Dear Dr. Blaisdell :
This is to confirm my understanding of our recent telephone conversation regard-
ing the proposed access road from the property of First-Calvary Baptist Church to
that of the Atkinson School . On the occasion when you, your business manager,
our architect, his associate, the co-chairperson of our design/construction
committee, and myself met in the school yard, it was obvious to us that the
asphalt play area was no longer sound. There was visual evidence of its breaking
up and, therefore, it was and is our conclusion that that area could not sustain
automobile traffic. Of course, we could be responsible for -removing the present
covering and installing a new asphalt covering. The expected cost of the access
road and such covering is in excess of $40,000. Quite frankly, we cannot justify
that in our budget. As a matter of fact, we are presently working with the
contractor who submitted the low bid for our complex in attempting to bring down
the costs quite significantly in order that they may be within our means.
My conversation with you would indicate that we are agreed that that access road
would not serve either the best purposes of the Atkinson School or those of the
church, and thus it is our intent to report this finding to the Planning Board
for their reconsideration.
On those occasions wheh our parking lot is inadequate, it would be our intent to
put up a sign at the driveway entrance that would direct automobiles to your
parking lot. The persons utilizing your parking lot would be expected to walk
to the church by way of the present sidewalk adjacent to our property on
Massachusetts Avenue. On the occasions that the Atkinson School needs the use of
our parking lot, of course a similar arrangement can be made.
Should the School Department require the use of our educational building we can,
at that time, determine whether or not a pedestrian bridge is indicated and
conclude whose responsibility that might be.
I trust that this summarizes our conversation and our mutual understanding. I do
appreciate your cooperation with us and your understanding and response to our
needs. Indeed, there is every evidence that we will be "good neighbors", and
that is as it ought to be.

Dear Reverend Dickinson:
You have requested that I summarize the position of the school system
following our joint review of the issues of parking and vehicular access at
the Atkinson School.
School and church representatives jointly met to study the possibility
of a proposed access road from church property to that of the Atkinson
School. We concluded that it was not feasible to have vehicular traffic
cross what is currently the playing area, since we believed that that area
would not sustain such traffic. With that in mind, it was our opinion that
the bridge from the church to school property would not be feasible .
Under our existing policies, the church, as a community group, would
have access to all school parking lots through the existing school entrance
when school is not in session or when school events are not scheduled.
Church patrons using our lot would leave school property by the existing
entrance and walk to the church along the present sidewalk.
Although we have had discussions about potential school use of church
property, a concept in which we have interest, we have not finalized any
understanding of such use. Should that idea become reality, the possibility
of a pedestrian bridge between the properties could be re-examined. I hope
this information is helpful to you in your continuing discussions with the
North Andover Planning Board.

Dear Mr. Huntress,
Enclosed please find two letters regarding the vehicular bridge connection to the Atkinson
School. As you know, this bridge is one of the conditions imposed by the Planning Board
when the appeal was granted August 7, 1990. For several months we have been working on
this issue with the school superintendent as reflected by the letters from both parties involved.
We are requesting that this condition be waived for the reasons stated and hope to resolve this
matter without further hearings. We intend to abide by all other conditions and look forward to
a spring ground breaking.

Dear Mr. Delegas,
I am in receipt of your letter dated April 17, 1991. You
have requested a waiver of condition number 18 of the Site Plan
Review approval granted by the Planning Board on August 7, 1990.
Condition Number 18 reads as follows:
The applicant shall receive approval from the North Andover
School Department for construction of the proposed
connection between the Atkinson School and the church. Any
changes to the plans approved by the Planning Board shall be
reviewed by the Town Planner. Any changes which the Town
Planner may deem as major shall be approved by the Planning
Board.
I would consider this request to be a major variation from
the approved plans. Further, I would require that the applicant
file an application for Modification to an approved Site Plan
Review granted by the Planning Board.
I have enclosed the necessary applications. Please feel free
to contact my office with any further questions or concerns.

At their meeting on April 29th, the North Andover School Committee
unanimously voted to accept the report that it is not feasible to have
vehicular traffic cross the current paved playing area at the Atkinson
School. Consequently, the School Committee will not approve the vehicular
connection between school and the church.

Dear Reverend Dickinson:
Following their discussion with you, the School Committee considered
your request later in their meeting on May 28th. By a majority vote, the
School Committee denied the church's request for access across the playground
area to reach the parking lot of the Atkinson School. Committee members
indicated that they continue to be willing to allow the church use of the
existing parking lot in accordance with the school system's use of facilities
policies, but they were unwilling to grant a permanent easement on the
property.
Members of the School Committee continue to be concerned about the
future use of the Atkinson School site for expanded school facilities . As
you know, some members of the School Committee previously expressed that
concern to the Planning Board. The Committee regrets any confusion which may
have been created about your request. On behalf of the Committee, I wish you
success in your plans for the church building.

