HomeMy WebLinkAbout1984-02-06February 6, 1984 Regular Meeting The Planning Board held a regular meeting on Monday evening, February 6, 1984 at 7:30 p.m. in the Town Office Meeting Room with the following members present and voting: Michael P. Roberts, Vice Chairman; John A. James, Jr., Clerk; John J. Burke; and Erich W. Nitzsche. Town Planner Karen Pomroy was also present. PLANS NOT REQUIRING APPROVAL McConaghy.- Appleton Street Plan approved by the Board of Appeals as a subdivision of one lot into two lots, each having less than the required area. MOTION: SECOND: by Mr. James that the plan of land located in North Andover, Mass. prepared for Daniel and Adele McConaghy, revised 2/6/84, be approved under Subdivision Control Law Not Required. by Mr. Nitzsche VOTE : Unanimous - motion carries. OTHER BUSINESS French Farm Village -. Sign Release Form The vote to sign the form was taken at ~e last meeting, but the original form was not available. Vice Chairman Roberts signed the form. French Farm Villag? - Discussion with Highway Surveyor - Telephone Co. Tabled - the Highway Surveyor was not present. Salem Forest II - Sign Definitive Plan and Covenant Note: We need a completion date. A letter from the Board of Health dated 2/6/84 was read and placed on file. Town Planner Pomroy reported that the developer did not show ~he location of the house on Lot 20A. It is shown now. The Board of Health did not look into where the septic system is located. It is too close to the proposed foundation drain and the two catch basins. They will seek variances or the catch basins will have to be moved. If the variances are denied, the developer would have to come back to the Planning Board. February 6, 1984 -2- Regular Meeting Salem Forest II - continued ~ember Nitzsche wants a notation on the plan stating that if any changes are made on Sheets 1-4 they will have to come back to the Planning Board. MOTION: by Mr. Nitzsche that the applicant be required to place on the plan the notation that "any changes made on the Definitive Subdivision Plan of Salem Forest II, Sheets 1 through 4 must come back to the Planning Board for approval prior to construction". SECOND: by Mr. Burke VOTE : Unanimous - motion carries. MOTION: by Mr. Nitzsche to accept the subdivision plan and covenan~ as submitted with the completion date placed on the covenant of June 1, 1986. SECOND: by Mr. Burke VOTE : Unanimous - motion carries. Bear Hill Road - Lot 2 - Special Permit Zachary Alexanian reported that there is a discrepancy in the approved plan for a Special Permit and the plot plan given to the Town Planner by the Building Inspector. The plan Mr. Alexanian was working off was the original plan submitted to the Planning Board which has been changed. The Board discussed bringing the house closer to Road A. It was worked into the Order of Conditions that the proposed dwelling be brought forward to a 40 foot setback. It was shown on a revised plan. The plot plan shows the setback at 49 feet. Mr. Alexanian said that he changed engineers and he did not have the revised plan. The house is framed. Member Nitzsche suggested that the Board hold another public hearing on the matter. Town Planner Pomroy added that the Building Inspector will not allow any more construction because it does not comply with the Special Permit granted by the Planning Board. No action - Board to check with Chairman to determine if another public hearing is necessary. February 6, 1984 -3- Regular Meeting PUBLIC HEARING Bear Hill Road - Lots 4, 5, and 6 - S~e~ial Permits - Watershed The Clerk read the legal notices. A letter from the Board of Health dated 1/20/84 was read and placed on file. Mr. Zachary Alexian was present and made the following presenta%ion to the Board: - Since the plan was drawn, the wetland lines on the lots are now the ponding area so they are no longer wetlands. - This is not official. - There should be no wetlands on the lots. - Until this is official, they need to apply for the Special Permits. - They will hear from the Conservation Commission on Wednesday. - The do not have an Order of Conditions from Con. Com. yet. No one spoke in favor or opposition to the Special Permit requests. NOTION: by Mr. Burke to take the Special Permit requests for Lots 4, 5, and 6, Bear Hill Road, under advisement. SECOND: by Mr. James VOTE : Unanimous - motion carries. MINUTES - 10/24/83 and 12/5/83 MOTION: by Mr. Nitzsche to ~ccept as written. SECOND: by Mr. Burke VOTE : Unanimous - motion carries. ZONING BY LAW CO~ITTEE Karen Pomroy informed the members of the Board that she will be forwarding to them all the proposed changes to the ZBL. The meeting adjourned at 8:30 p.m. M~ch'~el P.
