Regular Meeting
The PLANNING BOARD ~eld a regular meeting on Monday evening,
July 11, 1983 at 7:30 p.m. in the Town Office Meeting Room
with the following members present and voting: Michael P.
Roberts, Vice Chairman; Erich W. Nitzsche; John J. Burke;
and John A. James, Jr. Town Planner Karen H. Pomroy was
also present.
PLANS NOT REQUIRING APPROVAL
Matron Realty Trust - V~t Way
MOTION: by Mr. Nitzsche to approve the plan of land located
in North Andover, Mass. prepared for Matlyn Realty
Trust and dated July 1, 1983 under Subdividion Control
Law Not Required.
SECOND: by Mr. James
VOTE : Unanimous
Cana~ Realty Trust - Forest Street
Change in lot line to accomodate septic systems.
MOTION: by Mr. Nitzsche to approve the plan of land located
in North Andover, Mass. prepared for Canape Realty
Trust and dated July 11, 1983 under Subdivision Control
Law Not Required.
SECOND: by Mr. James
VOTE : Unanimous
PUBLIC HEARING
David Minicicci
Special Permit - Watershed District - Lot C-1
Johnson Street
Mr. James read the legal notice.
Mr. Joseph Cushing, project engineer, was present for the applicant
and made the following presentation:
- Mr. Minicucci intends to construct a single family dwelling.
- There is a pond which outlets into the brook and is closer
than 100 feet from the pond.
- The proposed work will not have any impact on be pond.
- There is 30 to 50 feet of undisturbed land.

The difficulty is the water table is approximately 5 feet
down and they want to put in a perimeter drain. They will
go across the Ridgewood Cemetery parcel and the Ogden parcel.
-They have not yet identified how they will go over the wetland
area.
- According to the plans, there will be no cutting of vegetation.

MOTION:
by Mr. Burke to grant the Special Permit to David Mini-
cucci for Lot C-1 Johnson Street subject to the following
conditions:
Only the proposed work dilineated on the plan entitled
"Notice of Intent Site Plan of Land, North Andover, for
David Minicucci" by Kaminski, Gelinas and Associates, Inc.
dated July 7, 1983 is allowed under this Special Permit.
After completion of final lot grading and prior to seeking
an occupancy permit, a certified "as built" plan from a
Registered Professional Engineer and/or Registered Land
Surveyor shall be submitted to the Planning Board for
review and approval with this Special Permit. Said certi-
fication will state that the "as built" grading and con-
struction fully complies to the approval plan with noted
revisions.

The Conservation Commission's O~der of Conditions shall be
reviewed by the Planning Board to ensure compliance with
the Special Permit prior to any construction on Lot C-1
Johnson Street.
4. The proposed dwelling shall be serviced by public water
supply from Johnson Street.
5. The Ridgewood Cemetery Association shall grant the applicant
a sewer line easement to be recorded at the Registry of Deeds.
No vegetation, including trees or topsoil, shall be dis-
turbed outside of the work limit as sho~n on the referenced
plan as delineated by the proposed contours and Insert A.
7. A no cut buffer zone shall exist 25 feet horizontally from

the edge of all tributaries in the Watershed District,
according to Section 4.133 (c) of the zoning By Law.
8. A driveway entry permit shall be obtained from the Highway
Surveyor.
9. The proposed six inch raised elevation by the driveway shall
be placed beyond the property line.
10. Permission to enter property of Ogden shall be noted on the
p lan.

OTHER BUSINESS
.R. ale.igh Tavern (Woodchuck) - Bond Release
MOTION: by Mr. Burke to release $800.00 from the bond and that
the applicant be advised that the catch basins need to
be cleaned, the street swept, and request tree plantings
at 10 to 12 feet and further request that the items in
the Highway Surveyor's letter of July 11, 1983 be
comp le te d.
SECOND: by Mr. James
VOTE : Unanimous
Gilman Lane - Bond Release
Letters from Mr. Patrick Cone dated June 27, 1983 and the Highway
Surveyor dated July 11, 1983 were read and placed on file.
MOTION: by Mr. Burke to release $13,000 per the Highway Surveyor's
re comme n dat i on.
SECOND: by Mr. James
VOTE : Unanimous
Hardtcourt Estates Phase II - Update from developer
A letter from Richard Kaminski dated July 11, 1983 was read and
placed on file. Mr. Follansbee added that the French drain is in
at the cul-de-sac.

French Farm Villa.ge - binder coat, completion date
Karen Pomroy reminded the Board that the completion date for the
binder coat is July 30, 1983 and it should be in by the fall.
MOTION:
by Mr. Nitzsche to extend the completion date from
July 30, 1983 to October 1, 1983 as specified in the
bond agreement to change the b~nder completion date
subject to a written request from the owner of the
property of French Farm Village to be submitted before
the next Planning Board meeting.
SECOND: by Mr. James
VOTE : Unanimous

MOTION: by Mr. Burke to elect Mr. James as Clerk.
