NELSON, DIRECTOR October 9 , 1987 Mr. Daniel Long, Town Clerk Town Hall 120 Main Street North Andover, MA 08145 Re: Lots 60A, 62A, 64A Haymeadow Road Dear Mr. Long: The North Andover Planning Board held a public hearing on Monday evening, October 5 , 1987 in the Town Office Library/ Conference Room upon the application of Michael Marino. The hearing was advertised in the North Andover Citizen on September 17 and September 24 , 1987 and all abutters were notified by regular mail. The following members were present and voting; Paul A. Hedstrom, Chairman; George Perna, Vice-Chairman; John Simons , Clerk; Erich Nitzsche. John Burke was also present but did not vote . The petitioner seeks a reconsideration of a Special Permit for a Common Driveway on lots 60A, 62A and 64A Haymeadow Road, North Andover, MA pursuant to MGL Chapter 40A, Section 16 - Repetitive Petition and Section 10 . 8 of the North Andover Zoning Bylaw. The request for reconsideration is to address any specific and material changes in conditions which the previous unfavorable action was based. The premises is known as lots 60a, 62A and 64A Haymeadow Road, on the north west side of Haymeadow Road, possessing 3 acres in a Residential-2 (R-2) Zoning District. John Simons read the legal notice to open the public hearing. Letters from the Board of Health, the Police Department and the Conservation Commission were read. Attorney Nelson Chang represented his client. Also present was John McQuilkin, of Yankee Engineers . Both presented the Board with the proposed plans. MOTION: By Erich Nitzsche to deny the application because the Board finds that there no specific and material changes in conditions upon which the previous unfavorable action was based. NEI-SON, DIHECTOH July 23 , 1987 Mr. Daniel Long, Town Manager Town office Building North Andover, MA 01845 Re: Lots 60A, 62A, 64A Haymeadow Road Common Driveway Special Permit Disapproval Dear Mr. Long : The North Andover Planning Board held a public hearing upon the application of Micheal Marino of G&M and G&P Realty Trust on Monday evening July 20 , 1987 in the Town office Meeting�ng Room. The hearing was advertised in the North Andover Citizen on July 2 , and 9 , 1987 . The following members were present at the July 20, 1987 meeting: Erich Nit-zsche, John Simons, John Burke, Paul Hedstrom, and George Perna. The petioner seeks a Special Permit for a Common Driveway to service three (3) lots (60A, 62A, 64A) on Haymeadow Road under Section 2 . 30 . 1 of the North Andover Zoning Bylaw. The referenced T lots are in the Residential 2 (R2) Zoning District. Lots 60A, 62A and 64A combined have an area of 3 acres with frontage 450 feet. The property is under the ownership of Micheal Marino of G&M and G&P Realty Trust. The legal. notice was read by John Simons, and the public hearing opened. There was no representative present for the petition. The following discussion to place: Located in Residential-2 (R-2) Zoning District Three (3) lots consisting of combined acreage of 3 acres North side of Haymeadow Road 450 foot 'frontage Ernest Cornelssen presented the Board with a letter signed by 10 abutters . John Simons read the letter to the Board with the following concerns : Site Plan does not show all contours and lacks adequate details Plan does not match septic system plan Was Notice of intent filed Driveway in violation of wetlands Erosion controls not in compliance with requirements Page : 2 Grading and filling below contour 132 in violation Septic system on lot 64A apears to violate the 100 ' buffer zone Substantial work was completed before issu4nce of Special Permit Not enough space for fire trucks to turnaround or other large vehicles Tree damage and removal of excessive trees Upon a motion made by George Perna and seconded by Paul Hedstrom, the Planning Board voted unanimous to deny the Special Permit request to construct a common driveway for cited reasons below. 1 . The applicant was no-L' present for the hearing. 2 . Significant on site wetland filling has taken place in violation of NACC Order of Conditions DEQE File No. 242-413 resulting in a cease and desist. 3 . The plans dated May 1 , 1987 do not show profile or width of driveway. 4 . A consistent plan is lacking which clearly indicates dwelling and septic system location or turn outs for safety measures . 5 . NELSON, DIRECTOR August 6 1987 Conservation Comm. re= Lot 64 HayMeadow The Site chosen for the Septic System location on this Lot is described in a plan by Yankee Engineers dated April 21 1987. The original leach area as proposed in earlier plans was located in the northwest corner of the Lotat the farthest point from surrounding wetlands . That site was rejected because of steep slopes that would have prohibited a satisfactory installation. The current proposal was the best possible compromise between favorable soil conditions and meeting the 100 foot offset for leach areas and wetlands .