Dear Reverend Dickinson:
As you know, Mr. George Perna, Chairman of the North Andover Planning
Board, met with the School Committee at their most recent meeting. Mr. Perna
indicated that he was seeking Town Counsel's opinion about the exact
information required to permit access to school property by church patrons.
He expects to receive that information shortly and indicated that he would
provide Town Counsel's response to the School Committee.
Based on his presentation, the School Committee agreed to allow the
church to have access to the school property in a manner to be worked out to
the mutual satisfaction of the School Committee and the church within the
time frame prescribed by the North Andover Planning Board. When you are
ready, please be in touch with me so that we may continue those discussions.
I very much hope that this most recent action of the School Committee
will help you to expedite your project.

The family of God called First-Calvary is celebrating the long-awaited deci-
sion to go forward with the building of their new Sanctuary, Friendship Hall ,
and the shell of a Classroom Wing. All of the necessary work has been
completed with town officials and committees, and appeal periods have passed.
The congregation has voted unanimously to hire DiDio Building & Realty, Inc. ,
of North Andover as the General Contractor and has authorized the borrowing
of all necessary funds. So, my friends, we are on our way!
We would like very much to have you be present at our formal Ground Breaking
on Saturday morning, August 17th, at 9:00 A.M. Of course, we understand that
on a Saturday in the summertime one has other priorities (vacation, family,
household chores and the like) and thus if you cannot join us we will under-
stand.
If you can be present we will call upon each of our invited guests to bring a
word of greeting -- just a minute in length. The intent is not a long day
but, rather, a short celebration of what we believe God is doing in our lives
and what the community has done to support the process.

ADMINISTRATION AND ENFORCEMENT
If the State Building Code Appeals Board does not notify the local board in
writing within forty-five (45) days from the date of the local board's decision, the
said decision shall be deemed approved; provided that the decision shall not conflict
with the general objectives of the state building code and the objectives of Section
95, Chapter 143 of the General Laws of the Commonwealth.
126.7.13 Enforcement of decision: If said decision is approved by the State
Building Code Appeals Board, all parties to the appeal shall take immediate action
in accordance with the decision of the local board unless the person aggrieved by
such decision appeals to the State Building Code Appeals Board as provided in
Section 126.0.
126.7.14 Review: Any person, including the State Building Code Appeals Board,
aggrieved by a decision of the local board of appeals, whether or not a previous
party to the decision, or any municipal officer or official board of the municipality,
may, not later than forty-five (45) days after the mailing of the decision of the local
board, apply to the State Building Code Appeals Board for a hearing de novo before
the State Board, in accordance with the regulations contained in Section 126.0.
fl SECTION 127.0 CONSTRUCTION CONTROL
127.1 Responsibilities: The provisions of this section define the construction
controls required for all structures needing registered professional architectural or
engineering services, and delineate the responsibilities of such professional services
together with those services that are the responsibility of the contractor during
construction.
Exceptions:
1. Any building containing less than thirty-five thousand (35,000) cubic feet
of enclosed space;
2. Any single or two family house or any accessory building thereto;
3. Any building used for farm purposes; and
4. Retaining walls less than ten (10) feet in height at all points along the
wall as measured from the base of the footing to the top of the wall.

127.2 Professional architecture or engineering services.
127.2.1 Design: All plans, computations and specifications involving new
construction, alterations, repairs, expansions or additions shall be prepared by or
under the direct supervision of a registered professional architect or engineer and
bear his signature and seal; said signature and seal shall signify that the plans,
computations and specifications meet the applicable provisions of this code, all
acceptable engineering practices and all applicable laws and ordinances.
127.2.2 Architect/engineer inspectional responsibility: A registered
professional architect or engineer shall be responsible for the following:
1. Review of shop drawings, samples and other submittals of the contractor
as required by the construction contract documents as submitted for
building permit, and approval for conformance to the design concept.
2. Review and approval of the quality control procedures for all code-
required controlled materials.
3. Special architectural or engineering professional inspection of critical
construction components requiring controlled materials or construction
specified in the accepted engineering practice standards.
A registered professional architect or engineer shall perform the necessary
professional services and be present on the construction site on a regular and
periodic basis to determine that, generally, the work is proceeding in accordance
with the documents approved for the building permit.
127.2.3 Reporting: A registered professional architect or engineer shall submit
periodically, in a form acceptable to the building official, a progress report together
with pertinent comments. At the completion of the construction, the registered
professional architect or engineer shall submit to the building official a report as to
the satisfactory completion and the readiness of the project for occupancy(excepting
any items not endangering such occupancy and listing pertinent deviations from the
approved building permit documents).
127.3 Construction contractor services: The actual construction of the work
shall be the responsibility of the general contractor as identified on the approved
building permit and shall involve the following:
1. Execution of all work in accordance with the approved construction
documents.
2. Execution and control of all methods of construction in a safe and
satisfactory manner in accordance with all applicable local, state, and )
federal statutes and regulations.

