It has come to my attention that ADS Management Company, owner
of both Prescott and Sutton Hill Nursing Homes in North
Andover, has filed with the North Andover Planning Board for
permission to build an assisted living complex in North Andover .
This letter will serve to support the need for alternative liv-
ing accommodations, as sought by the prospective builders , as
our population continues to age and as our society seeks to
organize its health care delivery system in a way which makes
both economic and clinical sense.
As you know, ADS Management Company, under the leadership of
Alan D. Solomont, has developed a reputation -- well deserved,
I might add -- for the quality of its facilities and services
and for the forward-looking approach it takes to providing
services to and for the elderly and the physically challenged.
Two of its facilities, the Prescott and Sutton Hill Nursing
Homes, are right in North Andover and stand as models for
others to emulate and to use as a standard against which
quality services might be measured.
Given the track record of ADS Management and the now clearly
demonstrated need for assisted living facilities of the types
that company has made application to build in North Andover, I
recommend your careful consideration. This new dimension of
service is innovative, is cost effective and will give those in
need the greatest opportunity for the independence each can
reasonably achieve and at costs that are substantively less
than nursing home rates . I recommend both ADS Management
Company and the concept of assisted living to you and your

Nursing & Retirement Center, has expressed interest in developing

The Retired & Senior Volunteer Program of Greater Lawrence,
currently supporting 400 senior volunteers, has enjoyed the
support both financially and non-financially, of ADS. It is
apparent that they are committed to improving the duality of
life for seniors within the greater Lawrence community. The
development of an assisted living community by ADS would provide
additional needed services and living options currently not
available to our senior community.
As director of the Retired & Senior Volunteer Program of Greater
Lawerence I support the ADS plan and hope that the North Andover

An Environmental Notification Form has been submitted for this
project. According to MGL Chapter 30, Section 62 , the Secretary
of Environmental Affairs must issue a determination regarding the
significance of the potential environmental impacts of this
project, and must determine whether an Environmental Impact
Report should be required to document these impacts and all
feasible means to reduce damage to the environment.
Therefore, a consultation meeting will be held to receive advice
and comment from agencies, officials, and citizens regarding
which environmental issues, if any, are significant for this
project. Opinions as to the extent of significance of possible
environmental impact will be welcome.
The meeting is scheduled as follows:

The Planning Board closed the public hearing on the site
plan review application for 700 Chickering Road at its meeting of
February 1 and will render a favorable decision at its February
15 meeting. The Planning Board supports the construction of 51
parking spaces initially with 49 additional spaces to be
constructed if needed in the future. The site plan for the
project showing 51 spaces maintains a residential quality as the
amount of paved area is reduced.
Therefore Planning Board supports the variance requested to
allow the applicant to construct the project with 51 parking
spaces.

Provisions of the Town's Zoning Bar- law in relation to a proposed
"assisted living" development. 1 have not been provided with a
full description Qf the development, but 1 understand that it
will consist primarily of a series of apartment units to be
housed in a farmer motel complex.

that it would be classified as "multi family dwellings" undi;r the
Zoning By-Law.
The term 'assisted living" is not generally defined in the
Zoning By-Law, but it does appear in the definitions in section
13 , Conti.nuin Care Retirement Center, In section 13 . 3 .d.
"Assisted Living Units" is defined as "Dwelling units for elderly
individuals ar couples in need of assistance with activities of
daily living. Such dwelling units may not include facilities for
cooking or eating. " This definition -does neat, in lay opinion,
apply tQ the proposed "assisted living'.,1 project. First, under
t'h6 terms of the bylaw, the definition in §13 .3 is intended to
apply to Continuing Care projects (which require a special
Permit) . Second, the term "assisted living" , as used in the
proposed project, appears primarily to be a marketing term or a
team of art in the housing field. it is not a phrase with a
fixed meaning for zoning purposes. This is especially evident in

indicating Rich Boettcher's consent to using the name Heritage at North Andover for our
new Assisted Living Community. As you and I have discussed before, while I believe
Rich has given his agreement (reluctantly) for us to use this name, it would be helpful for
me to assure that in fact we get this letter of consent. Therefore, I am wondering if I
could impose on you to perhaps place a call to him and ask him if he would be willing to
provide such a letter so that I can satisfy the Planning Departments requirement.

