpd means gallons per day.
- Improper Pump Station Design. If pump station exceeds two units must have two
pumps operating in lead-lag mode. [3 10 CMR 15.231(6) and (8)] Stable Compacted Base

This letter describes 8 site visit with Greg Smith on January 00, 007 by V. Olson and on
February 7, 2007 by W, Terrell to evaluate the existing sewage PUMP station for code
compliance and to make recommendations for an upgrade. We also reviewed Plans prepared
by others and file Arbitration Award for general code compliance,
Tile,existing station failed when winter weather Caused the frozen discharge pipe to burst its
fittings and discharge sewage to the ground, The existing small electric Beat,Was inadequate
to the 2"force main with non 0 g
to prevent freezing of the discharge pipe. It was noted that the pump discharg was connected
-pressure rated Unrestrained flexible couplings. It is our opinion that
with freezing of the force main, the pressure at the coupling increased to full Pump head causing
the flexible coupling to slip off the force main. The pump station was not in operation during our
initial site visit. After using a Pump out truck for a period the discharge pip was repaired and
the pump placed back in service, At the e

The following code violations were noted at the existing Pump station,
a. Two submersible Pumps are required(TR-16 3.2.3.1 and 248 CMR ); currently there
is only one Pump in place,
b, Pumps required to pass 31, solids (TR-16 3,2,3,2) (Note: This standard can be
relaxed to 20 solids by using a "cutter"type impeller for the pumps.)
C. Submersible Pumps to be "lift out"design for maintenance without the need for
entering the wetwell and connect to force main with self-locking coupling, Shalt seal
failure alarm required (TR-16 3,2.3-7)
d, Explosion proof rated motors, controls and electrical components required for
wetwells and spaces not separated from the wetwell. NEC-Area Electrical
Classification is Class 1, Group D, Divisions I &2 (NFPA 820 Table 4.2 Row 16 and
TR-1 6 15.2). The current wehvell is not Seated and the building has no ventilation.
The wetwell should be ventilated separately from the building,

that was submitted for review and discussed during the September 20,2006 Arbitration
Nearing, We have reviewed these materials in regards to crude requirements and
manufacturers recommendations and have the following comments. There were no formal
Plans or design calculations prepared for the pump station upgrade, The arbitrator indicated
that the pump station shall meet applicable codes and manufacturers recornnnendations.

5. Town of North Andover Building Permit
A building permit(NO, 412)Was issued at 178 Main Street (Assessors Map 0040 and Parcel
Number 0004) on December 5,2005 to the Sutton Pond Condominium Trust,s
rebuild a 6'X 8'shed per existing shed (n contractor to
o changes). The Permit application indicates the
Permit is for utility shed for complex including tear down and rebuild shed of same size,
length and width, The shed was rebuilt, however, the Permit does not indicate building
Permit is for replacing pumps,, electrical and mechanical equipment, Work to replace pumps,
electrical and mechanical equipment was not Completed. This building permit is expired and
a new Permit would be required to ensure municipal inspection by building inspector,
Plumbing inspector, electrical inspector and fire department.
6. Recommended PuMP Station
To comply with codes and to meet the orders and intent of the arbitrator's findings we
recommend a sewage pump Station incorporating the following components,

concrete and the flotation collar deleted, Alternately, a backup generator could be
provided to reduce the required size of the weiwell. Wetviell size and configuration
should be engineered In accordance with pump systems specified,
c. The wetwell should be positioned at least 10 ft. away from the existing building to
prevent undermining during excavation. A utiretwell 4'-0" diameter by 6 ft. deep would
be acceptable if emergency power(permanent with automatic transfer switch
preferred) is provided. The wetwell and all piping would be below grade with only the
access hatch visible.This would put the pump station outside the jurisdiction of the
248 CMR.
