Mahoney File Interested Parties Planning Board CONSERVATION 688-9530 RFALTH 688-9540 Pt A t-TVM10 69R-9515 Lot 2A Flagship Drive Site Plan Review and Common Driveway - Special Permit The Planning Board herein approves the Special Permit/Site Plan Review for the construction of a 30,216 SF one story building located in the Industrial - 1 Zoning District and for the construction of a common driveway to access this site over Lot 82 as shown on Map 25. This approval also includes the potential future construction of a 3,400 SF office within the 30,216 SF facility. Sufficient parking has been provided for this space and designated on the plan as future parking. This Special Permit was requested by Channel Building Company, Inc., 355 Middlesex Avenue, Wilmington, MA 01887. This application was filed with the Planning Board on August 5, 1997. The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Section 2.30.1, 8.3 and 10.3: FINDINGS OF FACT: 1. The specific site is an appropriate location for the project as it is located in an industrial park and is zoned for industrial use. 2. • The use as developed will not adversely affect the neighborhood as sufficient buffer have been provided as well as conditions on the hours of operation, the location of the HVAC units and other noise producing elements; 3. There will be no nuisance or serious hazard to vehicles or pedestrians as the common driveway will eliminate an additional curb cut on a cul-de-sac and create a more uniform intersection with Willow Street; 4. The landscaping approved as a part of this plan meets the requirements of Section 8.4 of the North Andover Zoning Bylaw; 5, The site drainage system is designed in accordance with the Town Bylaw requirements. 6. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8.3 of the Zoning Bylaw; 7. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.35 but requires conditions in orderto be fully in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1. Prior to the endorsement of the plans by the Planning Board, the applicant must comply with the following conditions: a) The final plan must be reviewed and approved by the drainage consultant, DPW and the Town Planner and subsequently endorsed by the Planning Board. The final plans must be submitted for review within ninety days of filing the decision with the Town Clerk. b) A bond in the amount of$20,000 (twenty thousand dollars) shall be posted for the purpose of insuring that a final as-built plan showing the location of all on-site utilities, structures, curb cuts, parking spaces and drainage facilities is submitted. The bond is also in place to insure that the site is constructed in accordance with the approved plan. This bond shall be in the form of a check made out to the Town of North Andover. This check will then be deposited into an interest bearing escrow account. C) An easement must be granted to the applicant from the owners of Lot 82 for the grading and construction of the driveway on Lot 82. Certified copies of the recorded easement must be submitted to the Planing Department. d) A certified copy of the recorded slope easement on Lot 85 must be submitted to the Planning Department. 2. Prior to the start of construction: a) A construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. b) All erosion control must be installed as shown on Sheet 4 of the approved and endorsed plans. G) The applicant shall determine the preexisting conditions of the noise levels emanating from the site are to determine the baseline noise conditions of the site area. The noise survey will provide evidence of the origin of surrounding noise and therefore a baseline condition from which the applicant determine their increases. The noise levels shall not increase the broadband level by more then 10 dB(a) above the ambient levels or produce a"pure tone" condition as set forth in DAQC Policy 90-001, the guideline for 310 CMR 7.10. 3. Prior to FORM U verification (Building Permit Issuance): a) The final site plan mylars must be endorsed and three (3) copies of the signed plans must be delivered to the Planning Department. b) A certified copy of the recorded decision must be submitted to the Planning Department. 4. Prior to verification of the Certificate of Occupancy: a) The applicant must submit a letter from the architect or engineer of the project stating that the building, signs, landscaping, lighting and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board. b) The landscaping must be planted as shown on Sheet 5 of the approved and endorsed plans. c) All artificial lighting used to illuminate the site shall be approved by the Planning Staff. All lighting shall have underground wiring and shall be so arranged that all direct rays from such lighting falls entirely within the site and shall be shielded or recessed so as not to shine upon abutting properties or streets. The site shall be reviewed by the Planning Staff. Any changes to the approved lighting plan as may be reasonably required by the Planning Staff shall be made at the owner's expense. d) The building must have commercial fire sprinklers installed in accordance with the North Andover Fire Department. 5. Prior to the final release of security: a) The site shall be reviewed by the Planning Staff. Any screening as may be reasonably required by the Planning Staff will be added at the applicant's expense. b) A final as-built plan showing final topography, the location of all on- site utilities, structures, curb cuts, parking spaces and drainage facilities must be submitted to and reviewed by the Planning Staff and the Division of Public Works, 6. Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must'remain covered at all times to minimize any dust problems that may occur with adjacent properties. Any stock piles to remain for longer than one week must be fenced off and covered. 7. In an effort to reduce noise levels, the applicant shall keep in optimum working order, through regular maintenance, any and all equipment which shall emanate sounds from the structures or site. 8. No HVAC equipment or other equipment that will emanate noise exceeding levels cited herein, shall be placed on the exterior of the structure. Such equipment shall be enclosed as shown on the plans. 9. All site lighting shall provide security for the site and structures however it must not.create any glare or project any light onto adjacent residential properties. 