Town of North Andover f NORTH OFFICE OF 3a o '` °,�oo< COMMUNITY DEVELOPMENT AND SERVICES ° . p 146 Main Street KENNETH R MAHONY North Andover, Massachusetts 01845 9SSACHUSE� Director (508) 688-9533 October 20, 1995 Ms. Joyce Bradshaw Town Clerk 120 Main Street North Andover, MA 01845 Re: Special Permit - Site' Plan Review - Central Metal Finishing Dear Ms. Bradshaw: The North Andover Planning Board held a public hearing on September 5, 1995 in the Library Conference Room of Town Hall upon the application of Engineering for Development and Construction (EDC, Inc. ) , 447 Boston Street, Suite 12 , Topsfield, MA 01983 requesting a special permit under Section 8 . 3 (Site Plan Review) of the North Andover Zoning Bylaw. The legal notice was properly advertised in the North Andover Citizen on August 16 and August 23 , 1995 and all parties of interest were duly notified. The following members were present: Joseph Mahoney, Chairman, Richard Rowen, Vice Chairman, Alberto Angles, Associate Member. John Simons arrived at 7 : 30 p.m. and Richard Nardella arrived at 8 : 20 p.m. Kathleen Bradley Colwell, Town Planner was also present. Alison Lescarbeau, Clerk, was absent. The petitioner was requesting a special permit to allow for the addition to a building at Willows Industrial Park, 80 Flagship Drive, No. Andover, MA 01845 . The proposed addition is to be 9500 square feet and one story in height. Richard Rowen read the legal notice to open the public hearing. Jim Bourgeois presented the plan, and Carol Shibels, owner, was also present. The structure is a one story building constructed in the early 1980 's. Central Metal Finishing acquired the property in 1989 and are now ready to expand. A 9500 square foot one story addition is proposed. Deliveries would be on the west side of the building; landscape would be ornamental trees and shrubs. Mrs. Condon, 89 Marian Drive, stated that the present floodlights light up her house at night in the winter time. Mr. Bourgeois proposed a "boxed down" light for the building, and they would replace existing lights with these also. There will be 15 new employees bringing the work force to 65 people. The hours of work are 7 a.m. to midnight. Truck deliveries are in early evening only. Edward Condon, abutter, asked if the pond will be fenced in? Mr. Bourgeois stated that it is not really a pond, but a detention pond. It is not designedtto hold water. Mr. Simons asked about the landscape plan. Mr. Bourgeois replied they would plant ornamental trees and shrubs. There will be no filling of wetlands, so no replications are needed. Mr. Mahoney asked if they would be adding to the air conditioning and heating units. Mr. Bourgeois stated yes, additional units will be comparable to existing units. Ms. Colwell asked if there was a dumpster on site and is it enclosed? Mr. Bourgeois replied yes, there is a dumpster, and no, it is not enclosed. Mr. Colwell stated that it will have to be enclosed. Mr. Bourgeois pointed out on the plan where three chemical storage units were located. Mr. Condon, abutter, asked what kind of chemicals? Ms. Shibels replied acids, alkalines. Ms. Colwell stated that the drainage report was received today, and there are some changes, nothing major. On a motion by Mr. Simons, seconded by Mr. Angles, the public hearing will be continued until September 19, 1995 . 2 The North Andover Planning Board held a regular meeting on September 19, 1995. The following members were present: Joseph Mahoney, Chairman. Alison Lescarbeau arrived at 7 : 15 p.m. , John Simons arrived at 7 : 30 p.m. Richard Rowen, Vice Chairman, Alberto Angles, Associate Member and Richard Nardella were all absent. Due to the lack of a quorum, the Planning Board was unable to continue the public hearing. The Board will continue the public hearing at the October 3, 1995 meeting. The North Andover Planning Board held a regular meeting on October 3 , 1995. The following members were present: Joseph Mahoney, Chairman, Richard Rowen, Vice Chairman, Alberto Angles, Associate Member, Alison Lescarbeau, Clerk, John Simons and Richard Nardella. Kathleen Bradley Colwell, Town Planner, was also present. Ms. Colwell pointed out that none of the Board members were present for the site walk. She met Carol Shibels, owner of Central Metal Finishing, and Mr. & Mrs. Krieger, abutters at the site. The Krieger's live directly behind the site and claimed that noise and lighting coming from there was very disturbing. It was discovered, however, during the site walk that the noise and lighting were coming from another business, not Central Metal Finishing. Ms. Shibels stated that if there were any problems, people were to contact her and they would be discussed and hopefully taken care of. The equipment at Central Metal Finishing was left on all night, and it was decided that not much noise at all was present, just a dull hum. Ms. Colwell stated that the drainage calcs have come back and final changes will be made. All hazardous chemicals will be stored inside the building. On a motion by Mr. Nardella, seconded by Mr. Rowen, the Board voted unanimously to close the public hearing. Staff was directed to draft a decision for the October 17 , 1995 meeting. The North Andover Planning Board held a regular meeting on October 17, 1995. The following members were present: Richard Rowen, Vice Chairman, Alison Lescarbeau, Clerk, Alberto Angles, Associate Member, John Simons and Richard Nardella. Ms. Colwell had a draft decision ready for the Board. Issues from Coler & Colantonio to be itemized. 3 The Board agreed upon a $10, 000 bond for the purpose of insuring that. a final as-built plan is submitted. On a motion by Mr. Simons, seconded by Ms. Lescarbeau, the Board voted unanimously to approve the special permit as drafted. Sincerely v 0 Joseph V. Mahoney, Chairman North Andover Planning Board 4 80 Flagship Drive (Central Metal Finishing) Site Plan Review - Special Permit The Planning Board makes the following findings regarding the application of EDC Inc. , 447 Boston Street, Suite 12, Topsfield, MA 01983, dated August 14, 1995 requesting a special permit to construct a 9,500 square foot addition to the existing Central Metal Finishing building located at 80 Flagship Drive in the Industrial - 1 Zoning District. The Planning Board makes the following findings as required by the Zoning Bylaw Section 8.3 and 10.3: FINDINGS OF FACT: 1. The specific site is an appropriate location for the project as it is zoned for Business and is an addition to the existing industrial building; 2. The use, as developed, will not adversely affect the neighborhood as the site is currently developed an industrial park. The lighting will be downcast and will not shine off site. There will be landscaping added to the rear of the property if necessary to provide screening, 3. There will be no nuisance or serious hazard to vehicles or pedestrians; 4. The landscaping plan approved as a part of this plan meets the requirements of Section 8.4 of the Zoning Bylaw; 5. The site drainage system is designed in accordance with the Town Bylaw requirements; 6. