Avenue Date: January 23, 1987 I have reviewed the site plan dated 1-8-87 submitted for this proposed building and have the following comments: 1 . Since the present building is connected via alarm lines to the municipal alarm system and has a sprinkler system installed, the Fire Department must be notified under Chapter 148 Section 27A (copy enclosed) of the proposed action regarding the existing building. 2. The new building will be required to have an automatic sprinkler system installed under MGL Chapter 148 Section 26G. Plans for that system must be approved by ISO and the Fire Chief. A stand pipe system will also be required in this building. 3. Fire detection and alarm warning devices must be installed and approved by the Fire Department. 4. Both of the systems listed in items 2 and 3 must be connected to the municipal alarm system via a master fire alarm box. 5 . The zoning data chart on page 1 of the plans give the height of the building as 45 ' but on page A5 the height is shown as 4516" on the east elevation and 4816" on the south elevation. Could this be clarified. 6. For planning for fire protection the developer should notify the Fire Department of the specific occupancy as soon as possible. by E a � illiam V. Dolan Fire Chief "SMOKE PLAN ING BOARD DE"r'ECTO S SAVE LIVES" In such buildings or additions, or in certain areas of such buildings or additions, where the discharge of water would be an actual danger in the event of fire, the head of the fire department shall permit the in- stallation of such other fire suppressant systems as are prescribed by the state building code in lieu of automatic sprinklers. Automatic suppressant or sprinkler systems shall not be required in rooms. or areas of a telephone central office equipment building when such rooms or areas are protected with an automatic fire alarm system. Sprinkler systems shall not be required in a one story building having a fire resistance rating as prescribed in the state building code that is used solely for offices provided the building is protected by an automatic fire alarm system. This section shall not apply to buildings or additions used for residential purposes. The head of the fire department shall enforce the provisions of this section. This section shall apply to construction of buildings or additions or major alterations commenced after July first, nineteen hundred and eighty-three. SECTION 27. Penalty. Any owner of a building who, within six months after having received an order from the marshal under section twenty-six, fails to comply with the requirement of such order shall be punished by a fine of not more than one thousand dollars. SECTION 27A. Protection from Fire Hazards Due to Industrial Emergency. Except as hereinafter provided, no person shall shut off, discon- nect, obstruct, remove or destroy, or cause or permit to be shut off, disconnected, obstructed, removed or destroyed, any part of any sprink- ler system, water main, hydrant or other device used for fire protection in any building owned, leased or occupied by such person or under his control or supervision, without first procuring a written permit so to do from the head of the fire department of the city or town wherein such building is situated, which permit'such head is hereby authorized to issue subject to such terms and conditions as, in his judgement, pro- tection against fire and the preservation of the public safety may require. This section shall not prevent the temporary shutting off or disconnection or partial removal of such a system, main, hydrant or other device for the purpose of making necessary repairs or of prevent- ing freezing or other property damage, provided a report thereof is made within twenty-four hours thereafter to the head of the fire department. Violation of this section shall be punished by imprisonment for not more than one year or by a fine of not more than one thousand dollars, or both. The supreme judicial and superior courts shall have jurisdiction in equity to enforce compliance with the provisions of of this section. SECTION 27B. Prohibition Against Piling Snow on Fire Hydrants, etc. No person other than an employee in the service of the commonwealth or any political subdivision thereof or in the service of an independent contractor acting for the commonwealth or any such subdivision shall pile, push or plow snow or ice on or against any fire hydrant or other 19 THE COMMONWEALTH OF MASSACHUSETTS ADVANCE COPY 1983 ACTS AND RESOLVES MICHAEL JOSEPH CONNOLLY, SECRETARY OF STATE Chap. 1�7. AN ACT FURTHER REGULATING THE INSTALLA- TION OF CERTAIN AUTOMATIC SPRINKLER SYSTEMS. Be it enacted, etc. , as follows: Section 27A of chapter 148 of the General Laws is hereby amended by striking out the second sentence, as appearing in chapter 283 of the acts of 1932, and inserting in place thereof the following two sentences: - This section shall not prevent the temporary shutting off or disconnection or partial removal of such a system, main, hydrant or other device for the purpose of making necessary repairs or preventing freezing or other proper- ty damage; provided, however, that the head of the fire depart- ment is notified immediately of such emergency action. The head of the fire department shall also be notified when the system, main, hydrant or other device is placed back in service. Approved June 17, 1983. 4 i -2- As a result of this review you must advise owners of buildings or additions if such automatic sprinklers installations (in the case of additions) are not now necessary throughout the entire building . The Legislature did not make any other amendments to Chapter 545 of the Acts of 1982 therefore the revised and complete statute would read as follows : M.G.L . CHAPTER 148 SECTION 26G "In any city or town which accepts the provisions of this section, every building of more than seventy-five hundred gross square feet in floor area or every addition of more seventy-five hundred gross square feet in floor area shall be protected throughout with an adequate system of automatic sprinklers in accordance with provisions of the state building code ; provided , however , that in the case of said addition, such an adequate system of automatic sprinklers shall be installed in said addition only . No such sprinkler system shall be required unless sufficient water and water pressure exists . For purposes of this system, the gross square feet of a building or addition shall include the sum of the floor areas for all floor levels , basement and sub-basements , measured from outside walls , irrespective of the existence of interior fire resistive walls , floor and ceilings . There will be a number of vehicles bringing material to the site and we might want a Police Officer there to help ,in the traffic situation. I will be having a problem with the school Bus in this are4a As it stands now the bus turnes into the parking lot of Jillyts then returns to Mass . Ave. letting the children off at Commonwealth Ave. . I will have to contact A.B.C. Bus Company about this situation. The school bus issue will be addressed by Unity Realty' s legal counsel. It is not clear to us what coordination is required with regard to the school bus. 1 i 2. Based upon trip generation rates by the Institute of I Transportation Engineers, the restaurant generated an average of '1562 vehicle trips per average weekday. The peak hour occurs between 12 :00 noon and 1 :00 p.m. with 55 vehicles entering and 20 vehicles exiting.) The p.m• peak occurs on Saturdays between 8 :00 and 9:00 p.m. with 66 vehicles entering and 41 vehicles exiting the site. i 1 The proposed office building will generate an average > of 125 vehicle trips per average weekday.` The a.m. peak would occur between 7 :00 and 9 :00 a.m. with 15 vehicles entering the site and 3 vehicles exiting. The p.m. peak will occur between 4:00 and 6 :00 p.m. with 3 vehicles entering the site and 17 vehicles exiting. The changes are: 1. The title has been changed from the Unity Essex Realty Trust to The Unity Realty Trust-Essex. 2. The property line for the previous site plan was prepared from plans and deeds of record. After further title search, an unrecorded plan depicting the Town line between Lawrence and North Andover was found and the site plan has been changed accordingly. 3. Parking has been reduced to accommodate the Town boundary line change. The Planning Board accepted the letter and continued the public hearing to February 23, 1987. A number of items were discussed which are to be addressed prior to the meeting. on February 23. The following is a list of those items: - coordination with school bus; - traffic generated, hours generated, impact; - scale model of building; - locus. map; - buffering to be shown on landscaping plans; - landscape plan. I do realize you are the engineer for the project and the architect may be handling some of these items. I am also aware that you have not yet submitted your plans which may address these items. Please be award that your plans should be submitted to the Planning Office no later than Friday, February 13, 1987. If you cannot meet this deadline, we. ask ,that you withdraw the application and resubmit and readvertise when the plans are complete.
