CROOK MARGARET DAtCSON ASSOCIATF.PASTOR TREASURER February 5, 1991 Dr. George Blaisdell Superintendent of Schools 675 Chickering Road North Andover, MA 01845 Dear Dr. Blaisdell : This is to confirm my understanding of our recent telephone conversation regard- ing the proposed access road from the property of First-Calvary Baptist Church to that of the Atkinson School . On the occasion when you, your business manager, our architect, his associate, the co-chairperson of our design/construction committee, and myself met in the school yard, it was obvious to us that the asphalt play area was no longer sound. There was visual evidence of its breaking up and, therefore, it was and is our conclusion that that area could not sustain automobile traffic. Of course, we could be responsible for -removing the present covering and installing a new asphalt covering. The expected cost of the access road and such covering is in excess of $40,000. Quite frankly, we cannot justify that in our budget. As a matter of fact, we are presently working with the contractor who submitted the low bid for our complex in attempting to bring down the costs quite significantly in order that they may be within our means. My conversation with you would indicate that we are agreed that that access road would not serve either the best purposes of the Atkinson School or those of the church, and thus it is our intent to report this finding to the Planning Board for their reconsideration. On those occasions wheh our parking lot is inadequate, it would be our intent to put up a sign at the driveway entrance that would direct automobiles to your parking lot. The persons utilizing your parking lot would be expected to walk to the church by way of the present sidewalk adjacent to our property on Massachusetts Avenue. On the occasions that the Atkinson School needs the use of our parking lot, of course a similar arrangement can be made. Should the School Department require the use of our educational building we can, at that time, determine whether or not a pedestrian bridge is indicated and conclude whose responsibility that might be. I trust that this summarizes our conversation and our mutual understanding. I do appreciate your cooperation with us and your understanding and response to our needs. School and church representatives jointly met to study the possibility of a proposed access road from church property to that of the Atkinson School. We concluded that it was not feasible to have vehicular traffic cross what is currently the playing area, since we believed that that area would not sustain such traffic. With that in mind, it was our opinion that the bridge from the church to school property would not be feasible . Under our existing policies, the church, as a community group, would have access to all school parking lots through the existing school entrance when school is not in session or when school events are not scheduled. Church patrons using our lot would leave school property by the existing entrance and walk to the church along the present sidewalk. Although we have had discussions about potential school use of church property, a concept in which we have interest, we have not finalized any understanding of such use. Should that idea become reality, the possibility of a pedestrian bridge between the properties could be re-examined. I hope this information is helpful to you in your continuing discussions with the North Andover Planning Board. Sincerely, George I. For several months we have been working on this issue with the school superintendent as reflected by the letters from both parties involved. We are requesting that this condition be waived for the reasons stated and hope to resolve this matter without further hearings. You have requested a waiver of condition number 18 of the Site Plan Review approval granted by the Planning Board on August 7, 1990. Condition Number 18 reads as follows: The applicant shall receive approval from the North Andover School Department for construction of the proposed connection between the Atkinson School and the church. Any changes to the plans approved by the Planning Board shall be reviewed by the Town Planner. Any changes which the Town Planner may deem as major shall be approved by the Planning Board. I would consider this request to be a major variation from the approved plans. Further, I would require that the applicant file an application for Modification to an approved Site Plan Review granted by the Planning Board. I have enclosed the necessary applications. By a majority vote, the School Committee denied the church's request for access across the playground area to reach the parking lot of the Atkinson School. Committee members indicated that they continue to be willing to allow the church use of the existing parking lot in accordance with the school system's use of facilities policies, but they were unwilling to grant a permanent easement on the property. Members of the School Committee continue to be concerned about the future use of the Atkinson School site for expanded school facilities . As you know, some members of the School Committee previously expressed that concern to the Planning Board. The Committee regrets any confusion which may have been created about your request. Mr. Perna indicated that he was seeking Town Counsel's opinion about the exact information required to permit access to school property by church patrons. He expects to receive that information shortly and indicated that he would provide Town Counsel's response to the School Committee. Based on his presentation, the School Committee agreed to allow the church to have access to the school property in a manner to be worked out to the mutual satisfaction of the School Committee and the church within the time frame prescribed by the North Andover Planning Board. All of the necessary work has been completed with town officials and committees, and appeal periods have passed. The congregation has voted unanimously to hire DiDio Building & Realty, Inc. , of North Andover as the General Contractor and has authorized the borrowing of all necessary funds. ADMINISTRATION AND ENFORCEMENT If the State Building Code Appeals Board does not notify the local board in writing within forty-five (45) days from the date of the local board's decision, the said decision shall be deemed approved; provided that the decision shall not conflict with the general objectives of the state building code and the objectives of Section 95, Chapter 143 of the General Laws of the Commonwealth. 126.7.13 Enforcement of decision: If said decision is approved by the State Building Code Appeals Board, all parties to the appeal shall take immediate action in accordance with the decision of the local board unless the person aggrieved by such decision appeals to the State Building Code Appeals Board as provided in Section 126.0. 