(VHB) relative to the subject project application for Special Permit. The following responses are presented in the order as the comments appear in their letter dated July 15, 2003. 1. SECTION 3 ZONING DISTRICTS AND BOUNDARIES The subject project site is located in the R-2 Zoning District, as indicated on the application for Watershed Special Permit as filed with the North Andover Planning Department(copy of Application attached). See note#2 which was added to the Site Plan. 2. SECTION 4.136 WATERSHED PROTECTION DISTRICT Section 2-Boundaries and Zones The lot was created in 1960, as indicated on the Application form. The project site is beyond the Non-Disturbance Zone and Conservation Zone of the Wetland Resource Area(bordering Vegetated Wetland), to our best knowledge. The nearby wetland area, located downslope of this proposed project, has been delineated in the field and shall be verified by the Conservation Agent soon. No work is proposed within 100' of the delineated area of wetland. The limits of the Conservation, Non-Disturbance, and Non-Discharge Zones have been added to the revised site Improvement Plan. Mr. Justin Woods July 21, 2003 Page 2 Section 3-Uses and Requirements The specific buffer zones, as mentioned above, have been added to the plan. Section 4- Special Permit Requirements 4-cii: See response under Section 3 above for status of revised plan, and wetland delineation. 4-ciii: A letter of certification is provided. There will be no degradation of water quality or the quantity of surface run off from their site, as the residential activity proposed will not generate excessive runoff and the proposed groundwater recharge basin will retain and infiltrate the collected runoff. 4-civ: The project is located outside of the Non-Disturbance Zone. In the Non- Discharge Zone, the proposed addition utilizes the existing driveway. 4-cvi: Fertilizers shall be used in minimal concentrations sufficient only to maintain quality grass root nutrient demand, all within established fertilizer application programs. SECTION 7 DIMENSIONAL REQUIREMENTS Section 7.1-Lot Area is established as of 1960, and no further activity requires a variance. Section 7.4-Building Heights The Architectural Plans showing the proposed addition are in compliance with zoning and building regulations. General Comments: 1. A line of siltation fencing shall be set in place where shown on the revised plan and prior to start of any construction activity, so as to establish the limit of work and equipment confinement area. 2. The design for the recharge system has been revised. A system of leaching pits are now proposed, for review and comment. No maintenance should be necessary. 3. See Note#2 response(above). 4. See Note#2 response(above). 5. No soil tests have been conducted. The redesign and revised calculations are conservative in demonstrating that the necessary mitigation and recharge volume will be provided. The stone lined trench may concentrate the roof run off volume close to the foundation,which may be detrimental should a potential crack develop in the foundation wall of at the footing. There are now proposed gutters on the addition,which will be connected to the roof drain leaching pits, as shown om the revised plan. SECTION 3 ZONING DISTRICTS AND BOUNDARIES The subject project site is located in the R-1 Zoning District, not as indicated on the application for Watershed Special Permit as filed with the North Andover Planning Department. See note#2 on the Site Plan,which has been appropriately revised. 2. SECTION 4.136 WATERSHED PROTECTION DISTRICT Section 2-Boundaries and Zones The lot was actually created in 1963,based on a recorded plan(ENDRD Plan #4707). The project site is beyond the Non-Disturbance Zone and Conservation Zone of the Wetland Resource Area(bordering Vegetated Wetland), to our best knowledge. The nearby wetland area, located downslope of this proposed project, has been delineated in the field and shall be verified by the Conservation Agent soon. No work is proposed within 100' of the delineated area of wetland. The 325 foot Non-Discharge Zone has been corrected on the revised site Improvement Plan. We have contacted the Conservation Commission and have been assured that the wetland flag locations will be confirmed late this week or early next week. 4-ciii: A revised letter of certification is provided. The basement of the house is virtually dry, at elevation 137.5+/-. VHB recommends that the Applicant indicate on the plan the Conservation Zone,the Non-Disturbance and the Non-Discharge Zones for the wetland resource areas. VHB recommends that the Applicant provide a statement as to why there are no other reasonable alternatives., 4-cvi: This section requires that evidence be provided that all operations,including but not limited to fertilizer applications,will not create concentrations of nitrogen in the groundwater greater than the Federal limit. VHB recommends that the Applicant provide a statement regarding the use of fertilizers on the site. VHB would also like to note that the use of any lawn care or garden product (fertilizer,pesticide,herbicide)that may contribute to the dco adation of the public water supply as well as the use of lawn care or garden products that are not organic is strictly prohibited. SECTION 7 DIMENSIONAL REQUiRENIENTS Section 7.1-Lot Area Based on the assumption that this lot is within the R-1 district,the parcel does not meet the minimum lot area requirement as shown in Table 2 of the North Andover Zoning Bylaws. As this is an existing lot,this may be a moot point. Section 7.4—Building Heights Architectural plans tivere not included in this submission. VHB could not review this section for compliance. VHB assumes that the proposed addition meets the Town's building height requirement. General Comments: 1. The plans have a note that indicates erosion control measures. It is not clear what erosion control measures are proposed. VHB recommends an erosion control detail be provided. 