Dear Kathy:
In response to your communications to Rimmer Environmental Consulting dated 11/7/02 and
11/8/02 please find enclosed a revised site plan dated 11/24/02 along with a written response to
each item of the letters following below.
LETTER DATED NOVEMBER 7, 2002 (VHB REVIEW)
• The North Andover Conservation Commission (NACC) has reviewed the project and delineated
edge of wetlands shown on the plan as part of a Notice of Intent hearing which is now closed.
The proposed project will be subject to an Order of Conditions that we expect to be issued by
the Commission imminently. A note to this fact has been added to the plan.
• Offset buffers from the delineated edge of wetlands have been shown on the plan at 25, 50, and
100 feet. Please note that no disturbance is proposed closer than 70 feet to the delineated edge
of wetlands and that no surface or point discharge of storm water runoff to the delineated
wetlands is proposed at all.
• Precluding the front yard as an obviously inappropriate location for the addition, the current
location shown on the plan is the only place that complies with applicable zoning setbacks and
also maximizes the distance to the delineated edge of wetlands (99.5 feet). Furthermore, given
the nature of the proposed addition handicapped access is essential predicating the additional
site work shown on the plan to meet the strict regulatory dimensions for such access. Although
there are many ways to construct this access that shown on the plan represents a natural,
flowing, landscaped solution that does derogate from the protectable interests of the Watershed
Protection District. Finally, all proposed work will take place entirely within the footprint of the
existing lawn and will come no closer than 70 feet to the delineated edge of wetlands.
• There are no other uses existing or proposed on the site other than lawn and landscaping
fertilization which impose a nitrogen loading on the surrounding groundwater. A note limited
the quantity and quality of fertilizer application has been added to the plan.
LETTER DATED NOVEMBER 8, 2002 (PLANNING DEPT. COMMENT)
• A certification regarding the quality and quantity of site storm water runoff has been added to
the plan.

Dear Kathy:
Please find enclosed three (3) copies of the revised subject plan. The revisions to the plan included
replacing the bordering vegetative wetland buffer zones as defined by the Wetland Bylaw with those
defined by the Watershed Protection District. This revision necessitated a minor relocation of the
proposed grading and infiltration trench to move them outside of the Conservation Zone.
Additionally, a note was added to the plan to indicate the location of soil-stockpiling during
construction.

Dear Mary:
Attached please find a copy of VHB's review letter for the above project. Most of the comments
are minor but all still require a written response. The comments that I would like to see a
comprehensive, written response to are:
• The issue of alternative location outside of the Non-Disturbance Zone
• Statements that the use of the site will not create concentrations of nitrogen and only
organic fertilizers will be used an site. A note should be added to the final plan reflecting
this.
I also have one general comment regarding the application. It has come to my attention that it
will be necessary for the homeowners to apply for a Family Suite Special Permit from the Zoning
Board of Appeals prior to issuance of a Building Permit. The owners should contact Mitch in the
Zoning Office for more details, 978-688-9541.
If you have any questions, do not hesitate to call. Please be aware that Town offices will be
closed on Monday,November 11'"in observance of Veteran's Day.

FOR CONFORMANCE WITH THE TOWN OF NORTH ANDOVER
ZONING BYLAW AND STANDARD ENGINEERING PRACTICE

The Applicant's engineer submitted plans and documents to VIA for review on October 16,
2002 and a revised set of plans on October 30,2002. The submission was reviewed for
conformance to appropriate sections of the 1972 Town of North Andover Zoning Bylaw
amended May 2001 and standard engineering practice. The following comments note non-
conformance with specific sections and questions/comments on the proposed design.
I. WATERSHED SPECIAL PERMIT
The parcel of land falls within the watershed protection district of Lake Cochichewick and
more specifically within the Non-Disturbance Zone of either the surrounding wetlands within
this district.
Section 4.136.4.c.ii.(2)The Applicant should verify that all the wetland resource areas are
shown on the plans and that the resource areas have been confirmed by the Conservation
Commission.
Section 4.136.4.c.ii.(3-5)VHB recommends that the Applicant indicate on the plan the
Conservation Zone,the Non-Disturbance and the Non-Discharge Zones for the wetland
resource areas. The limits of the zones are listed in Section 4.136.2,Table 2.
Section 4.136.4.c.iv. This section requires that the Applicant demonstrate that there is no
reasonable alternative location for the improvements outside of the Non-Disturbance and/or
the Non-Discharge Buffer Zones. 'VHB recommends that the Applicant provide a statement
as to why there are no other reasonable alternatives.
Section 4.136.4.c.vi. This section requires that evidence be provided that all operations,
including but not limited to fertilizer applications,will not create concentrations of nitrogen
in the groundwater greater than the Federal limit. VHB recommends that the applicant
provide a statement regarding the use of fertilizers on the site. VHB would also like to note
that the use of any lawn care or garden product(fertilizer,pesticide,herbicide)that may
contribute to the degradation of the public water supply as well as the use of lawn care or

garden products that are not organic within the Noon-Disturbance Buffer Zone,is strictly
prohibited.
It is recommended that the applicant provide VVRff TEN RESPONSES to the issues and
comments contained herein.

Please consider this letter as a follow up to my November 7" correspondence. Please have your
engineer certify and stamp a statement that the construction of the addition, terrace, and proposed
regrading will not have an effect on the quality or quantity of runoff entering the watershed protection
district.
I apologize for bombarding you with faxes, but I am hoping to have all issues resolved by
Tuesday's meeting if possible.
