This is written in response to your recent letter notifying the Massachusetts
Highway Department(MassHighway) that a former Dairy Queen building will be
demolished and a new building will be constructed.
MassHighway regulations stipulate that all structures must be set back a minimum
of twelve(12) feet from the State Highway Layout(property)line.

The Applicant submitted plans and documents to VHB for review in May, 2000. The site plan
submission was reviewed for conformance to the appropriate sections of the 1972 Town of North
Andover Zoning Bylaw reprinted in 1998 and standard engineering practice. The following
comments note non-conformance with specific sections and questions/comments on the proposed
design.
1) After reviewing the dimensional requirements of Table 2—Summary of Dimensional
Requirements and section 8.5 of the Zoning Bylaw, it appears that the dimensional
requirements are satisfied with the exception of Lot Area, Street Frontage,Front Setback,
Side Set Back and Rear Set Back. The Applicant is requesting a variance from these
requirements.
2) The following information is required by Section 8.3.5 and VHB offers the following
comments:
a) EASEMENTS/LEGAL CONDITIONS: Note number 8 on sheet 2 of 5 suggests that
other rights,restrictions and easements may exist, other than what is shown on the plan.
The Applicant suggests that a title examination may reveal these other rights,restrictions
or easen-entq. The Applicantis roquired toidentify a!!eassem-ents and le4p-11
encumbrances that are related to the site's physical development. The Applicant should
investigate this further.
b) STORMWATER DRAINAGE/DRAINAGE BASIN STUDY: See comments below
under"Drainage Review".
c) REFUSE AREAS: No refuse area is proposed for this development. However,the
Applicant states that an existing refuse area on the adjacent property will be utilized.
d) TRAFFIC IMPACT STUDY: The Applicant has not submitted a Traffic Impact Study
or any traffic data for the proposed development.

e) COMMONWEALTH REVIEW: As work is proposed within the state highway layout
of Chickering Road(Route 125 & }33)' the Applicant io required W apply to the
Massachusetts Highway Department(MHI) hx appropriate permiim. V8Brecommeudu
that the Applicant obtain all necessary MB]0permits.
3) DRAINAGE REVIEW: The proposed drainage design iou closed drainage system that
booludua xcutob basin and two drain ouuobo\ea. Drainage calculations were also submitted.
We offer the following comments regarding the proposed drainage design:
a\ The contributing area calculations iu the drainage calculations do not appear toinclude
the roof orthe sidewalk areas. The&oD|icuot should revise the oulcoia1iouu as
necessary. Also, the Applicant should identify where the runoff from the roof area is
going.
b) VHB recommends that four(4)foot sumps be proposed in proposed catch basins, The
Applicant should revise the detail.

located at existing CB-2 has the capacity io accommodate the additional flow resulting
from this development.
4) STANDARD ENGINEERING PRACTICE: VBB has reviewed the site plans for

• Several details have item number references. It is not clear what these numbers refer to.
VllI5 recommends that these item numbers be removed.
• The plan indicate that u2'ioob vvaiez service is proposed,yet the detail shows u l-inub /
copper service. VBB recommends that the plan and the details hecoordinated.
Itisrecommended that the applicant provide WRITTEN RESPONSES to the ixmoea and
comments contained herein.

Dear Planning Board Members,
I first want to apologize for not being in front of you tonight, I am out of town and
could not change my plans. As you are aware the post two meetings have
been delayed and this date falls on an unchangeable time frame for myself.
I would have passed on this meeting until next month, but because of a
particular problem with this property, time is of the essence.
My brothers, who are also the owners of Sal's Just Pizza and my engineering firm
are present. I have worked very closely with the planning department and I
hope I have covered all my bases. I hope that the board feels that this is a
positive project.
If the board could see fit to grant this project tonight I will certainly address any
conditions if there are any, immediately. I hope that I have proved myself to the
board on my past projects, I have been in the community for almost ten years
and I intend on making the town of North Andover proud to have our business
there.
