Dear Attorney Kutrubes,
The issue of the pumping station which is the subject matter of your Enforcement Request has
been litigated, resulting in a Settlement Agreement, an Essex Superior Court Order and an Award of an
Arbitrator.
I do not have the authority to interfere with or over rule,that process so I respectfully decline to
issue the Enforcement Order which you requested.

Dear Attorney Kutrubes,
I have received your September 9,2015 Request for Enforcement. Please provide the
following to me:
1. The Settlement Agreement in Civil Action No.99-01960 as referenced in the Award of
Arbitration which you provided.
2. All findings of the Court in Civil Action No. 99-01960.
3. All Judgements entered in Civil Action No.. 99-01960.
4. All documents files by all parties with the Court in Civil Action No.099-01960 after
October 18, 2005,which is the date of the Arbitration Award.
5. Certification by you that you have provided copies of your Enforcement Request to each
and every owner of a condominium at the Sutton Pond Condominium Project.
6. All correspondence by and between representatives of your client and representatives
of the Sutton Pond Condominium Project since the January 16,2006 from the Norfolk
Ram Group.
7. All engineering reports since January 16, 2006 relating to the pump station.
