Construction Phase
The BMPs associated with this project will be owned by 1003 Osgood Street, LLC, who will be
responsible for inspection, operation and maintenance.
1) The contractor is to install and maintain drainage facilities as shown on plan(202306, by MHF
Design Consultants, Inc. revised, dated August, 2006).
2) Prior to construction, all erosion/silt control devices shown on above plan are to be installed.
To prevent silt intrusion into surrounding areas during construction, the contractor is to set silt
fencing at all slopes which may erode in the direction of any open drainage facilities or abutting
property. Such preventive measures are to be maintained throughout the construction process.
3) All construction of drainage facilities is to be inspected by inspectors from the Town of North
Andover and an authorized agent to verify conformance to the design plan.
4) The sequence of drainage construction shall be as follows:
a) Clear, grub, excavate areas for detention system.
b) Install catch basins, pipes, stormceptor and detention system.
c) Trench and install drainage channel.
4) Erosion controls are to be inspected and maintained on a daily basis. Upon discovery of silt
build-up in any catch basin sumps, Stormceptor, drainage channel, detention system, emergency
control outlet structure or any other structures they are to be cleaned.
5) All exposed soils shall be immediately stabilized with a layer of mulch hay.
6) Upon installation of catch basins, inlet protection - as described on aforementioned plan- shall
be installed and maintained until ready for paving.
7) Prior to construction of impervious areas, all drainage structures and pipes shall be installed
and inspected for proper function. During construction of other site features, all drainage facilities
shall be inspected on a daily basis and cleaned/repaired immediately upon discovery of sediment
build-up or damage.
8) After paving is installed, it shall be swept clean on a monthly basis.

Post-Development Phase
The owner is to be responsible for maintenance of all drainage structures in the project - including
drain pipes and detention system. The future owner is expected to be 1003 Osgood Street, LLC,
who will ultimately be responsible for compliance with Plan.
Regular maintenance is to include the following:
1) Inspection of all drainage facilities (catch basins, drainage channel, .Ytorniceplor, emergency
outlet control structure, underground detention and infiltration systems,) every three months.
During the first year of operation, all drainage facilities should be inspected after every large
storm, and 2-3 days afterward. During these inspections the inspector as designated by 1003
Osgood Street, LLC shall look for evidence of the following: structural damage, silt accumulation
(near inlet inverts on catch basins), and improper function.
2)After inspection, if any of the above conditions exist, the inspector shall notify 1003 Osgood
Street, LLC, who shall immediately arrange for all necessary repairs and sediment removal.
3)Parking areas are to be swept clean every three months spring through fall and otherwise as
needed (ie. visually noticeable debris build-up).
4) The Catch Basins, Drainage Channel, Infiltration Trenches, Detention System including the
emergency outlet control structure and Stormceptor are to be inspected every three months.
Remove oil, debris and sediment after inspections.
5) All graded slopes shall be inspected every spring for erosion. Upon discovery of any failure (ie.
erosion) loam and seed shall be put in place and nurtured.
6) During the winter months, all snow is to be stored such that snowmelt is controlled within the
paved area and enters the storm water treatment systems. In the event the amount of snow
exceeds such capacity, it is to be removed off-site. The minimum amount of deicing chemicals
needed is to be used. No toxic chemicals are to be used for snow or ice control.
7) During the summer months, all landscape features are to be maintained with the minimum
possible amount of fertilizers, pesticides or herbicides. The materials used should be organic,
biodegradable, non-toxic in nature. If in question, maintenance personnel should check with the
Conservation Commission. All personnel involved with the maintenance of landscaping will be
informed of this condition.

AGREEMENT OF EASEMENT
Reference is made to a plan of land in North Andover, Essex County, MA,
entitled:
Site Development & Landscape Plan,
Assessors Map 35, Lot 20,
1025 Osgood Street, North Andover, Massachusetts,
Dated January 28, 2005,
prepared by MHF Design Consultants, Inc. , and attached hereto ("the Easement
Plan") .
For good and valuable consideration, the sufficiency and receipt of which
are hereby acknowledged, the undersigned, being the owners of those certain
parcels of land with all improvements thereon and located on the southerly side
of Osgood Street, North Andover, Essex County, MA, all as more particularly
described in "Exhibit A" annexed hereto prior to the execution hereof and herein
incorporated by reference as if fully set out hereon (hereinafter termed "1025
Osgood Street Parcel" and "1003 Osgood Street Parcel") , hereby grant and reserve
to themselves, their respective successors and assigns, the following rights and
easements, to wit:
1. A temporary easement for the benefit of the 1025 Osgood Street Parcel,
covering and concerning that portion of the 1003 Osgood Street Parcel abutting
the 1025 Osgood Street Parcel which is designated on the said Easement Plan as
"Temporary Grading Easement. " The easement is granted to allow the owner of the
1025 Osgood Street Parcel, its agents, servants and employees, to enter onto the
Temporary Grading Easement area by foot or by vehicle for the limited purpose of
completing the construction of the driveway and parking area which will serve
the improvements to be erected on the said 1025 Osgood Street Parcel.
2. A permanent easement for the benefit of the 1025 Osgood Street Parcel,
covering and concerning that portion of the 1003 Osgood Street Parcel abutting
the 1025 Osgood Street Parcel which is designated on the said Easement Plan as
"Prop. 10' x 10' Conc. Pad for Dumpster wi Fenced Enclosure & Cap Cod Berm. " The
easement is granted to allow the owner of the 1025 Osgood Street Parcel, its
agents, servants and employees, to enter that area by foot or by vehicle to
construct, install, maintain, replace and repair a concrete pad and dumpster
with surrounding fence and asphalt berm. The obligation to install, maintain,
repair, replace and keep all portions of the constructed or installed
improvements shall be shared equally by the owners of the 1025 Osgood Street
Parcel and the 1003 Osgood Street Parcel.
3. (A) . A permanent easement, in common with others entitled thereto, over,
across and through the paved areas of the 1025 Osgood Street Parcel for the
benefit of the 1003 Osgood Street Parcel, for the sole and limited purpose of
access to and egress from the said 1003 Osgood Street Parcel to Great Pond Road,
by foot or by means of vehicle.
(B) . A permanent easement, in common with others entitled thereto, over,
across and through the paved areas of the 1003 Osgood Street Parcel for the
benefit of the 1025 Osgood Street Parcel, for the sole and limited purpose of
access to and egress from the said 1025 Osgood Street Parcel to Osgood Street,
by foot or by means of vehicle.

