Thank you for the update on the planning Board decision regarding 200 Chickering
Road. As I mentioned, The Trustees of Reservations Executive Committee (EC)
voted to recommend to the Standing Committee to accept the donation of the parcel.
The Standing Committee meets next month, and I expect they will accept the
recommendation of the EC.Below is the vote as accepted.

Dear Mark:
As per your request, DJK Associates, Inc. has evaluated the traffic generation impacts
relative to the above references site.
The initial Traffic Study was conducted in July 1996 and was updated during October
1996. The Updated Traffic Study was based on 17,500 square feet (SF) of retail floor
space. The current project calls for 16,500 SF of retail floor space plus 7,500 SF of
office space. Table 1 summarizes the traffic generation characteristics used for the
most recent October 1996 Traffic Study and the traffic generation characteristics for the
current proposed project.
As shown by Table 1, in all cases the current project would generate less traffic than the
previous project.

b) All dumpsters must be placed on concrete pads and enclosed on all sides with a
permanent fence. The location of the dumpsters must be reviewed and approved
by the Board of Health and Fire Department for conformance to their regulations.
2) Deliveries:
a) To the site must be limited to between the hours of 7:00 a.m. and 9:00 p.m. with
the exception of individual vendors approved by the Board of Health.
3) Hours of Operation:
a) The hours of operation of the retail/office complex will be between the hours of
6:00 a.m. and 12:00 midnight.
4) Parking/Uses:
a) The site as currently configured contains sufficient parking for retail/office
use only. No restaurants, seats, booths, stools, counters or table for eating or
drinking will be allowed without the closing off of some of the existing
office/retail space or the creation of additional parking spaces in a umber
sufficient to meet the requirements of the Zoning Bylaw.
5) Prior to the endorsement of the plans by the Planning Board, the applicant must
comply with the following conditions:
a) A FORM A plan must be submitted to the Planning Board for review and
approval separating the "back land"as shown on Exhibit A which will be
donated to the Trustees of Reservations.
b) The final plan must be reviewed and approved by the engineering
consultant, DPW and the Town Planner and subsequently endorsed by the
Planning Board. The final plans must be submitted for review within
ninety days of filing the decision with the Town Clerk.
C) A bond in the amount of ten thousand dollars ($10,000) shall be posted
for the purpose of insuring that a final as-built plan showing the location of
all on-site utilities, structures, curb cuts,parking spaces and drainage
facilities is submitted. The bond is also in place to insure that the site is
constructed in accordance with the approved plan. This bond shall be in
the form of a check made out to the Town of North Andover. This check
will then be deposited into an interest bearing escrow account.

In the Year One Thousand Mine Hundred and Ninety-five
AN ACT RELATIVE TO THE ASSAULT, ABUSE, NEGLECT AND FINANCIAL EXPLOITATION
OF AN ELDERLY OR DISABLED PERSON.
Be it enacted by the Senate and House of Representatives In General Court
assembled, and by the authority of the same, as follows:
SECTION 1. The first paragraph of section I of chapter 188 of the General
Laws, as appearing in the 1994 official Edition, is hereby amended by striking
out, in line 18, the word "stand." and inserting in place thereof the follow-
ing word:- stand;,- and by adding the following clause:-
(6) upon an execution issued from a court of competent jurisdiction to
enforce its judgment based upon fraud, mistake, duress, undue influence or
lack of capacity.
SECTION 2. Section 26 of chapter 218 of the General Laws is hereby
amended by inserting after the word "twenty-eight", in line 44, as so appear-
ing, the following word:- , thirty.
SECTION 3. Said section 26 of said chapter 218 is hereby further amended
by striking out, in line 43, as so appearing, the words "section fifteen A"
and inserting in place thereof the following words:- sections fifteen A and
thirteen K.
SECTION 4. Chapter 265 of the General Laws is hereby amended by inserting
after section 13J the following section:-
Section 13K. (a) For the purpose of this section the following words
(shall, unless the context requires otherwise, have the following meanings:-
"Bodily injury", substantial impairment of the physical condition, includ-
ing, but not limited to, any burn, fracture of any bone, subdural henatoma,
injury to any internal organ, or any injury which occurs as the result of re-
peated harm to any bodily function or organ, including human skin.
"Caretaker", a person with responsibility for the physical care of an e
der or person with a disability, which responsibility may arise as the result
lof a family relationship, or by a fiduciary duty imposed by law, or by a vol-

untary or contractual duty undertaken on behalf of such elder. or person with

§ 11. Notice requirements for public hearings; parties in interest defined; review of special permit petitions;
recording copies of special permit and variance decisions
In all cases where notice of a public hearing is required notice shall be given by publication in a newspaper of general
circulation in the city or town once in each of two successive weeks,the first publication to be not less than fourteen days before
the day of the hearing and by posting such notice in a conspicuous place in the city or town hall for a period of not less than
fourteen days before the day of such hearing. In all cases where notice to individuals or specific boards or other agencies is
required,notic shall e sent by mail,postage prepaid. "Parties in interest" as used in this chapter shall mean the petitioner, -
abutters,owners of land directly opposite on any public or private street or way, and abutters to the abutters within three hundred
feet of the property linN of the petitioner as they appear on the most recent applicable tax list,notwithstanding that the land of any
such owner is located in another city or town, the planning board of the city or town,and the planning board of every tting city.

