DATE: March 6,2006 Proposal: The applicant, Colonial Village Development Corporation, is filing for a Watershed Special Permit under Section 4.136 of the Zoning Bylaw to construct an in ground swimming pool and concrete patio within the Non-Disturbance Zone of the Watershed Protection District. The project site is located at Lot 1 Marble Ridge Road (formerly 249 Marble Ridge Road), Assessors Map 37D, Parcel 16 in the R-3 Zoning District. The parcel consists of approximately .79 acres (34,445 sf) with 128' of frontage on the Eastern side of Marble Ridge Road. The parcel was created in 2005 and is subject to the Watershed Protection District provision for lot created after October 24, 1994. The first public hearing will be later this month. ❑ The Applicant requested that the outside review by the Town's consultant be waived due to the type of project and limit of impact. ❑ The Division of Public Works reviewed the application and determined that there were no issues involving the proposed activities. See attached March 7, 2006 letter to New England Engineering Services regarding driveway concerns. RECOMMENDATION ❑ Continue the application pending the outcome of the Zoning Board of Appeals decision to approve/deny the variance to construct a new permanent structure within the non-disturbance zone in accordance with Section 4.136.3.c.ii.3 of the Town Bylaw.
