The Applicant's engineer submitted plans and documents to VHB for review on January 12,
2002. The submission was reviewed for conformance to the October 2000 Rules and
Regulations Governing the Subdivision of Land,appropriate sections of the 1972 Town of North
Andover Zoning Bylaw amended May 2001 and standard engineering practice. The following
comments note non-conformance with specific sections and questions/comments on the proposed
design.
• General: VHB recommends that the leach trench detail be revised to show a geotextile
fabric placed between the existing ground and the proposed 1-�/2 inch stone.
• Section 4.136.4,g:To assure the good performance of the leach trench,VHB
recommends that the Applicant determine the seasonal high ground water elevation
where the proposed leach trench is located. The Applicant should note that in general,
two feet is provided between the bottom of the trench and the seasonal high ground water
elevation.
It is recommended that the applicant provide WRITTEN RESPONSES to the issues and
comments contained herein. AA

Specific Requirements
There will not be any degradation of the quality or quantity of water in or entering Lake
Cochichewick.
There is no reasonable alternative location outside the non-disturbance or non-discharge
buffer zones for any discharge, structure, or activity associated with the proposed use to
occur.
On site operations will not create concentrations of nitrogen in groundwater greater than the
Federal limit at the downgradient property boundary.

The Applicant submitted a plan,special permit application and cover letter to VHB for review.The special
permit submission was reviewed for conformance to the appropriate sections of the 1972 Town of North
Andover Zoning Bylaw as amended May 2000 and standard engineering practice. The following comments
note non-conformance with specific sections and questions/comments on the proposed design. VHB offers
the following comments:
1. (4.136.2.f)Based on the reference information shown on the plan,it appears that the lot was created
before October 24, 1994.The Applicant should verify this.
2. (4.136.3.c.iii)VHB assumes that the lot was created before October 24, 1994.According to Table 2,
the Non-Disturbance Buffer Zone is defined from the edge of wetland out to 100 feet within the
Watershed Protection District. It appears that the proposed pool falls within the Non-Disturbance Zone
This section states that construction of new permanent structure is prohibited within the Non-
Disturbance Zone unless a variance has been granted by the Zoning Board of Appeals. The applicant
should obtain the variance or relocate the proposed pool outside of the Non-Disturbance zone.
3. (4.136.4.c.iv) This section requires that a reasonable alternative location outside of the Non-
Disturbance or Non-Discharge zone be investigated. It appears that any proposed pool location would
fall within these zones. Therefore,it appears that there is no reasonable alternate location for the
proposed pool. VHB recommends that the applicant pursue a variance with the Zoning Board of
Appeals
4. It appears that the proposed cabana falls within the 30-foot setback.The applicant should relocate the
proposed cabana or request a variance.
It is recommended that the Applicant provide WRITTEN RESPONSES to the issues and comments
contained herein.

Please find enclosed a revised Site Plan for Lot 1 Great Pond Estates- Owners Sal &
Marie Vaudo. Please note the following additions to the plan as recommended in the
engineering review by VHB:
-A note has been added to the detail of the proposed leaching trenches stating
that Ater fabric shall be installed between the existing ground and the proposed
1-1/2"stone.
-A note has been added to the plan that confirms the applicant has determined the
seasonal high groundwater elevation in the vicinity of the proposed leaching
trenches and shall provide at least 2 feet of separation between the bottom of
the proposed leaching trenches and said seasonal high groundwater elevation.
Please note that the proposed separation is in fact 4.25 feet as shown.