This letter will confirm our recent conversations concerning the use of the
name "Heritage at North Andover" for you new Assisted Living Community. As
discussed I feel the use of this name could lead to some confusion in the future
due to other areas within North Andover using a combination of the name
"heritage". I am reluctant for you to use this name in your trade name as a
location but I can not restrict your use of it.
As further discussed, I indicated my involvement as the 9-1-1 Coordinator
was to insure no duplicate or sound-a-like street names were creating problems.
The address for your new Assisted Living Community is 700 CHICKERING ROAD and
"Heritage at North Andover" is not your street address. Because of this fact
it does not fall under the 9-1-1 guidelines. You are using "Heritage at North
Andover" as a location name and not as your street address.
I urge you to educate your residents and staff the proper address for your
facility is 700 CHICKERING ROAD.

Elder Services of the Merrimack Valley, Inc. is a private nonprofit agency on contract with the state and
federal governments to provide comprehensive screening, assessment and monitoring of the long term
care needs of elders throughout the Merrimack Valley. As the federally designated Area Agency on
Aging,we also have the responsibility of monitoring the quality of care provided in all the long term care
facilities in our service area. Based upon this experience, I can testify to the excellent reputation and
quality of care provided by ADS Management and offer our full support of their efforts.
It is my understanding that ADS plans to develop a unique studio and two room apartment design, and

As you have undoubtedly witnessed, construction progress is moving along at a rapid pace
at the site of the former Merrimack Valley Motor Inn. We have had good weather in
these early weeks, and have been working hard to take full advantage of this before the
winter sets in.
We are currently on schedule with construction, now that foundation walls are in. We
expect to be pouring the foundation slab in the next two to three weeks, with initial paving
of the front parking/driveway area to take place before Thanksgiving. This will allow us
to begin the structural framing and start the actual process of constructing the building.
We have received a number of calls from individuals in North Andover inquiring about
residency at Heritage at North Andover and have been delighted with the high level of
interest. While it is too early to provide any particular statistical updates, our early
information certainly confirms the need for housing of the type we are developing. Any
people you know who might be interested in being placed on our mailing list should call
508-683-1300 as we will be sending out periodic newsletters and other updates to these
individuals in the coming months.

of Meadow View Condominium which abuts the site of the proposed
A. D . S . Elderly Services , Inc . , ( A . D . S . ) elderly housing
development .
0n behalf of Meadow View Condominium , we wish -to state that
members of our Board have been contacted by and met with a number,
of representatives of A. D . S . , who have demonstrated concern for the
residents of Meadow View in an effort to ensure that a good
relationship will exist between our complexes in the future .
The consensus of Meadow View representatives is very favorable
to the A . D . S . project and those connected with its development . It
is our opinion that the proposed development will be an asset to
our neighhorhood , the comnsunit-v and the Town of North Andover in
general . We therefore hope that you will act favorably on said
applications ,
Nonetheless , as part of the application process , and to ensure
that our obligation to the beneficiaries of the Meadow View Trust:
are islet , we are bringing the following concerns to your attention
so that you and A . D . S . may Formally address same in the conditions
and/or covenants which you may impose on the project in the event
of approval . A . 0 . S . has already addressed many of these concerns
in their plans presented to us ,
1 ) As you may be aware , Meadow Vicw consists of 168 residental
units , many of which are in close proximity to the proposed