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8.3 of the Zoning Bylaw; 7. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally, the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.35 but requires conditions in order to be fully in compliance. The Planning Board hereby GRANTS an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1. Prior to the endorsement of the plans by the Planning Board, the applicant shall adhere to the following: a. A final set of site plans must be submitted to the Town Planner and to the outside drainage consultant for review within ninety days of filing the decision with the Town Clerk. The following comments raised in the September 27, 1995 letter from Coler and Colantonio must be addressed: i. The hydraulic grade line of the existing and proposed storm drains should be calculated to determine if an outlet control "f condition would exist at the proposed detention basin. ii. The proposed six inch rip rap surface should have suitable filter fabric under it to prevent the growth of nuisance vegetation and stabilize the soil/stone interface. I 1 iii. The model number and total opening size must be provided on the beehive grate. A maintenance program must be instituted to keep the structure clear of debris. iv. An emergency spillway should be provided to prevent the dike from being eroded in the event that the outlet 'orifice and catch basin are plugged with debris. This spillway should be sized to pass a 100-yr storm with the outlet plugged. c A bond in the amount of ten thousand ($10,000) dollars shall be posted for the purpose of insuring that a final as-built plan showing the location of all on-site utilities, structures, curb cuts, parking spaces and drainage facilities is submitted. The bond is also in place to insure that the site is constructed in accordance with the approved plan. This bond shall be in the form of a check made out to the Town of North Andover. This check will then be deposited into an interest bearing escrow account. A construction schedule shall be submitted to the Planning Staff for the purpose of tracKing the construction and informing the public of anticipated activities on the site. 2. Prior to FORM U verification (Building Permit Issuance) : a. The final site plan mylar must be endorsed and three (3) copies of the signed plans must be delivered to the Planning Department. This decision shall be recorded at the Essex North Registry of Deeds and a recorded copy delivered to the Planning Staff. 3. Prior to verification of the Certificate of Occupancy: a. The building must be constructed as presented to the Planning Board and as shown on the following plans: Plans titled: Central Metal Finishing 80 Flagship Drive North Andover, MA 01845 Prepared by: Thomas E. Neve Associates, Inc. 447 Old Boston Road Topsfield, MA Sheet: Building Elevations Dated: 5 Sept 95, 13 Sept 95, 19 Sept 95 b. The landscaping of the site will be reviewed by the Town Planner. Where the existing vegetation is not sufficient as per Section 8.4 of the Zoning Bylaw, landscaping must be added. The Town Planner will review in particular the area to the rear of the property adjacent to the Residential-2 Zoning District boundary. A row of evergreens may be necessary to provide a dense buffer between the industrial and residential use. C. All artificial lighting used to illuminate the site shall be approved by the Planning Staff. All lighting shall have underground wiring and shall be so arranged that all direct rays from such lighting falls entirely within the site and shall be shielded or recessed so as not to shine upon abutting properties or streets. The site shall be reviewed by the Planning Staff. Any changes to the approved lighting plan as may be reasonably required by the Planning Staff shall be made at the owner's expense. d. All buildings shall have commercial fire sprinklers installed in 2 accordance with the North Andover Fire Department. e. The site must have received all necessary permits and approvals from the North Andover Board of Health and the Conservation Commission. 4. Prior to the final release of security: Ca. The site shall be reviewed by the Planning Staff. Any screening as may be reasonably required by the Planning Staff and/or Tree Warden will be added at the applicant' s expense. b. A final as-built plan showing the location of all on-site utilities, structures, curb cuts, parking spaces and drainage facilities must be submitted to and reviewed by the Division of Public Works. 5. The dumpster shown on the plan must be enclosed entirely by a wooden stockade. fence two (2) feet higher than the dumpster. 6. Any plants, trees or shrubs that have been incorporated into the Landscape Plan approved in this decision that die within one year from the date of planting shall be replaced by the owner. 7. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 8. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 9. All catch basins shall be protected and maintained during construction with hay bales to prevent siltation into the drain lines. 10. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 11. No underground fuel storage shall be installed except as may be allowed by Town Regulations. 12. All signs must be consistent with the signage currently on site and must comply with the sign bylaw. 13. All mechanical devices (ie: HVAC, vents, etc. . . ) which may be visible from any surrounding roadways shall be placed on the rear roof line. 14. The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. 15. Any action by a Town Board, Commission, or Department which requires changes in the plan or design of the building as presented to the Planning Board, may be subject to modification by the Planning Board. 16. Any revisions shall be submitted to the Town Planner for review. If these revisions are deemed substantial, the applicant must submit revised plans to the Planning Board for approval. 17. This Special Permit approval shall be deemed to have lapsed after Q��ub�r ao. i99'7 (two years from the date permit granted) unless substantial use or construction has commenced. Substantial use or construction will be determined by a majority vote of the Planning Board. 18. The following information shall be deemed part of the decision: 3 a.
