Site Plan Review
through Special
Permit Process
Dear Mr. Long :
The North Andover Planning Board held a public hearing on
November 9 , 1987 , in the Town Hall Library/Conference Room
upon the application of Positive Start Realty Trust, 21 Clark
Street, North Andover. The hearing was duly advertised in the
North Andover Citizen on October 22 and October 29 , 1987 . The
following members were present and voting: Paul' Hedstrom,
'Chairman; George Perna, Vice-Chairman; John Simons , Clerk;
and John Burke. Erich Nitzsche was absent.
The petitioner seeks a Special Permit under Section 8 . 3 of
the North Andover Zoning Bylaw. The purpose of the Site Plan
Review is to review the proposal to construct an addition of 100x100
feet, two story building to an existing building on 2 . 66 acres
of land on the East side of Clark Street in an Industrial-2 (I-2)
Zoning District.
John Burke read the legal notice to open the public hearing.
Letters from the Conservation Commission, Board of Health,
Police Department and the Fire Department were read. James Rand of
JJB Associates presented the Board with the plans.
MOTION: By John Burke to close the public hearing and take the
matter under advisement.
SECOND: George Perna
VOTE: Unanimous
On December 3 , 1987 the Planning Board held a regular
meeting with the following members present and voting:
Paul Hedstrom, Chairman, George Perna, Vice-Chairman,
John Simons, Clerk, and John Burke .
MOTION: By John Burke to approve the Site Plan subject to
nine conditions.
SECOND: John Simons
VOTE : Unanimous

DeRosa Trucking Company - Special Permit Site Pjan' Review
The Planning Board made the following fin( a�ng'� tsar ing this
Special Permit: "` ' t
1 . The proposed use and site design of the expansion of the
existing building is appropriate due to its location in
Town.
2 . . The site improvements called for under this Special Permit
will clean up a number of existing problems found on the
site . The improvements will upgrade the use of the site
and better utilize the property.
3 . The applicant has met the requirements of the Town for
Site Plan Review as stated in Section 8 . 3 of the Zoning
Bylaw.
Upon reaching the above findings , the Planning Board votes to
approve this Special Permit based upon the following conditions :
1 . Letters submitted by the Lawrence Airport Commission and
the FAA, that the construction proposed by this site plan
will not have an adverse impact on airport operations .
Any improvements asked for by the Commission or the FAA shall be
incorporated 'as a condition of this approval.
2. The existing trees found on the site shall be' preserved.
3. All lighting shall be directed onto the site and no
lighting shall be cast onto any adjacent property.
4 . A fire hydrant shall be installed near the Northeast
corner of the new structure .
5. All fire safety standards outlined in the letter from the
Fire Chief, dated October 15 , 1987 shall be incorporated
in the structures found on this site.
6. All equipment currently stored on and off of this lot
shall be removed and placed only in areas designated on
the site plan for the outside storage of vehicles . All
vehicles so stored shall have a valid vehicle registry
with state . All exterior storage areas shall be paved.
7 . The landscaping plans submitted shall be followed. All
planting materials shall be planted prior to a Certificate
of Occupancy is issued for any new structure built on this
site .
8 . The steep slopes found along the property lines adjacent
to Noren Realty and Airport Commission property shall be
stablized with planting .
9 . The applicant shall improve the roadway adjacent to his
lot to current Town standards , prior to issuance of a
Certificate of Occupancy by the Town.

The following plans shall be adopted upon condt3onaliapproval
granted by the Planning Board:
Plans entitled: Positive Start Realty, prepared by Joseph Borgesi,
JJB Associates, dated August 8 , 1987 , revised November 3 , 1987 .
Landscaping Plan entitled : Positive Start Realty, prepared by
John Tullock, Jr. , dated November 4 , 1987