`r 3. Upon completion of the construction, he shall certify to the best of his
knowledge and belief that such has been done in substantial accord with
Items 1 and 2 above and with all pertinent deviations specifically noted.

127.4 Special professional services: When applications for unusual designs or
magnitude of construction are filed, or where reference standards require special
architectural or engineering inspections, the building official may require full-time j
project representation by the registered professional architect or engineer in addition
to that provided in Section 127.2.2. The project representative shall keep daily
records and submit reports as may be required by the building official. Upon
completion of the work, the registered professional architect or engineer shall file
a final report as required under Section 127.2.3.
127.4.1 Building permit requirement: This special professional service
requirement shall be determined prior to the issuance of the building permit and
shall be a requisite for the permit issuance. Refusal by the applicant to provide such
service as required by the building official shall result in the denial of the permit.
However, the applicant may file an appeal as provided in Section 126.0.
127.4.2 Fee and costs: All fees and costs related to the performance of special
professional services shall be borne by the applicant.
127.5 Building official responsibility: Nothing contained in this section shall have
the effect of waiving or limiting the building official's authority to enforce this code
with respect to examination of the contract documents,including plans,computations
and specifications, and field inspections (see Section 108.0).

SECTION 128.0 CONSTRUCTION MATERIALS SAFETY BOARD
i
128.1 Membership: There shall be a board under the control of the BBRS called
the Construction Materials Safety Board, hereafter in Section 128.0 called the CMSB
which shall consist of nine (9) members, one (1) of whom shall be a member of the
BBRS who shall be ex-officio and a voting member of the Board and eight (8)
members to be appointed by the chairman of the BBRS: one of whom shall be a
registered professional engineer who is a structural engineer; one of whom shall be
a registered architect; one of whom shall be a representative of a commercial testing
laboratory; one of whom shall be a representative of a public testing laboratory; two
of whom shall be representatives from the construction industry; one of whom shall
be a member of a university faculty engaged in research and teaching in structural
materials; and one of whom shall be a member of a university faculty engaged in
research and teaching in the area of theoretical and applied mechanics.

Dear Mr. Perna:
Please be advised that this office represents the First Calvary
Baptist Church Of I orth Andover, Massachusetts.
In a letter forwarded under your signature to Mr. Daniel Long, Town
Clerk, and dated June 12 , 1991, you detail the position of the North
Andover School Committee with respect to the granting of an easement
to First Calvary Baptist Church for the purpose of building a bridge
connecting the church property with that of the School Department.
The School Committee indicated in a letter forwarded under the
signature of Superintendent George Blaisdell to Reverend Donald
Dickinson and dated May 29 , 1991 that "they were unwilling to grant a
permanent easement on the property. " It was our understanding that
this issue would be addressed to town counsel , as indicated in your
letter to Mr. Long . It is our position that we need an easement from
the North Andover School Committee before we may construct a bridge
thatn,vill extend onto their property.
Site.,, ;plan reviews and modifications thereof pursuant to the North
Andover Zoning Bylaws are governed by Massachusetts General Laws
Chapter 40A. Section 3 of Chapter 40A provides that "No zoning
ordinance or by-law shall . . . regulate or restrict the use of land or
structures for religious purposes. . . ; provided, however, that such
land or structures may be subject to reasonable regulations concerning
the bulk and height of structures and determining yard sizes, lot
area, set-backs, open space, parking and building coverage
requirements. " It is our position that Special Condition Number 23 of
the Site Plan Review Modification of the First Calvary Baptist Church ,
conducted pursuant to Section 8 . 3 of the North Andover Zoning Bylaws
requiring First Calvary to "grant an easement to the School Department
for access and parking. . .prior to the issuance of a Certificate of
Occupancy" , constitutes a confiscatory and invalid taking of property
under an arbitrary exercise of power by the Planning Board of North
Andover. It is our further position that Special Condition Number 23
constitutes an impermissible burden on the religious practices of
First Calvary Baptist Church.
Please forward to this office the opinion of town counsel on these
matters as indicated in your letter dated June 12 , 1991 and referenced
above, in order that we may proceed.

