Dear Mrs. pur,bzm:
(}u December l9, 2OO) the North Andover Planning Board issued a special permit for the above
referenced parcel under section 4.136 of the North Andover Zoning Bylaw. The scope of work
involved the reconfiguration o[on existing driveway, related landscaping, ood,edumkionoftbe
existing deck within the Non-Disturbance Zoom of the Watershed Protection District.
Enclosed for your review please find the following:

McKenzie Engineering Group, Inc.—Sheet I` and Sheet 2.
• Planning Board Notice ofDecision, dated December lM,2OUl` petition for special
permit from the requirements of the North Andover Zoning Bylaw Section 4.136.
The permit was recorded with the town clerk on December 19, 2001 and has since expired on
December 19, 2003 (2 years from the date in which it was granted). Since the time of the issuance
of that permit,oo work has been done om the project vvitbfhoexoeptioomftbe emergency removal
nf most of the existing rear deck*hicb collapsed under u heavy snow load this past winter. The
applicant has elected to make minor modifications to the approved plan which will result inthe
reduction of the overall impervious area(driveway& deck) o/approximately l,4OOsquare feet.
We believe these modifications "will not result in any significant degradation of the quality or
quantity of water in or entering Lake Cochichewick" as previously determined in the December
lB. 2001 planning board decision.
On behalf of Mr. Palmer we respectfully request a one year extension to the above referenced
Special Permit, commencing December 19, 2003.

Dear Commission:
On behalf of David Palmer of 284 Salem Street,Rimmer Environmental Consulting, LLC (REC)
and McKenzie Engineering Group, Inc. request an amendment to the Order of Conditions issued
on December 12, 2001 for work shown on a plan entitled Conservation Site Plan 284 Salem
Street,prepared by Design Consultants, Inc. and dated 11/21/01. Eight(8) copies of this request
are being forwarded to you. The Order included the following work, as referenced in Special
Condition 27:
"expansion,regrading and realignment of the existing driveway, installation of a
stormwater infiltration trench, stormwater infiltration system, construction of a retaining
wall, 4-foot wood fence and walkway, removal of the existing pool and 5-feet of existing
deck,placement of hot tub on the deck and the planting of shrubs...."
This work was depicted on a plan prepared by Design Consultants, Inc: dated July 20, 2001 and
last revised on 11/21/01. The amendment includes revisions to the original plan, though the
general intent and scope of work is very similar. This work is indicated on a plan prepared by
McKenzie Engineering Group, Inc. dated March 24, 2004 (sheets 1 and 2) and included as an
attachment. All of the work is intended to provide maximum protection to wetland resources,
while addressing on-going stormwater runoff and erosion problems at the site. The following
modifications to the original plan are proposed:
1. Revised driveway layout—The original plan called for 1,500 square feet of paved
surface. The driveway has been revised to reduced in size by 650 square feet and 810
square feet is proposed to consist of pervious pavers. This work does not extend any
closer to the wetlands than the originally approved plan. The existing retaining wall
along the driveway edge is not proposed to be relocated as originally proposed. The
paved area along Salem Street has been eliminated.
2. Stormwater Infiltration System—revised from an infiltration trench to a subsurface
infiltration system. Details of the system are shown on the site plan. Sizing
calculations are included as an attachment.
3. Installation of fencing—reduced from 175 linear feet to 136 linear feet.
4. Revised deck—the proposed new deck is reduced from 960 square feet to 445 square
feet(rear deck setback to wetlands increased from 5 feet to 15 feet).
5. Revised brick walkway in fronts—Due to the elimination of the revised retaining
wall along the driveway, the walkway much be realigned. Square footage within the
riverfront area is similar to originally proposed condition.
6. Buffer Zone Enhancement Plan—the number and type of plantings is the same,but
the location is proposed to include a larger portion of the western corner of the site,
Plantings are not proposed within the fenced area proposed to be used as a dog
turnout. This planting plan includes removal of invasive Japanese knotweed
(Polygonum cuspidtatunz)to enhance habitat value of buffer zone.
7. Revised Erosion Control - In order to minimize impacts to the wetland from
installation of erosion controls,it is recommended that siltation fence be substituted
for haybales. This will minimize introduction of weed seeds into the wetland and
reduce the total area of impact as the silt fence can be set closer to the limit of work.
The following work was not included in the original plan, but is proposed to be included as part
of the Amended Order of Conditions:
1. Removal and replacement of the rear retaining wall
Presently, the railroad tie retaining wall at the wetland edge is in disrepair and is in
danger of collapse. This work was apparently not included in the original Order of
Conditions, (the final plan is unclear as no note is provided indicating this work).
Repair of the wall is believed to be important for the protection of the wetland, since
its failure could result in a significant impact to the adjacent wetland. Also, under
current conditions sediment and salt from stormwater runoff from the driveway
washes directly into the wetland at the eastern edge of the retaining wall (see attached
photos). The applicant proposes to remove the existing wall and construct a more
durable interlocking stone retaining wall and to regrade the existing rear yard so that
stormwater is infiltrated prior to discharging into wetlands. Approximately 18 feet of
the existing retaining wall in the western portion of the site will be removed and not
rebuilt. Approximately 18 feet on the eastern portion of the site, east of wetland flag
6 will be removed (some of this wall is not on the applicant's property) and
reconstructed further from the wetland, extending to meet the end of the driveway.
Upon completion of construction,the rear yard would be reseeded and restored.
2. Rear Walkway—In order to provide safe access to the rear door and deck,
construction of a 3-foot wide brick walkway is proposed.
3. Planting Bed-Installation of a small (3-foot wide),mulch planting bed along the
upland side of the proposed new retaining wall.

We recognize that this work is subject to the Special Permit requirements of the Planning Board
for work within the Watershed Protection District, and will be filing for either a new permit or an
extension of the existing permit as required by the Planning Board.
A copy of this material is also being forwarded to the Natural Heritage and Endangered Species
Program for review, as the site is located within or near Estimated Habitat of Rare Wetlands
Wildlife. We will notify abutters as required in accordance with your public hearing requirements
and will forward a certified list of abutters contacted. Enclosed,please find a check in the
amount of$100 to cover filing fees associated with this request for amendment. The wetland
boundary will be reflagged in accordance with your adopted the North Andover Conservation
Commission Policy 94-2. We look forward to discussing this project with you further at your next
