The following written comments address the review comments from VHB: Section 2 Boundaries and Zones': 1. The buffer zone lines have been modified to be consistent with a lot created prior to October 24, 1994. The 100 foot buffer zone line has been relabeled as the 100 foot buffer zone to wetland resource. The 150 foot buffer zone has been eliminated as it is not appropriate for a lot created prior to 10/24/94. i Section 3 Uses and Requirements 2. A note has been added to the plan to prohibit the use of lawn care or garden products that may contribute to the degradation of the public water supply. Section 4 Special Permit Requirements' 3. The wetland resource area,which was delineated by Rimmer Environmental Consulting, defines the top of bank of Lake Cochichewick which is coincident with the mean annual i high water mark. Although the Town Zoning Bylaw and Subdivision Rules and Regulations donot appear to have design criteria for driveway design, the Massachusetts Highway Department(MHD)has driveway design criteria. Specifically,MHD allows the driveway vertical profile to range between 10% and 15%. The Applicant ia proposing u driveway with m slope ranging{ruzo15%to12%fozdbernjordvc6thedrivevvay length. Although a driveway slope of 15%is not desirable,it is acceptable if MHD standards are being applied. 3. The plan indicates that the driveway will be'cut'into the existing hill. Surface water will likely runoff the adjacent hill and onto the driveway surface. During winter months, this runoff has the potential to freeze. The following written comments address the review comments from VHB: i 1. The enclosed plans have been stamped by a registered professional civil engineer. 2. The proposed driveway has been designed to meet widely accepted civil engineering design criteria. As noted in the review letter,the Massachusetts Highway Department recommends a maximum profile grade of 15%for driveway design. In an effort to balance public safety and conform to the intent of the Watershed Protection District Special Permit, driveway slopes of 12%to 15%were utilized to minimize earthworks. A leveling area with a maximum grade of 3%has been provided at the intersection with Great Pond Road to provide for save access and egress to the site. 3. The maximum grade of the proposed driveway is 15%for a distance of approximately 27 feet. The majority of the proposed driveway is designed less than 15%. The minimum horizontal curve has a radius of 43 feet. In MSG's opinion these grades and curves are within acceptable limits for the design of a residential driveway. Furthermore,the geometry of the driveway was chosen in an effort to minimize earthworks and promote overland flow of stormwater runoff. The curvature of the driveway enables stormwater flows to leave the driveway surface and travel overland(over pervious surfaces)prior to reaching Lake Cochichewick rather than flowing straight down the driveway if the curvature were eliminated. i North Andover Planning Board Page 2 May 11,2004 4. The paved width of the proposed driveway has been reduced from 14 feet to 12 feet and a 3 foot wide infiltration Swale has been added adjacent to the driveway(on both sides)in j order to mitigate stormwater flowing from the hillside toward the proposed driveway surface. The infiltration swale has been designed to divert stormwater from flowing onto the proposed driveway surface thus minimizing the risk of icing while promoting groundwater recharge in accordance with the intent of the Watershed Protection District j Special Permit. 5. The sight distance of the proposed driveway will be very similar to that of the existing driveway. Approximately 300 linear feet of sight distance exists to the west while the sight distance to the east is in excess of 300 feet.. 6. As suggested,a proposed 12-inch reinforced concrete pipe has been proposed to replace the existing 10-inch clay pipe located at the intersection of the proposed driveway with Great Pond Road. We believe that we have sufficiently addressed all of the comments relative the applicants request. The plans have been revised such that the proposed utilities have been relocated under the existing driveway where possible, This change was made in an effort to minimize the amount of disturbance associated with the installation of utilities. It was not possible to locate both the proposed water and sewer services under the existing driveway and maintain a minimum 10-ft separation,however the utilities were re-located to minimize the amount of disturbance The Watershed Protection Special Permit regulations are intended to"preserve the purity of the ground water,the lake and its tributaries;to maintain the ground water table,and to maintain the filtration and purifications of the land,while conserving the natural environment;and protection the public health,safety and welfare". In the opinion of McKenzie Engineering Group,Inc. (MEG)the proposed design illustrated on the plan prepared by MEG entitled"Proposed Site Plan Plat 35 Lot 40 Great Pond Road in North Andover,Massachusetts"dated April 9,2003 and revised October 20,2004 is consistent with the spirit of the by-law for the following reasons: 1. The geometry of the driveway has been designed in such a manner so as to promote overland flow. By meandering the driveway across the lot,surface water is forced to flow overland as much as possible such that a natural filtering and purification by the land can occur. 2. Roof drywells and infiltration trenches have been proposed to provide groundwater recharge from stormwater runoff generated by impervious surfaces_ These best management practices(BMP's)not only mitigate the peak rate of runoff generated from the development of the subject property but also serve as a means to maintain the groundwater table. Soil testing was performed by MEG during the design of this project to verify the on-site soil conditions. Nov 16 04 05: 37p Bradlee C. McKenzie, P. E. (701 ) 941-2662 p. 2 The results obtained from the soil testing were employed in the drainage design for this project and reviewed by Vanasse Hangen Brustlin,Inc. 3. Deep sump hooded catch basins have been proposed at the end of the driveway. Stormwater runoff that is not captured by the infiltration swaies is directed toward the deep sump hooded catch basins. Deep sump hooded catch basins are capable of removing 25%total suspended solids(TSS)from stormwater flows per the DEP Stormwater Management Policy. 4. The location of the driveway alignment and proposed single family dwelling has been revised throughout this project in an effort to minimize the amount of overall disturbance associated with the construction. A specific construction sequence has been prepared for this project to ensure that there will not be a negative impact on Lake Cochichewick due to the development of this project. Finally,during the October 19,2004 Public Hearing,the board asked that MEG suggest different erosion control measures for different seasons. MEG recommends that the standard construction sequence outlined on sheet 3 of 3 be followed for Spring,and Summer construction. If construction is ongoing during the late fall and winter months,the contractor should follow the following erosion control measures: -'► if construction activities are planned during the winter months(December thru March),then the North Andover Planning Board shall be notified in writing as to the specific construction activities and erosion control measures. 4 If habales and siltation fence have not been properly installed before the ground freezes,then construction activities should not commence until they can be installed properly or an approved alternative(filter berm)is approved. 4 Exposed soil areas should be covered with hay or a compost mitt to prevent the migration of fines toward the lake.
