Bradshaw, The North Andover Planning Board held a public hearing on Tuesday evening, March 18, 1997 at 7 : 30 p.m. in the Senior Center behind the Town Building, on the application of System Builders, Inc. 202 Sutton Street, North Andover, MA 01845, for a special permit under Section 8 . 3 (Site Plan Review) of the North Andover Zoning Bylaw. The legal notice was properly advertised in the North Andover Citizen on February 26 and March 5, 1997 and all parties of interest were duly notified. The following members were present : Joseph V. Mahoney, Chairman, Alberto Angles, Associate Member, Alison Lescarbeau, Clerk, John Simons, Richard Nardella and Richard Rowen. Kathleen Bradley Colwell,. Town Planner was also present. The petitioner was requesting a special permit to allow construction to a 4, 560 SF addition to the existing Senior Center building. Kathleen Gorman, Director, was present representing the Senior Center. Ms . Gorman stated that they have received a grant of $583, 000 that will pay for all the construction and will not cost the town anything. Ms . Gorman stated that the seniors gave a lot of support and fundraised $42, 000 . The majority of that money has come from the seniors themselves . Dennis Ingram, architect for the Senior Center, stated that it would be a 4, 500 SF addition. The building will not exceed in height the existing building. There will be 10 parking spaces lost but, they will still have an area for drop off. Mr. Ingram stated that the initial plan did not have sidewalks but they have added a 3' sidewalk along the front of the building. They would like to use the side of the building for handicap parking spots and for the loading dock. 1 BOARD OF APPEALS 688-9541 BUILDING 688-9545 CONSERVATION 688-9530 HEALTH 688-9540 PLANNING 688-9535 Mr. Rowen asked what would be unloaded at the dock. Mr. Ingram stated that it would be used for the Meals on Wheels . Mr. Mahoney asked who owned the building and the parking lot. Mr. Ingram stated that the town did. Mr. Mahoney asked if the plan meets the parking regulations . Mr. Ingram stated yes it did. t Mr. Rowen asked if the parking lot was full of cars often. Mr. Ingram stated that when a special event is held the lot is full . Such as when the flu clinics are held or when a bus trip is scheduled. The Senior Center has discussed alternate parking site on bus trip days . Mr. Mahoney asked what the issues were with the drainage. Bill Scott, Director of Community Development, stated that Bill Hmurciak, Asst. Director DPW, said that there will be no problem with the drainage. Mr. Nardella asked if there was going to be any additional lighting on the building and if so will they be on all night. Mr. Ingram stated that they will add lighting to the loading area side of the building but will not be on all night. Mr. Mahoney asked how they are going to control the noise from the HVAC Units . Mr. Ingram stated that they are putting them on the roof and the smaller unit will be on the back for the kitchen. They are planning to add baffling to control the noise. Ms . Colwell asked what they are planning to do with the landscaping. Mr. Ingram stated that they want to work with the existing trees and plants and would like to transplant them. Ms . Colwell asked where they plan on putting the dumpster. Mr. Ingram stated that they will use trash barrels and keep them in the back near the loading dock. Ms . Lescarbeau asked what the total number of parking spaces there were . Mr. Scott stated that there was about 62 in the lower parking lot near the• Annex Building and 35 in the upper building. Mr. Scott added that a lot of the senior citizens either walk, carpool or take the Weebus service . Ms . Colwell stated that the regulations require 1 space for every 4 people. Frank Generelli, Brewster Street, stated that this is an asset to the community and will put the seniors into the 21st century. Mr. Generelli also stated that a lot of people have put many of hours into this grant and the new building will entice new residents . 2 Gene Willis, believes this is a tremendous asset to the town but has a concern for keeping the screening and to continue to keep the gate closed entering his neighborhood. Lillian Boyle, stated that she moved here two years ago and the Senior Center has opened so many doors for her. She also stated that the Town of North Andover has been wonderful and has been t like a lifeline for her. On a motion by Mr. Rowen, seconded by Mr. Nardella the Board voted unanimously to close the Public Hearing. The Board directed Ms . Colwell to draft a decision based upon the Boards comments . The North Andover Planning Board held a public hearing on Tuesday evening, April 8, 1997 . The following members were present: Richard Rowen, Vice Chairman, Alison Lescarbeau, Clerk, Alberto Angles, Associate Member and Richard Nardella. Kathleen Bradley Colwell, Town Planner was also present. Ms . Colwell stated that in her draft decision she put in that the HVAC units must shielded from the residential neighborhoods . On a motion by Mr. Angles, seconded by Ms . Lescarbeau the Board voted unanimously to accept the Site Plan Review Special Permit draft decision as amended. Attached are the conditions . Mahoney 3 120 Main Street(Senior Center) Site Plan Review-Special Permit The Planning Board herein approves the Special Permit/Site Plan Review for the construction of a 4,560 SF addition to the existing Senior Center located at 120 Main Street, North Andover, MA 01845. This Special Permit was requested by Kathleen Gorman, Director, North Andover Senior Center, 120 Main Street,.North Andover,MA 01845 on February 20, 1997. The Planning Board makes the following findings as required by the Zoning Bylaw Section 8.3 and 10.3: FINDINGS OF FACT: 1. The specific site is an appropriate location for the project as this is an addition to the existing Senior Center building. 