COVENANT WITH THE INHABITANTS
OF THE TOWN OF NORTH ANDOVER
I , Charles F. Doe, Trustee of Doe Family Trust u/d/t
dated April 30, 1980 and recorded at Essex North Registry of
Deeds in Book 1930 , Page 181 on January 20, 1985, of Mack
Road, Woburn, Mass• , being the record owner of a parcel of
land situate in North Andover, Essex County, being more
particularly described in North Essex District Registry of
Deeds Book 2844, Page 164 •
represents that the above.-described land is proposed
for a change in use from Residence-3 ( R-3) to Business 2
District in Article 34 of the Warrant for the Town Meeting of
the Town of North Andover scheduled for May 6 , 1991 does
covenant and agree with said Town of North Andover as
follows :
In the event that the above described land is rezoned
at the said May 6 , 1991 meeting or any valid
postponement thereof, I , together with my heirs,
successors and assigns agree that any deed of
conveyance of the above-described land shall contain
the following restriction as to use: "that the grantee
and successors and assigns will use the parcel solely
for the operation of an eating and drinking
establishment with accessory uses associated with the
principal use .
This agreement shall act as a restriction running with
the land as a result of rezoning to Business 2 District at
the Town Meeting of May 6, 1991 or any valid postponement
thereof.
IN WITNESS WHEREOF, I, the undersigned have caused this
instrument to be executed as a sealed instrument this 6th day
of May, 1991 .
