HISTORY AND BACKGROUND
On or about on May 6, 2005, the Applicant, Watts Regulator, filed an Application for Site Plan
Review Special Permit with the Planning Board pursuant to Section 8.3 of the Town of North
Andover Zoning Bylaws. On January 20, 2006,the Planning Board unanimously voted to grant
the Applicant a Site Plan Review Special Permit for the Premises Affected, and proceeded to
issue a Special Permit Decision approving the Project.
By facsimile, dated August 6, 2007, the Applicant (through their engineering consultants, Dutton
& Garfield) requested a determination of insubstantial change with respect to certain proposed
adjustments to the approved Site Plans in accordance with Special Condition No. 18 of the Site
Plan Special Permit Decision, as well as Section 8.3 of the North Andover Zoning Bylaws,
which authorizes the Town Planner to make a determination of whether certain changes to the
site plans constitute substantial changes. Specifically, and as outlined in the facsimile Letter and
attached plan, the proposed plan adjustments relate to the orientation and location of the
proposed fencing behind the parking lot expansion located to the south of subject property and
the abutting the residential properties.
FINDINGS OF FACT
Pursuant to my authority as Town Planner pursuant to Section 8.3 of the Zoning Bylaw, I have
reviewed the Letter with regard to the proposed adjustments to be made to the approved Site
Plans identified in the above-referenced Site Plan Special Permit Decision. The relocation of the
fence will preserve several of the trees of significant caliper that currently provide natural
buffering between the subject property and the abutting residential properties. The relocation of
the fence will have a diminutive impact on the neighborhood and shall provide sufficient
screening and buffering. Further, the relocation of the fence will have no effect on the approved
landscape design and the number and type of required plantings. Based upon the foregoing, I
have determined that the proposed plan adjustments shown on the hand sketched plan entitled
Watts Industries
815 Chestnut Street, 107C,Parcels 22&71

"Fence Relocation", prepared by Dutton and Garfield are not substantial changes but are in fact
minor, insubstantial changes, subject to the following conditions.
CONDITIONS
The Town Planner's finding of no substantial change is conditioned on the following:
1. Watts Industries and its successors agree that the location of the proposed fence shall be
staked in the field. A meeting shall be scheduled with the Town Planner for review and
approval of said fence location.
2. Watts Industries and its successors agree that said fence shall be consistent with the
materials,type, style, height, and length approved in the referenced Site Plan Special
Permit decision. Further, the fence will be located within the same or similar horizontal
plane of the approved fence and be located at a minimum of 15 feet from the edge of the
parking lot on the southerly side of the project area abutting the residential properties.
3. Watts Industries and its successors agree that upon the completion of the fence and
natural buffer on the southerly side of the project area abutting the residential properties,
the Town Planner will review the site and any screening or buffering as may be
reasonably required at the discretion of Town Planner, both natural and manmade,will be
added at the applicant's expense.
4. That this Decision is recorded with the Registry of Deeds and evidence of recording is to
be provided to the Planning Department.
Accordingly, Watts Industries may proceed with the proposed relocation of fence in accordance
with the Site Plans referenced in the Special Permit Decision, as modified by the plan and
adjustments referenced above.
