Box 1016 North Andover, MA 01845 RE: Lot 3 Gray Street,North Andover,MA Dear Mr. Serwatka, The proposed septic system design plans for the above site dated April 15, 2004 and received on November 16,2004 have not been fully reviewed because of some major design issues. The following items are in need of attention prior to a full review: 1. The soil tests performed on August 24, 2004 are not located, nor logged on this plan. Additionally,the overnight soak for the percolation test was never completed, so the percolation rate used to determine the LTAR is invalid. 2. The ESHGW based on the August soil test was at 30", not 36"used in design. 3. Please review the DEP approval letter for the gravel-less chambers being used and provide design data as required in section L3 showing that a fully compliant conventional system could be located on this site. Please feel free to contact the office with any questions you may have. We look forward to working with you to obtain a septic system which will be in compliance with all regulations and assure protection of public health and the environment of North Andover. These plans dated April 15,2004, final revision date August 26,2005,have been approved for a four(5)bedroom,maximum 11-room home. The design has been approved for use in the construction of a new onsite septic system. This approval for construction is valid for three years from the date of this letter and during this time a licensed septic system installer must obtain a permit and complete this work. Prior to an occupancy sign off,the installer and designer must endorse an Installation Certification,an acceptable final as-built must be submitted,all final grading, looming and seeding over the system must be completed and subsequently the Town of North Andover will issue a Certificate of Compliance. This approval is subject to the following conditions: 1. If site conditions are found in the field to be different from those indicated on the design plan and/or soil evaluation,the originally issued Disposal System Construction Permit is void, installation shall stop,and the applicant shall reapply for a new Disposal Systems Construction Permit(3 10 CMR 15.020(1)). 2. The issuance of the disposal works construction permit is contingent upon the receipt of a foundation as-built of the dwelling. The as-built must be in a scale of 1"=20`. The Health Department must also view a copy of the floor plans for verification of the size of the proposed structure. 3. It is the responsibility of the applicant and/or the applicant's septic system designer, septic system installer or other representative to ensure that all other state and municipal requirements are met. These may include review by the Conservation Commission,Zoning Board, Planning Board, Building Inspector, Plumbing Inspector and/or Electrical Inspector, The issuance of a Disposal System Construction Permit shall not construe and/or imply compliance with any of the aforementioned requirements. Please let me know if they want to use a different product. Make sure it is appropriate for this use. Hundreds of flushes a day!! Also, Lot 3 Before I approve it, I would like you to include more detail on the wall and the barrier. You should note that a minimum of 40 ml polybarrier must be used. I woul like the barrier drawn in on the plan view so the installer knows where you want to put it. Usually it is at the 5 foot, but I want to know where you want it. The placement will affect the height of the wall would think. Also note if any of the wall is going to need a geomembrane if it is over 4 feet. As you may remember, the entire area between the foundation and test pit had been lowered by several feet. The current:grade in the area of our recent test pit is at about 199 feet, with a grade of about 202 feet near-the foundation. I have assumed groundwater at 36 inches,to be conservative, for the additional trench(now trench 1). As we discussed, this is berg alone to account for the possibility that the homeowner may finish the basement sometime in the future. The house, as constructed, has four bedrooms. In response, I offer the following: 1. The term "Gray Street" has been added to the sheet. 2. As stated on previous letters, a separate map and lot number will not be available until the assessor has updated his maps. 3. The immediately abutting lots are all part of the subdivision, except for the property across Gray Street. That abutter has been noted. 4. Bouyancy calculations have been provided for the septic tank. 5. The slope of the building sewer has been shown. 6. A rubber roof membrane has been specified for behind the wall. 7. Minimum and maximum cover has been shown in the profile, and the breakout elevations are shown in section A-A. S. The 196 contour has been moved to 15' from trench 3. 9. The contours have been revised to provide 6' separation. 10. Groundwater for trench 2 was interpolated originally at 40", which is appropriate for the area between the two test pits. 11. I offer the following in response: 1. The soil tests performed on August 24, 2004 were located some 40-50 feet upslope from the 2002 approved soil testing, and were done in an attempt to relocate the house. We have chosen to use the approved 2002 soil and perc testing, which is adequate and valid. Contrary to your letter, the LTAR used to design the system is valid. I respectfully request that your consultant continue review the submitted plan in a timely manner. 2. As mentioned above, we decided not to relocate the house, and therefore the August 2004 soil testing is not used. The 2002 soil and percolation testing is valid, and the ESHGW from that testing is valid. Again, I respectfully request that your consultant review the submitted plan. 3. The DEP approval letter for the gravel-less chambers does not state that a conventional gravel system must be designed for the site before the gravel- less system can be used. It states that the gravel-less"system may be installed on all facilities where a system in compliance with 310 CMR 15.000 exists on site or could be built and for which a site evaluation in compliance with 310 CMR 15.000 has been approved by the local approving authority". We have approved site evaluation forms for the subject lot which were performed in 2002 under the supervision of the Health Agent and the Town's consultant. These forms allow us to submit a design plan for the lot using appropriate materials and methods. Gravel and gravel-less systems are approved by DEP for general use. I submit septic system designs throughout the north shore and Massachusetts, and never have I seen the requirement to, in essence, design the system twice as implied by your letter. I have spoken with other engineers and health agents, and none are aware of any requirement to provide a gravel design prior to being allowed to use a gravel-less design. The DEP approval is