2. The use, as developed, will not adversely affect the neighborhood as lighting and air conditioning units will be shielded from abutting homes, 3. There will be no nuisance or serious hazard to vehicles or pedestrians as the majority of senior citizens either car pool or use the wee bus service to attend functions at the Senior Center, 4. The existing landscaping will be replanted with the addition, 5. No new drainage is proposed on site as no additional impervious surface will be created. 6. No new lighting is proposed on the site. The existing lights will be adjusted to fit the new addition. 7. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8.3 of the Zoning Bylaw; 8. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally, the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.35 but requires conditions in order to be fully in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met: ` SPECIAL CONDITIONS: 1. Prior to any work on site,the applicant shall adhere to the following: a) The final plan must be reviewed and approved by the Town Planner and subsequently endorsed by the Planning Board. The final plans must be submitted for review within ninety days of filing the decision with the Town Clerk. 1 b) A bond in the amount of two thousand ($2,000) dollars shall be posted for the purpose of insuring that a final as-built plan showing the location of all on-site utilities, structures, curb cuts, parking spaces and drainage facilities is submitted. The bond is also in place to insure that the site is constructed in accordance with the approved plan. This bond shall be in the form of a check made out to the Town of North Andover. This check will then be deposited into an interest bearing escrow account. c) A construction schedule must be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. 2. The hours for construction must be limited to between the hours of 7:00 a.m. and 7:00 p.m.. Trucking of supplies and the use of heavy of equipment must also be restricted to these hours. Sunday and Holiday construction will not be permitted. 3. Prior to FORM U verification(Building Permit Issuance): a) The final site plan mylars must be endorsed and three (3) copies of the signed plans must be delivered to the Planning Department. b) This decision must be recorded at the Essex North Registry of Deeds and a certified copy of the decision delivered to the Planning Staff. 4. Prior to verification of the Certificate of Occupancy: a) HVAC units or other noise producing mechanisms must be shielded from the residential neighborhood. a) The applicant must submit a letter from the architect or engineer of the project stating that the building, signs, landscaping, lighting and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board. b) All artificial lighting used to illuminate the site shall be approved by the Planning Staff. All lighting shall have underground wiring and shall be so arranged that all direct rays from such lighting falls entirely within the site and shall be shielded or recessed so as not to shine upon abutting properties or streets. The site shall be reviewed by the Planning Staff Any changes to the approved lighting plan as may be reasonably required by the Planning Staff shall be made at the owner's expense. c) The building must have commercial fire sprinklers installed in accordance with the North Andover Fire Department. 2. Prior to the final release of security: a) The site shall be reviewed by the Planning Staff. Any screening as may be reasonably required by the Planning Staff will be added at the applicant's expense. b) A final as-built plan showing the location of all on- site utilities, structures, curb cuts, 2 parking spaces and drainage facilities must be submitted to and reviewed by the Planning Staff and the Division of Public Works. 3. Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times to minimize any dust problems that may occur with adjacent properties. Any stock piles to remain for longer than one week must be fenced off and covered. 4. Any plants, trees or shrubs that have been incorporated into the Landscape Plan approved in this decision that die within one year from the date of planting shall be replaced by the owner. 5. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 6. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 7. All catch basins shall be protected and maintained during construction with hay bales to prevent siltation into the drain lines. 8. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 9. No underground fuel storage shall be installed except as may be allowed by Town Regulations. 10. The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. 11. Any action by a Town Board, Commission, or Department which requires changes in the plan or design of the building as presented to the Planning Board, may be subject to modification by the Planning Board. 12. Any revisions shall be submitted to the Town Planner for review. If these revisions are deemed substantial, the applicant must submit revised plans to the Planning Board for approval. 13. This Special Permit approval shall be deemed to have lapsed after CA pc G ►GG (two years from the date permit granted) unless substantial use or construction has commenced. Substantial use or construction will be determined by a majority vote of the Planning Board. ` 14.
