Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening, June
10 , 1985 upon the application of Robert J . Palumbo, as Trustee of
Business Park Realty Trust. The hearing was duly advertised in the
North Andover Citizen on May 23 , and M• ay 30 , 1985 and all abutters
were notified by regular mail . The followina Board members were
present at the public hearing and again on June 26 , 1985 when the
Board rendered its decision: Frank Serio, Jr . , -Chairman; Alfred
E . Frizelle, Esq . , Vice-Chairman; Augustine Nickerson, William
Sullivan, Walter Soule .
The Petitioner seeks a Special Permit under Section 4 .1 , Paragraph
4 . 11 (3) of the Zoninq By-Law so as to permit a 100-foot section
extention of industrial use into a residential district on premises
located at Flagship Drive and off Route 114 , shown as parcels 33
and 51 on Assessor ' s Map No. 25 and Parcel 84 on Assessor ' s Map No .
107C .
Attorney Andrew Caffrey, Jr. , appeared on behalf of the Petitioner
and testified that the premises had received a special permit to
extend 100 feet into the residential zone four years ago, but the
permit was not exercised . The fact that the land was in one owner-
ship of record on June 5, 1972 remains the same . The request is to
use approximately 2 acres of the land, which is intersected by the
zoning district line for industrial use, -the highest use of the
land . There is no residential development near the land.
Mr. Peter Novello of Marion Drive and Mr. John Simons of Rock
Road spoke in opposition to the Petition. In summary, the oppo-
sition is against industrial use of residential land.
Upon a motion by Mr. Frizelle, seconded by Mr. Nickerson, the
Board voted unanimously to grant the Special Permit as requested
subject to the condition that there be no access to the land from
Marion Drive .
The Board finds that the site is appropriate for such use and
incorporates herein by reference its decision of ?august 4 , 1981
by Robert P. Regan for a Special Permit for Willow Industrial
Park (the same premises) . The Board finds that the provisions
of Section 10.31 have been satisfied .

In reply to your letter of June 9, 1987, please be advised that the Zoning
Board of Appeals, at the June 9th meeting, voted to extend your Petition #85,
dated July, 1985, for a period of one year.
This petition of Robert J. Palumbo, Trustee of Business Park Realty Trust affects
premises at Flagship Drive and off Route 114, Special Permit of Section 4, Paragraph
4.11(3) so as to permit a 100' extension of industrial use into a residential
district.
The vote was as follows: In favor; Mr. Serio, Mr. Frizelle, Mr. Nickerson,
and Ms. O'Connor. Mr. Soule abstained.
