The points upon which this application is made are as follows: 1. The retail building that is proposed represents the most reasonable use of the land. The parcel is zoned General Business which allows for retail uses. The use within the building will be preparation and sale of food products for consumption off- site. The existing building is too small to accommodate commercial uses,which is why it has remained vacant for so long. The proposed one-story building will be compatible in terms of both use and appearance with the building on the adjacent lot (Sal's Pizza). 2. While it was necessary to get several variances from the Zoning Board of Appeals for building setbacks, this proposal will not result in an overcrowding of the land. Currently the site is occupied by a vacant building surrounded entirely by pavement. As part of this project, extensive areas of existing pavement will be removed and replaced with landscaping. The open curb cut on Main Street will be reduced in width and the curb cut on Chickering Road eliminated entirely. By reducing the amount of pavement and providing green areas around the perimeter of the site, the net effect will be less impervious area and more green space than what currently exists. 3. The removal of an abandoned building and the construction of a new architecturally pleasing building with new parking and landscaping on this parcel will improve the value of the land and of the surrounding buildings. 4. As part of this project the existing curb cut on Chickering Road will be eliminated. Access to the site will be entirely from Main Street through a new curbed entrance. This will eliminate traffic conflicts on Chickering Road and provide for controlled traffic movement into and out of the site. 5. This project will not result in undue concentration of population. The nature of the use of this building will result in brief visits by customers spread throughout the course of the day. 6. The massing of the proposed building will still allow for adequate light and air both on-site and off. The scale of the building is compatible with the existing building in the area. 7. The new building will present less of a fire hazard than the existing building. An existing hydrant is located within 60 feet of the building. The proposed building presents no hazards to the population. 8. The construction of a new retail building on the site will provide additional tax and utility(water and sewer)revenues to the town while having no impact on the school system. 9. Due to the location of this parcel along Main Street and Chickering Road, no wetlands, watercourses, or water bodies will be impacted by this project. 10. This parcel is not located in a flood hazard area therefore there is no probability of loss from flooding. 11. The applicant for this project, Sal Lupoli, sees a need for a food takeout business at this location. The demolition of the former Dairy Queen building and the construction of a new building, parking lot and landscaped areas will result in an improvement in the visual character of the area and will be an amenity to the Town of North Andover. In preparing these plans for the Special Permit Granting Authority, all of the conditions contained in Section 10.31 have been met: a. This lot is zoned General Business. The use proposed for the new building is allowed by zoning and is compatible with the existing uses within the area. b. The use proposed on this site will compliment the use on the abutting parcel (Sal's Just Pizza)and will not adversely affect the neighborhood. c. By eliminating the curb cut on Chickering Road and reducing the opening of the curb cut on Main Street,the site will improve both traffic and pedestrian flow. The crosswalk to the school on Main Street will be relocated, further from the intersection. The site layout will not result in a nuisance or hazard to vehicles or pedestrians. d. The building layout and parking area will provide for proper operation of a food takeout facility on this site. Town water and town sewer, gas, electric and telephone services are all available and adequate to service the building. Stormwater runoff will be collected in a closed drainage system that will connect to the existing system in Chickering Road. e. The use proposed on this site is consistent with the intent and spirit of the Zoning By-law and represents the best possible use of this land.
