I. CALL TO ORDER
The meeting was called to order at 7:05 pm.

IV. APPROVAL OF MINUTES
A. Meeting minutes from November 19,2015 were presented for signature.
MOTION made by Mr. Fixler to approve the minutes,the motion was seconded by Mr.McCarthy,
all were in favor and the minutes were approved.

VI. NEW BUSINESS
A. Designation of agents for the MA Death Registration System -Joyce Bradshaw,Patricia Sifferlen,
Angela Ciofolo and Suzanne Pelich,from the Town of North Andover's Cleric's Office,will be
designated as Burial Agents for the MA Death Registration System. This will allow them to continue
the issuance of burial permits at the Town Cleric's Office.
MOTION made by Dr.MacMillan to approved designations as presented by Dr.Trowbridge.
MOTION seconded by Mr.Fixler.All were in favor and the motion was approved.
B. Local upgrade approval 62 Wintergreen Dr.—Phil Christiansen,representing the owners of 62
Wintergreen Dr.requested a Local Upgrade approval for only one deep test within the septic system
(310CMR15.102).Mr. Christiansen explained the reason for the request for the LUA. A discussion
ensued regarding the existing system and the proposed system.
MOTION made by Mr.Fixler to approve the local upgrade approval for only one deep test
within the septic system (310CMR15.102).Motion seconded by Mr.McCarthy.All were in favor
and the motion was approved.

C. Commonwealth Waste Transportation 'Attorney Kyle Soandme,representing Kenneth Connolly of
Commonwealth Waste Transportation(CWT),requested that the town waives the fees for permits and
placards that are required for waste transportation in North Andover.A request was made last year and
was granted. Attorney Scandore stated that upon reviewing the regulation, it is his belief that the
criteria for placards does not apply to CWT.Attorney Scandore gave some background information
regarding the facility located o1 1175 Turnpike St. CWT does not pick npor dispose of any solid waste
in North Andover. Fle doesn't feel that the criteria that requires the permits applies to CWT.Mr.
Connolly did apply for the permits this year but is requesting the placards like last year out of
convenience as not to be stopped by NA police when driving back to the facility.A discussion ensued
where the Commonwealth's trucks are housed. K4o. Grant discussed CWT route sheets and the
designated routes and why placards would be needed. Ms. Grant gave a snap shot of a week's worth of |
route sheets for some of Commonwealth's vehicles. Mr. McCarthy discussed the routes and when
placards would hu needed.lf vehicles are traveling outside the designated route,placards would 6c
required.Mr. Fixler noted that the route sheets show that CWT is conducting business in North
Andover. Mr. Connolly stated that if that was the case,lie would like to request a placard for all his
registered vehicles.Mr.McCarthy stated that the regulation needs to be enforced.A discussion ensued
regarding fiooufor not having placards.Mr. Connolly stated that biu easier to apply for u placard for
all his registered trucks out o[convenience. Ms. Grant explained why the need for permits and placards
came about years ago and the Study that was done.Dr. Trowbridge stated that Mr. Connolly could
request o placard for all his registered trucks onRoute ||4 but placards can ho moved fi-om truck tn
truck.Mr.Connolly stated that it would 6e easier to placard all his registered trucks.Normally placards
aren't given out to all registered trucks but leniency is given to a business that is in North Andover.A
discussion ensued oil]low many placards would be needed and what information Mr. Connolly would
need to supply on the application.Mr. Connolly is requesting 27 placards. Mr. Connolly will list what
placards are for North Andover and what are for Peabody.Ms. Grant stated that Mr. Connolly can call �

o1 any time if more placards are needed.No action is needed by the Board u1 this time.
D. Board of Health Fee schedule--Mrs. Sawyer informed the Board that the septic program goes out to �
bid every three years and present costs challenge the current fee schedule. Mrs. Sawyer reviewed
current costs and the various permit fees with Mr.Fixler and Mr.McCarthy recently. Mrs, Sawyer is
suggesting an increase in the recommended fees as to not lose money paying the consultants.A
discussion ensued regarding the increase in the Current fee schedule.Dr.MacMillan asked to include in
the fee schedule a definition rather than"new"to"new construction"and"repairs"to"repair and
replace,"just to be clear.A discussion ensued regarding the proposed new fees. Dr. MacMillan asked
why the proposed new fees wouldn't be the same as what the consultant Mill River is charging.Mrs.
Sawyer explained that some of the inspections/reviews can 6odone iu house,There was udiscussion
on plan reviews and fees. Dr. Trowbridge stated that the town should not be losing money.Dr.
Trowbridge suggested charging a fee o[$l25 for additional plan reviews vs.the%|O0 proposed fee.A
discussion ensued regarding the fees charged for a new septic system and fees for the inspections, Mrs. �
Sawyer explained that due to the restructuring of the septic prograrn and using Mill River more often, �

the program iu being overtaxed and there is now more money going out than coming in.The last time �

fees uouu annual basis.The fees should be brought iu line with what ia being charged bythe
consultant.A discussion ensued regarding re-inspection fees. Mrs. Sawyer suggested the Board look
into charging for variances or LUA's.A discussion ensued regarding the difference between variances
and LUA`a. Plan reviews, full and minor changes, were discussed uuwell. Mr.Fixlm stated that |
charging o fee for both LDA`a and variances should 6uconsidered. Dr.Trowbridge stated that the fees |
could always be waived by the Director or the Board under certain situations. Mrs. Sawyer stated that
unlike other Boards,the BOH has the right to change and set reasonable fees. Dr,Trowbridge stated
that additional plan reviews be$125 instead of$100. Re-inspection fee of$75 refer to all re-
inspections across the board.All variances and local upgrades will have the same fee. A discussion
ensued regarding adding a statement to the fee schedule regarding waivers for variances and local
upgrades. The Board members agreed to not add the statement regarding waivers to the fee schedule.
MOTION made byDr. MacMillan to accept the fee schedule uo presented with the following
edits:

• 'Septic variance and local upgrade approval' and
• 'Plan review minor changes' amsuggested. �
MOTION seconded by Mr. McCarthy.All were iu favor and the motion was approved.

VII. COMMUNICATIONS,ANNOUNCEMENTS,AND DISCUSSION
A. 2016 Mosquito Control season; opt out procedures—Dr.Trowbridge discussed the 2016 opt-out
procedures.The forms can be found on the Town of North Andover's website. Forms must be
submitted by certified mail to the Town clerk by March Is`.A request will be made for NEMCC to
come to a future BOII meeting.
B. Mr.McCarthy reported on the water quality issue in Flint,Michigan. He discussed lead levels and
chloride iron levels in the water at Flint and the effect it will have on many children. Fortunately,
North Andover has a good water treatment system with low lead and chloride iron levels.
C. Dr. Trowbridge thanked Susan Sawyer for her many years of service to the Town of North Andover.
She will be missed by all.