authority the names and addresses of parties in interest and such certification shall be conclusive for all purposes. permit
granting authority or special permit granting authority may accept a waiver of notice from, or an affidavit of actual notice to any
party in interest or,in his stead, any successor owner of record who may not have received a notice by mail, and may order special
notice to any such person, giving not less than five nor more than ten additional days to reply.
Publications and notices required by this section shall contain the name of the petitioner, a description of the area or premises,
street address,if any, or other adequate identification of the location, of the area or premises which is the subject of the petition,
the date,time and place of the public hearing, the subject matter of the hearing, and the nature of action or relief requested if any.
No such hearing shall be held on any day on which a state or municipal election,caucus or primary is held in such city or town.
*13683 Zoning ordinances or by-laws may provide that petitions for special permits shall be submitted to and reviewed by one
or more of the following and may further provide that such reviews may be held jointly:--the board of health, the planning board
or department,the city or town engineer,the conservation commission or any other town agency or board. Any such board or
agency to which petitions are referred for review shall make such recommendations as they deem appropriate and shall send
copies thereof to the special permit granting authority and to the applicant; provided,however,that failure of-any such board or
agency to make recommendations within thirty-five days of receipt by such board or agency of the petition shall be deemed lack
of opposition thereto.
Upon the granting of a variance or special permit, or any extension,modification or renewal thereof,the permit granting
authority or special permit granting authority shall issue to the owner and to the applicant if other than the owner a copy of its
decision,certified by the permit granting authority or special permit granting authority, containing the name and address of the

owner, identifying the land affected, setting forth compliance with the statutory requirements for the issuance of such variance or
permit and certifying that copies of the decision and all plans referred to in the decision have been filed with the planningboard
and city or town clerk. No variance or special permit, or any extension,modification or renewal thereof, shall take effect until a
copy of the decision bearing the certification of the city or town clerk that twenty days have elapsed after the decision has been
filed in the office of the city or town clerk and no appeal has been filed or that if such appeal has been filed,that it has been
dismissed or denied, and if it is a variance or special permit which has been approved by reason of the failure of the permit
granting authority or special permit granting authority to act thereon within the time prescribed, a copy of the application for the
special permit or petition for the variance accompanied by the certification of the city or town clerk stating the fact that,the permit
granting authority or special permit granting authority failed to act within the time prescribed and no appeal has been filed and
that the grant of the application or petition resulting from such failure to act has become final or that if an appeal has been filed,
that it has been dismissed or denied, is recorded in the registry of deeds for the county and district in which the land is located and
indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner's certificate of title. The
fee for recording or registering shall be paid by the owner'or applicant.

0. ) ABUSE OF MECHANICAL SYSTEM. The Trustees may charge to a Unit
Owner any damage to the mechanical, electrical or other building
service system of the Condominium caused by such Unit Owner by
misuse of those systems.
CAR KEYS. If a Unit Owner entrusts a car key to any employee of
the Condominium for purposes of moving the car or having access to
the car, the entrusting of such keys shall be a the sole risk of
the Unit Owner or Owners of the car key and the Trustees in no way
be liable for any injury, loss or damage resulting directly or
indirectly from- such entrusting of a car.
LO. ) NO OFFENSIVE ACTIVITY. No noxious or offensive activity shall be
carried an in any Unit, or in the common areas and facilities, nor
shall anything be done therein, either willfully or negligently,

Notes:Please review the attached settlement agreement as per the Board's discussions Tuesday

As we discussed this past Wednesday, The Trustees of Reservations is very
interested in, accepting the donation of land at 200 Chickering Road in North
Andover, Our staff is in agreement that it would make a valuable addition to the
Stevens-Coolidge Place.
There are three steps we must follow before we can formally accept the donation of
the property. First, we require review of the site plans when they are made available.
Second, we will conduct routine reviews to satisfy ourselves that potential liabilities
(issues of title, hazardous waste contamination, etc.) are nonexistent or at least
manageable. Finally, we require our internal board approvals. I do not expect any
problems in completing the steps within your two month time frame.
I look forward to hearing from you regarding the site plans, and working with you on
the completion of the transfer. in the meantime please feel free to call me if you have

As part of the response to the Planning Board's questions during their meeting on 07/21/98, 1 am writing
to individually address Items 3 and 4 listed in your summary/letter 07/22/98.
Response to item#3, rear of building appearance
As a result of developing the plan lay-out and proposed areas for the second floor offices,
revisions and massing reductions of the building at the rear were made.
Enclosed herewith are revised building elevations, which I hope address the Planning Board's
concern with the less detailed, rear appearance of the building, previously shown.
Response to item #4, noise mitigation of HVAC roof top units
Heating and cooling requirements for this building require sizable equipment. Our design
suggests a split system, where approximately half the equipment is located within the building and
will have no adversary noise impact. The remaining roof mounted equipment(condensing units)
will be placed in screened and/or recessed roof areas, with acoustically dampening treatment,
reducing reverberation and arresting the travel of sound.