2. Have any future maintenance procedures been considered for the retention pond? As with many retention ponds,the overflow will probably clog with debris. How will the retention pond be maintained? 3. Although the Applicant's calculation indicates that the retention pond exceeds the required recharge volume,the construction and maintenance of this shallow pond maybe difficult. The Applicant should consider increasing the depth to 6"either by raising the elevation of the berm or by lowing the weir elevation. 4. The rip-rap overflow Wier is shown to be discharging to an"existing Swale"on the abutting property. The existing swale is not shown on the plans. The Applicant should verify this will not flood the adjacent property. 5. Soil test information or data was not submitted. Were soil tests(percolation test and high water cable test) performed to verify that the soil type is in fact"Group LB"? 6. As there are no gutters on the existing or proposed buildings,the Applicant may wish to consider a stone lined trench along the dripline of roof. VHB has received the following drawings and documents for review: • Transmittal letter date July 25,2003 • Site Plans(1 sheet)dated June 20,2003—revised July 25,2003 • Letter of certification dated July 25,2003 • Response letter dated July 25,2003 In General the Applicant's Engineer has addressed several of the comments from our previous letter;however,a few items still need to be addressed. The responses listed below follow the general outline of VHB's July 15,2003 Site Plan review letter. For clarity,VHB's original comment is shown followed by our second comment shown in bold. SECTION 3 ZONING DISTRICTS AND BOUNDARIES The parcel of land is located within the Watershed Protection District of Lake Cochichewick. VHB assumes that the site is also in the Residence 1 (R-1)District. The Applicant should verify. The applicant has responded that the parcel is in the R-2 district,and that has been indicated on the application for Watershed Special permit as attached. The Watershed permit was not found in the package sent to VHB. Further,from the zoning map it appears the lot is located in zone R-1. The applicant should confirm the zoning district and forward the application to VHB. Given the different lot requirements between zone R-1 and R-2,our concern is that the lot may be non-conforming if it is within zone R-1. SECTION 4.136 WATERSHED PROTECTION DISTRIC Section 2—Boundaries and Zones The year the lot was created is not provided on the plan. The limits of the Conservation,Non-Disturbance and the Non-Discharge Zones are dependent upon the date the lot was created. The plan should show all buffer zones of the Watershed Protection District. The response letter indicates that the lot was created in 1960 while the plan indicates the lot was created in 1964. The date should be consistent. Also the Non-Discharge Zone appears to have been incorrectly labeled on the plan. 1 TA0671677\does\reports\%eater shedl-revie%c rev]aloe Section 3—Uses and Requirements Since the buffer zones are not shown on the plans,VHB could not review this section for compliance. Since the applicant will be adding impervious area in the Non-Discharge Zone and discharging to both the surface and subsurface,the special permit is required. The Applicant's engineer should show calculations that the proposed additional area and recharge system have been sized appropriately. To accomplish this,the Applicant's engineer should provide runoff and infiltration calculations. VHB recognizes that the scope of this project is very limited,however it is standard practice to demonstrate that the proposed method of infiltration will work. Section 4—Special Permit Requirements 4-cii: The Applicant should verify that all the wetland resource areas are shown on the plans and that the resource areas have been confirmed by the Conservation Commission. VHB recommends that the Applicant indicate on the plan the Conservation"Zone,the Non-Disturbance and the Non-Discharge Zones for the wetland resource areas. The limits of the zones are listed in Section 4.136.2,Table 2. This has been addressed by the applicant,and will be confirmed by the Conservation Commission. 4-viii: VHB recommends that the Applicant submit a document certified by a Professional Engineer,or other scientist educated in and possessing extensive experience in the science of hydrology and hydrogeology,stating that there will not be any significant degradation of the quality or quantity of water in or entering Lake Cochichewick. The Applicant's engineer has provided a certification that addresses the downstream wetland within the Lake Cochichewick watershed. VHB recommends that the Applicant's engineer revise the certification to address the waters of Lake Cochichewick directly. 4-civ: This section requires that the Applicant demonstrate that there is no reasonable alternative location for the improvements outside of the Non-Disturbance and/or the Non-Discharge Buffer Zones. VHB recommends that the Applicant provide a statement as to why there are no other reasonable alternatives. As the entire lot is located within the non-discharge zone,there does not appear to be a reasonable alternative. 