126.7.14 Review: Any person, including the State Building Code Appeals Board, aggrieved by a decision of the local board of appeals, whether or not a previous party to the decision, or any municipal officer or official board of the municipality, may, not later than forty-five (45) days after the mailing of the decision of the local board, apply to the State Building Code Appeals Board for a hearing de novo before the State Board, in accordance with the regulations contained in Section 126.0. fl SECTION 127.0 CONSTRUCTION CONTROL 127.1 Responsibilities: The provisions of this section define the construction controls required for all structures needing registered professional architectural or engineering services, and delineate the responsibilities of such professional services together with those services that are the responsibility of the contractor during construction. Exceptions: 1. Any building containing less than thirty-five thousand (35,000) cubic feet of enclosed space; 2. Any single or two family house or any accessory building thereto; 3. Any building used for farm purposes; and 4. Retaining walls less than ten (10) feet in height at all points along the wall as measured from the base of the footing to the top of the wall. 780 CMR - Fifth Edition 1-33 THE MASSACHUSETTS STATE BUILDING CODE 127.2 Professional architecture or engineering services. 127.2.1 Design: All plans, computations and specifications involving new construction, alterations, repairs, expansions or additions shall be prepared by or under the direct supervision of a registered professional architect or engineer and bear his signature and seal; said signature and seal shall signify that the plans, computations and specifications meet the applicable provisions of this code, all acceptable engineering practices and all applicable laws and ordinances. 127.2.2 Architect/engineer inspectional responsibility: A registered professional architect or engineer shall be responsible for the following: 1. Review of shop drawings, samples and other submittals of the contractor as required by the construction contract documents as submitted for building permit, and approval for conformance to the design concept. 2. Review and approval of the quality control procedures for all code- required controlled materials. 3. Special architectural or engineering professional inspection of critical construction components requiring controlled materials or construction specified in the accepted engineering practice standards. A registered professional architect or engineer shall perform the necessary professional services and be present on the construction site on a regular and periodic basis to determine that, generally, the work is proceeding in accordance with the documents approved for the building permit. 127.2.3 Reporting: A registered professional architect or engineer shall submit periodically, in a form acceptable to the building official, a progress report together with pertinent comments. At the completion of the construction, the registered professional architect or engineer shall submit to the building official a report as to the satisfactory completion and the readiness of the project for occupancy(excepting any items not endangering such occupancy and listing pertinent deviations from the approved building permit documents). 127.3 Construction contractor services: The actual construction of the work shall be the responsibility of the general contractor as identified on the approved building permit and shall involve the following: 1. Execution of all work in accordance with the approved construction documents. 2. Execution and control of all methods of construction in a safe and satisfactory manner in accordance with all applicable local, state, and ) federal statutes and regulations. 1-34 780 CMR - Fifth Edition ADMINISTRATION AND ENFORCEMENT `r 3. Upon completion of the construction, he shall certify to the best of his knowledge and belief that such has been done in substantial accord with Items 1 and 2 above and with all pertinent deviations specifically noted. j 127.4 Special professional services: When applications for unusual designs or magnitude of construction are filed, or where reference standards require special architectural or engineering inspections, the building official may require full-time j project representation by the registered professional architect or engineer in addition to that provided in Section 127.2.2. The project representative shall keep daily records and submit reports as may be required by the building official. Upon completion of the work, the registered professional architect or engineer shall file a final report as required under Section 127.2.3. 127.4.1 Building permit requirement: This special professional service requirement shall be determined prior to the issuance of the building permit and shall be a requisite for the permit issuance. Refusal by the applicant to provide such service as required by the building official shall result in the denial of the permit. However, the applicant may file an appeal as provided in Section 126.0. 127.4.2 Fee and costs: All fees and costs related to the performance of special professional services shall be borne by the applicant. 127.5 Building official responsibility: Nothing contained in this section shall have the effect of waiving or limiting the building official's authority to enforce this code with respect to examination of the contract documents,including plans,computations and specifications, and field inspections (see Section 108.0). In a letter forwarded under your signature to Mr. Daniel Long, Town Clerk, and dated June 12 , 1991, you detail the position of the North Andover School Committee with respect to the granting of an easement to First Calvary Baptist Church for the purpose of building a bridge connecting the church property with that of the School Department. The School Committee indicated in a letter forwarded under the signature of Superintendent George Blaisdell to Reverend Donald Dickinson and dated May 29 , 1991 that "they were unwilling to grant a permanent easement on the property. " It was our understanding that this issue would be addressed to town counsel , as indicated in your letter to Mr. Long . It is our position that we need an easement from the North Andover School Committee before we may construct a bridge thatn,vill extend onto their property. Site.,, ;plan reviews and modifications thereof pursuant to the North Andover Zoning Bylaws are governed by Massachusetts General Laws Chapter 40A. Section 3 of Chapter 40A provides that "No zoning ordinance or by-law shall . . . regulate or restrict the use of land or structures for religious purposes. . . ; provided, however, that such land or structures may be subject to reasonable regulations concerning the bulk and height of structures and determining yard sizes, lot area, set-backs, open space, parking and building coverage requirements. " It is our position that Special Condition Number 23 of the Site Plan Review Modification of the First Calvary Baptist Church , conducted pursuant to Section 8 . 3 of the North Andover Zoning Bylaws requiring First Calvary to "grant an easement to the School Department for access and parking. . .prior to the issuance of a Certificate of Occupancy" , constitutes a confiscatory and invalid taking of property under an arbitrary exercise of power by the Planning Board of North Andover. It is our further position that Special Condition Number 23 constitutes an impermissible burden on the religious practices of First Calvary Baptist Church. Please forward to this office the opinion of town counsel on these matters as indicated in your letter dated June 12 , 1991 and referenced above, in order that we may proceed.