Dear Mr. Crouch:
Please be advised that this office represents the First Calvary
Baptist Church of North Andover, Massachusetts.
In a letter addressed to George D. Perna, Jr. , Chairman of the Town of
North Andover Planning Board and dated 25th September, 1991, a copy of
which is enclosed herewith, we requested an opinion of town counsel
relative to the necessity of an easement from the North Andover School
Committee in order that we construct a bridge connecting school
property with that of the church. We requested in addition an opinion
on Special Condition Number 23 of the Site Plan Review Modification of
the First Calvary Baptist Church, which same requires the church to
grant an easement to the Town of North Andover for "access and
parking. " our positions on these matters are detailed in the enclosed
letter.
It has been four months since we requested a response on these
matters, and to date no formal response has been forthcoming.
We would respectfully request that we rece .ve forthwith an opinion of
town counsel on the above-referenced matters in order that we may
proceed.

Thu attached correspondence is in regards to the Site Plan
Review for the First Calvary Baptist Church pertaining to
Condition 23 in the Planning Board's decision dated June 12, ,1.991,
It appears that a written request was submitted to the Planning
Board Chairman in September 1.991 without as response from the
board. Thus the attached letter was mailed directly to the
Chairman of the Board of Selectmen.
I would like you to follow up with Mr. Fiorentini to bring
this matter to a conclusion.

Dear Mr. Perna:
Following your request to review the matter of the bridge at the First
Calvary Baptist Church site, the School Committee discussed the issue again
at its most recent meeting.
As a result of that discussion, the School Committee unanimously voted
to allow the Church to build a bridge on the school property and, further, to
allow the bridge to be used for foot traffic. I hope that their action is
helpful to you and to the Church in attempting to resolve this issue.
Although the Committee did not vote on the location of the bridge, I
would recommend that the location be by joint agreement of church and school
representatives. Please be in touch with me if you have any questions about
this matter.

Dear Atty Carpenter;
Please be informed that the North Andover Planning Board is
of the opinion that the conditional approval granted to deCastro,
Nelson Associates, Inc. on June 12 , 1991, with regard to the
above referenced property, under the North Andover Zoning Bylaw
Section 8 . 36, paragraphs 1 & 2 is within the Board's authority.
Enclosed you will find correspondence dated April 1, 1992
from the Superintendent of Schools with regard to location of a
bridge on school property. The letter states that the School
Committee has voted unanimously to allow the Church to build a
bridge on school property and, further, to allow the bridge to be
used for foot traffic. 1 would recommend that you contact this
office and the Superintendent of Schools to determine the proper
location of this proposed bridge.
It is the opinion of Town Counsel that in order to fulfill
condition No. 22, the Church must first obtain an easement or a
licence for construction on, and use of, School Department land.
Further, due to the fact that the Church did not bring a timely
appeal of the Special Permit approval pursuant to G.L. c. 40A,
§ 17, it is foreclosed from contesting its validity now. The
Board may, at the applicant's request, remove or modify the
conditions after hearing and new public notice.
Finally, please be advised that condition No. 22 must be
fulfilled prior to the Church receiving a Certificate of
Occupancy from the Town of North Andover. Please feel free to
contact my office with any further questions or concerns.

DPW request for I & I analysis
The water department has requested test results or an infiltration
infloweexamination of the new sanitary sewer installed under a
previous contract to the construction of the new church . Whereas this
office was unaware of the requirement and an occupancy permit is
immediately required it is requested on the owner ' s behalf that this
test be performed after the dedication service on May 31 , 1992 .
While water dept . and planning signatures are requested for the
issuance of the occupancy permit it is agreed that the present temporary
$5 , 000 . 00 bond 'satisfy the comprehensive requirement of this and
similar formalities which are requited -.-by the order of conditions
Enclosed are as built drawings per your request .

More than a year ago we completed the above construction project. On May 26,
1992 Tony DiDio, Angelo C. DiDio, Building and Realty, Inc. , submitted directly
to Chris Huntress the As-Built Drawings required for your review with a letter
to the Planning Board, dated 5/26/92.
In your letter of 1/7/93 to Bob Carpenter and Jane Barlow you also requested
a copy of the same As-Builts for review. These drawings have been enclosed in
this package with a return receipt requested.
We would like, because of this year-long delay, to request an immediate review
of these drawings and then the return of the $5,000 escrow check, since this
$5,000 escrow has been tied up in a non-interest bearing account for more than
two years.

drawings for our project and requesting that the town release our $5,000.00 Escrow
Account.
Also referencing your later letter to me, requesting additional site drawing infor-
mation as well as our conversation requesting a letter from our Engineers.
Enclosed in this package are the re-submitted Record Site Drawings: Ll, L2, L3, L4,
L5, and Xl, with those minor changes, which were made to our site during construction.
Also enclosed is a letter to the church certifying that thier were only minor changes
during the site work phase and that the record drawings accurately reflect the work
which was completed.
Hopefully, this letter and the copies of the revised record drawings, which I have
enclosed, will allow a favorable review of this project at your next Planning Board
Meeting, and subsequently the release and return of our $5,000.00 Escrow Account
Passbook.