development . Therefore , there is apprehension relative to the
impact of demolition and construction noise to our residents . We
request restrictions that construction and demolition be limited to
between the hours of 7 a . m. and approximately 7 p .m.
2 ) Blasting , if necessary , should be strictly limited to mid-day
hours with appropriate supervision by municipal authorities .
3 ) Trucking of supplies and use of heavy equipment should also be
restricted to hours of construction .
4) Sunday and Holiday construction should not be permitted or
specially licensed .
5 ) The existing vegetative buffer between the properties should
not be disturbed . We understand that plans are to remove present
asphalt areas closest to Meadow View and increase the vegetation in
these areas . This is highly des ireable to Meadow View . Any
modification in location of proposed structures or improvements
placing same closer to Chickering Road on the site would be
acceptable to Meadow View.
5 ) As Meadow View lies below grade level of this project , we are
very concerned about water drainage effecting our complex and
particularly basement units . We understand that proposed plans
provide for grading and drainage to be directed away from Meadow
View . We are informed that engineering plans have been revised to
address our concerns and a retention area is proposed . We would
request that attention to these matters be made from commencement
of construction
7 ) We request that all roof , walkway , driveway and parking area
run offs be directed into the storm drain system (with appropriate
tra ;s . if necessary ) and said system be linked to that existing on
Route 125 . Gutter systems on buildings should be required .
B ) Any steps which would decrease the shedding of surface waters
in the direction of our complex would be desireable to Meadow View .
This would include our strongly favoring the application for a
variance to allow minimal parking facilities which is being
requested in view of the proposed use of the premises and the
resultant minimal automobile ownership by residents therein .
9) A future change of use of the premises from elderly assisted
living to more general residential use should also be restricted by
appropriate covenants of appropriate duration which Mould run with
the land and bind successors and assigns .

10 ) Because of height variations between the properties , we are
concerned about lighting restrictions in the vicinity of buildings
closest to the property line . We also are concerned about privacy
considerations relative to the height of structures closest to
existing buildings .
11 ) The length of the actual construction period might also be
limited so as to minimize the impact to our residents . There is
concern about construction litter and dust effecting our premises ,
particularly in the summer months , as our pool area is in close

stabilization of exposed earth and materials might also be provided
for in conditions .
12 ) Bonding and Insurance . Although we do not have any desire to
increase the financial burden on the developer , in order to address
any problems which may arise in the demolition and construction
process , we believe that reasonable bonding and security is an
essential component in the enforcement of conditions placed upon
the project .
As previously stated , we beileve that most of these concerns
have been anticipated and addressed by A . D . S . We believe that this
is an important and major project and are confident that you will
give appropriate attention to these matters .
We are hopeful that you will act favorably on the applications
before you , and look forward to an amicable relationship with our
proposed new neighbors .

Provisions of the Town's Zoning By-law in rslation to a proposed
"assisted living" development. I have not been provided with a
full description Qf the development, but I tXndi�rstand that it
will consist primarily of a series of apartment units to be
housed in a former motel complex.
Based on my understanding of this project, it is my opinion
that it would be classified as "mul,ti-family dwellings" under the
Zoning By-Law.
The term "assisted living" is not generally defined in the
Zoning By-Law, but it does appear in the definitions in section
13 , Cont.i.nuinq Cara Retirement Canter, In section 13 . 3 .d.
"AsQisted. living Units" is defined as "Dwelling units, for elderly
individuals or couples in need of assistance with aotiviti.es of
daily living. Suoh dwelling units may not include facilities for
cooking or eating. " This definition •does not, in my opinion,
apply tQ the proposed "assisted living," project. First, under
the terms of the bylaw, the definition in §13 . 3 is intended to
apply to Continuing Care projects (which require a special
permit) . Second, the term "assisted living' , as used in the
prQpased project, appears primarily to be a marketing term or a
term of art in the housing field. it is not a phrase with a

2 . Prior to the endorsement of the plans by the Planning Board

Site Plan Review Bond
Dear Mr. Grape,
In reviewing the Planning Department file for this project it has come to our attention that the
Planning Board is holding a$2,000 bond for the completion of the project. A final as-built plan
showing the location of all on site utilities, structures, curb cuts,parking spaces and drainage
facilities must be submitted to and approved by the Division of Public Works. Once the
Planning Department receives notification from Public Works that the plan is complete,the
Board will vote to release the bond.