4 . A permanent easement for a common driveway and parking over, across and
through that portion of the 1003 Osgood Street Parcel abutting the 1025 Osgood
Street Parcel, which area is designated on the said Easement Plan as "Proposed
Parking and Driveway Easement, " for the benefit of both the 1025 Osgood Street
Parcel and the 1003 Osgood Street Parcel, for the purposes of: (a) access to and
egress from Osgood Street, by foot or by means of vehicle, to both the 1025
Osgood Street Parcel and the 1003 Osgood Street Parcel, and (b) vehicular
parking in the designated spaces for the benefit of the 1025 Osgood Street
Parcel in the designated spaces which are located within said "Parking and
Driveway Easement".
Such easement shall be for the unrestricted joint use by the owners of the said
1003 Osgood Street Parcel and the 1025 Osgood Street Parcel, and their
successors in title.
It is hereby further agreed by the undersigned that an equal portion of
the cost of installation, maintenance, replacement and repair of the said
"Parking and Driveway Easement" area shall be borne by the respective owner(s)
of said 1003 Osgood Street Parcel and the 1025 Osgood Street Parcel, and their
successors in title.

The easement grants set forth herein are to and shall run with the land,
and is and shall be for the benefit of and appurtenant to and a burden to the
said 1003 Osgood Street Parcel and the 1025 Osgood Street Parcel, their current
owners and their successors in title.

the Iown of North Andover has requested that Vanasse Hangen Brustlin,Inc (VHB)comment on
the adequacy of the drainage design and provide an opinion on the project's impact to L ake
Cochichewick.
Unfortunately,VHB has not provided a detailed drainage review for the above referenced project and
therefore is not in a position to comment on the adequacy of the drainage design Please note that the
drainage system appears to be similar to the adjacent property(1025 Osgood Street)and VHB
reviewed and approved that design.
VHB was previously asked to provide a ctusory review of the connection(common driveway)
between this property and the adjacent property(1025 Osgood Street) As part of this cursory review,
VHB suggested that the Best Management Practices(BMPs)proposed at 1025 Osgood Street be
considered for the 1003 Osgood site Refer to VHB letters dated August 30 and September 21,2006..
Please note that all of the VHB suggested BMPs appear to have been incorporated into the project
design and all of our cursory review comments have been satisfactorily addressed. Since the
drainage design and BMPs for this property are similar to those proposed at 1025 Osgood Street,VHB
would not expect significant impacts to the water quality of Lake Cochichewick

Dear Board Members:
Pease find enclosed a revised set of plans and supporting documentation regarding the above referenced project located at
1003 Osgood Street. The plans have been revised to address the comments in correspondence from VHB dated 8-30-06.
Based on those comments we offer the following:
1. Access to Osgood Street has changed_from the original plan. VHB assumes that the Applicant will notify Mass
Highway of this change and if necessary,update any access permit application.
RESPONSE: Comment acknowledged,applicable permits will be obtained.
2. The Town had specific concerns regarding water quality for the adjacent property(1025 Osgood Street). That
development incorporated specific measures designed to eliminate/minimize impacts to the water quality of Lake
Cochichewick. Since the stormwater runoff from this development will be conveyed toward the lake,VHB suggests
that the Applicant consider the following:
a. Incorporate a mechanism in the outlet control manhole that could contain an emergency spill of hazardous
material. Adjust the Operation and Maintenance Plan, (assuming one exists)to include language regarding this
provision. The adjacent development incorporated a shear gate that could be closed by the owner thus
containing any spill.
RESPONSE: A shear gate has been added to the plan set as recommended and the Operation and
Maintenance Plan has been revised and attached hereto.
b. Incorporate check dams within the proposed grass swale.
RESPONSE: Check dams with corresponding details have been added to the plan set.
c. Incorporate a level spreader at the end of the proposed grass lined swale.
RESPONSE: A level spreader and corresponding details have been added to the plan set.
d. Clean the existing catch basin(s)along the frontage of the proposed development prior to and at the completion
of construction of the development.
RESPONSE: A note has been added to the plans.

3. The Applicant should consider provided an edge treatment(curb or berm)at the rear of the"18'x18' concrete pad for
trash receptacle". Edge treatment would ensure that stormwater and other undesirables remain within the parking lot
and drain toward the drainage system.
RESPONSE: Curbing has been added as recommended.
4. It appears that the overall traffic circulation works well given the configuration of the common driveway between the
two properties. The access point between the two properties behind the proposed buildings also seems to work well.
VHB assumes that the appropriate access easements will be executed by both properties at the appropriate time.
RESPONSE: Comment acknowledged,the easement agreements are currently being written.
