Dear Jackie:
This document serves as a resolution letter for the above-mentioned project for your
comments dated November 29, 2001 and the comments of your consulting engineer
(VHB) dated November 27, 2001, both of which are being enclosed. Design Consultants
Inc,'s (DCl's) comments are as follows:
Planning Department Comments:
1. Scale of Plans: The scale of I"=20' represents a plan that is larger than the
required 1" =40'. A larger plan is required to show the level of detail required.
2. Distance from Annual High Water Mark: No resolution required.
3. Wetland Flag Confirmation: A North Andover Conservation Agent has
confirmed the location of the wetland flags. Additionally, the Conservation
Commission has closed their hearing and the owner is awaiting a favorable order
of conditions.
4. Limit of Vegetative Clearing: Approximately 250 SF of natural vegetation east
of the driveway will be removed to mitigate this 750 SF of lawn, which will be
converted to restore the buffer zone to a more natural state. Additionally,
approximately 560 SF of suburban lawn will be altered.
5. PE Certification of runoff quality: No resolution required.
VHS Comments:
First Bullet: Wetland Resource Area Delineation: The wetlands were delineated
by Wetlands Consultant Mary Trudeau and confirmed by the North Andover

Conservation Agent. Additionally, the Conservation Commission's public hearing has
been closed and a favorable order of conditions is anticipated at their next meeting.
• Second Bullet: Construction Detail at the BVW: The location of haybales as
shown on the current plan are in areas abutting the BVW where no tree plantings will
occur. DCI has clarified this on the drawings. A Silt Fence Detail has also been added
to the information requested.
• Third Bullet: PROPOSED Planting Material Compatibility with the Resoure
Area: A registered Landscape Architect, Michael V. Weinmayr will provide the
planting with the specific intent of providing a transition from the developed uplands
to the wetlands.
• Fourth Bullet: Bituminous Concrete Curb Location: A bituminous concrete
curb is not to be placed at the edge of the driveway abutting the storm water
management infiltration trench. The drawings have been modified to clarify this point.
• Fifth Bullet: Infiltration System Construction Requirements: DCI, to its
knowledge, has complied will all requirements.

The applicant proposes to reconfigure his existing driveway and do related landscaping work including
reducing the size of the existing deck in the watershed district. The reconfiguration of the driveway is to
eliminate the need to back out of the driveway and provide the applicant with a turn around. All work is
proposed to be within the Nun-Disturbance Zone. My review is as R)llows:
1. The plans are shown in a scale of 1"=20' instead of the required 1"=40'.
2. A statement on the plan has been provided indicating that it is, located beyond the four hundred

3. Wetland flags arc indicated on the plan but clarification needs to be,submitted whether the

The Applicant submitted a plan, special permit application and cover letter to VHB for review.The special
permit submission was reviewed for conformance to the appropriate sections of the 1972 Town of North
Andover Zoning Bylaw as amended May 2001 and standard engineering practice. The following
comments note non-conformance with specific sections and questions/comments on the proposed design.
VHB offers the following comments:
• 4.136.4.c.ii.2. The Applicant should verify that the wetland resource areas shown on the plans are
defined per requirements of this section.
• VHB recommends that a construction detail showing the minimum allowed offset from the hay bale
centerline and wetland line be provided for review. The detail should also include the offset between
the wetland line and the center of the proposed trees,as well as all relevant vertical information
(wetland approximate elevation,depth of rootball etc.).
• The Applicant should verify that the proposed trees and shrubs are compatible with adjacent wetland
vegetation and are not invasive.
• A bituminous concrete curb is provided around the proposed driveway. It appears that the water
flowing down the driveway will not be able to reach the storm water management infiltration trench.
VHB recommends that the Applicant revise the plan to provide a means for the water to reach the
infiltration trench.
• The Applicant should follow all requirements(state,local, etc.)regarding the design and construction
of the infiltration systems.
It is recommended that the Applicant provide WRITTEN RESPONSES to the issues and comments
contained herein.

Dear Ms. Griffin:
As you are aware, Design Consultants, Inc. is a Civil Engineering and Professional Land
Surveying firm with our offices located in Somerville, Massachusetts. Design Consultants, Inc.
are the professional land surveyors and civil engineers of record for the subject site. As such, I
have specific knowledge of the subject site. The property is entirely located within the
watershed protection boundary for Lake Cochichewick. It is located beyond four hundred feet
from the annual mean highwater mark. However, it is within 100 feet horizontally from the
edge of a wetland within the watershed. Additionally, the existing single-family dwelling was
developed prior to October 24, 1994. Hence, the existing dwelling and improvements are
located in the non-disturbance zone of the Watershed Protection District.
As part of the special permit process to perform work in this zone, I offer the following
certification:
1, David Giangrande, being a registered Professional Engineer in the Commonwealth of
Massachusetts, do hereby certify that the modifications as shown on the referenced plan below
to #284 Salem Street,North Andover will not degrade the water quality or quantity of the Lake
Cochichewick reservoir.
My certification is based on the magnitude of the changes, in relation to the existing condition
and proposed mitigation. Existing and proposed conditions, along with storm water mitigation
are shown on a site plan produced by my office, Design Consultants, Inc. Said site plan is dated
July 20, 2001, and revised through October 29, 2001.