10. The hours for trucks entering the site for shipping , receiving and waster hauling shall be limited to between the hours of 8 am and 6 p.m. Monday through Friday. Snow plowing may occur during operating hours and at least two (2) hours prior to the opening of the facility and four hours after the closing. 11. Any plants, trees or shrubs that have been incorporated into the Landscape Plan approved in this decision that die within one year from the date of planting shall be replaced by the owner. 12. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 13. Gas, Telephone, Cable and Electric utilities shall be installed underground as specified by the respective utility companies. 14. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 15. No underground fuel storage shall be installed except as may be allowed by Town Regulations. 16. The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. 17. Any action by a Town Board, Commission, or Department which requires changes in the plan or design of the building as presented to the Planning Board, may be subject to modification by the Planning.Board. 18. Any revisions shall be submitted to the Town Planner for review. If these revisions are deemed substantial, the applicant must submit revised plans to the Planning Board for approval. 19. This Special Permit approval shall be deemed to have lapsed after (two years from the date permit granted) unless substantial use or construction has commenced. Substantial use or construction will be determined by a majority vote of the Planning Board. 20. SCOTT �9SSgCHU5�4�y Director October 13, 1997 Ms. Joyce Bradshaw - Town Clerk - 120 Main Street No. Andover, MA 01845 Re: Site Plan Review/Lot 2A Flagship Drive Dear Ms. Bradshaw, The North Andover Planning Board held a public hearing on Tuesday evening, September 2, 1997 at 7:30 p.m. in the Department of Public Works Conference Room, upon the application of Channel Building Company 355 Middlesex Avenue, Wilmington, MA 01887 requesting a special permit under Section 8.3 Site Plan Review of the North Andover Zoning Bylaw. The legal notice was properly advertised in the North Andover Citizen on August 13 and August 20, 1997 and all parties of interest were duly notified: The following members were present:, Richard Rowen, Chairman,. John Simons, Clerk, Alberto Angles, Associate Member, Richard Nardella and Joseph V. Mahoney. The petitioner was requesting a special permit to allow for the construction of a 30,216 SF building for the use of light manufacturing w/ accessory storage. The Zoning District is (I-1) Industrial -1. Frank Montero of MHF Design was present to represent Channel Building for Lot 2A Flagship Drive. The applicant is proposing a 30,216 SF building. The access of the site is off a driveway that leads to the Town Printing Building which leads to Flagship Drive. The building is going to be used for a furniture company which assembles then delivers office furniture. Mr. Montero stated that they meet all parking and zoning requirements. Mr. Nardella asked if they meet the new parking requirements. Mr. Montero stated that they are planning to have 10' x 20'. The federal requirements for the handicap parking is 20'. Mr. Rowen asked if there were any comments from the TRC Meeting. Mr. Scott,stated not too many. Mr. Scott went over some changes he suggested on the plan regarding the landscape and the driveway. Mr. Nardella asked where are they are planning to put the dumpster. Mr. Montero stated that they are planning to have a trash compactor. Mike Farrow, CEO of the company explained the use of the building. Mr. Farrow also stated that this was strictly for expansion reasons not changing anything. It will only be used for storage and assembling the furniture and then waiting for delivery. Mr. Nardella asked what the hours of operation would be. Mr. Montero stated that it was approximately 30,000 SF. Mr. Rowen asked what the building would be built out of Mr. Montero stated that it would have a concrete block with a flat metal panel. Mr. Simons asked if it would be on the same scheme as the other buildings in the park. Greg Weich of Channel Building stated yes, and there will be no central air conditioning planned for this building. Mr. Rowen asked what the total number of employees will be working at this building. Mr. Farrow stated that there will be a total of 15 people working there. Mr. Simons asked what the closest residence was. Mr. Montero stated that it was 2 buildings away from there property. Mr. Rowen asked where they are planning to push the snow if UPF plans on putting on their addition. Mr. Montero stated that there are to other locations on the property. Mr. Rowen asked if they push the snow into the swailes won't that affect the drainage. Mr. Scott suggested that they address all the comments that were made by the next meeting. Mr. Farrow asked if they can begin cutting tree's once they get the O.K. from ConCom. Mr. Rowen stated as long as ConCom O.K.'s it, it's your property. Continued until September 16, 1997. Kathleen Bradley Colwell, Town Planner was also present. Frank Montero of MI-IF Design was present to represent Lot 2A Flagship Drive. Mr. Montero stated that they have redesigned the grading and there is no need to re-file with ConCom. Mr. Montero stated that Mr. Scott had suggested minor changes to the landscape design. Mr. Scott recommended deleting the grass and add mulch to the front of the property. Mr. Montero stated that they have redesigned the drainage and submitted the changes to John Chessia, of Coler and Colantonio, and they are all set. Mr. Montero stated that they are getting an easement for access off of Town Printing. They are also getting a slope easement from UPF which is temporary until UPF puts on their addition. Mr. Rowen asked if they had to get an easement from the town. Mr. Montero stated that, that was deleted from the plan. Ms. Colwell read the letters from Town Printing and UPF granting the applicant the easements. Ms. Colwell asked the Board how they feel about whether the applicant should file a common drive special permit. Mr. Rowen stated 2 that the site plan is a special permit and it can be added into the decision. Mr. Nardella suggested that the bond be set at $20,000. Attached are the conditions.