4-evi: This section requires that evidence be provided that all operations,including but not limited to fertilizer applications,will not create concentrations of nitrogen in the groundwater greater than the Federal limit. VHB recommends that the Applicant provide a statement regarding the use of Fertilizers on the site. VHB would also like to note that the use of any lawn care or garden product (fertilizer,pesticide,herbicide)that may contribute to the degradation of the public water supply as well as the use of lawn care or garden products that are not organic is strictly prohibited. The use of fertilizer is limited by the zoning regulations. The Applicant should review the limitations expressed in the regulations. The proposed pit system should be routinely inspected and cleaned. An operation and maintenance schedule should be submitted to insure that debris from the roof is removed from the pit. Given the location of the pit adjacent to the proposed driveway,the proposed pit should specify an H-20 slab/cover to prevent injury and avoid damage to the system. 3. Although the Applicant's calculation indicates that the retention pond exceeds the required recharge volume,the construction and maintenance of this shallow pond maybe difficult. The Applicant should consider increasing the depth to 6"either by raising the elevation of the berm or by lowing the weir elevation. This comment has been addressed. 4. This review is conducted in accordance with the Town of North Andover Zoning Bylaw,Massachusetts Department of Environmental Protection(DEP)Stormwater Management Policy and standard engineering practice. VHB has received the following drawings and documents for review: • Site Plans(I sheet)dated June 20,2003 • Groundwater Recharge Calculations dated June 20,2003 The following comments note non-conformance with specific sections,constructability issues and questions/comments on the proposed design. SECTION 3 ZONING DISTRICTS AND BOUNDARIES The parcel of land is located within the Watershed Protection District of Lake Cochichewick. VHB assumes that the site is also in the Residence 1 (R-1)District. The Applicant should verify. SECTION 4.136 WATERSHED PROTECTION DISTRIC Section 2—Boundaries and Zones The year the lot was created is not provided on the plan. The limits of the Conservation,Non-Disturbance and the Non-Discharge Zones are dependent upon the date the lot was created. The plan should show all buffer zones of the Watershed Protection District. Section 3—Uses and Requirements Since the buffer zones are not shown on the plans,VHB could not review this section for compliance. Section 4—Special Permit Requirements 4-cii: The Applicant should verify that all the wetland resource areas are shown on the plans and that the resource areas have been confirmed by the Conservation Commission. VHB recommends that the Applicant indicate on the plan the Conservation Zone,the Non-Disturbance and the Non-Discharge Zones for the wetland resource areas. The limits of the zones are listed in Section 4.136.2,Table 2. 4-ciii: VHB recommends that the Applicant submit a document certified by a Professional Engineer,or other scientist educated in and possessing extensive experience in the science of hydrology and hydrogeology,stating that there will not be any significant degradation of the quality or quantity of water in or entering Lake Cochichewick. 1 CAcadtemp\water shedl-review.doc 4-civ: This section requires that the Applicant demonstrate that there is no reasonable alternative location for the improvements outside of the Non-Disturbance and/or the Non-T)ischarge Buffer Zones. VHB recommends that the Applicant provide a statement as to why there are no other reasonable alternatives. 4-evi: This section requires that evidence be provided that all operations,including but not limited to fertilizer applications,will not create concentrations of nitrogen in the groundwater greater than the Federal limit. VHB recommends that the Applicant provide a statement regarding the use of fertilizers on the site. VHB would also like to note that the use of any lawn care or garden product (fertilizer,pesticide,herbicide)that may contribute to the degradation of the public water supply as well as the use of lawn care or garden products that are not organic is strictly prohibited. SECTION 7 DIMENSIONAL REQUIREMENTS Section 7.1-Lot Area Based on the assumption that this lot is within the R-1 district,the parcel does not meet the minimum lot area requirement as shown in Table 2 of the North Andover Zoning Bylaws. As this is an existing lot,this may be a moot point. Section 7.4—Building Heights Architectural plans were not included in this submission. VHB could not review this section for compliance. VHB assumes that the proposed addition meets the Town's building height requirement. General Comments: 1. The plans have a note that indicates erosion control measures. It is not clear what erosion control measures are proposed. VHB recommends an erosion control detail be provided. 2. Have any future maintenance procedures been considered for the retention pond? As with many retention ponds,the overflow will probably clog with debris. How will the retention pond be maintained? 3. Although the Applicant's calculation indicates that the retention pond exceeds the required recharge volume,the construction and maintenance of this shallow pond maybe difficult. The Applicant should consider increasing the depth to 6"either by raising the elevation of the berm or by lowing the weir elevation. 4. The rip-rap overflow wier is shown to be discharging to an"existing Swale"on the abutting property. The existing swale is not shown on the plans. The Applicant should verify this will not flood the adjacent property. 5. Soil test information or data was not submitted. Were soil tests(percolation test and high water table test) performed to verify that the soil type is in fact"Group B"? 6. As there are no gutters on the existing or proposed buildings,the Applicant may wish to consider a stone lined trench along the dripline of roof. It is recommended that the applicant provide WRITTEN RESPONSES to the issues and comments contained herein.
