BOARD OF SELECTMEN MINUTES April 11, 2016
CALL TO ORDER:
ChairmanTracy Watson called the meeting to order at 7:00PM at School
Administration Building Meeting Room.
ATTENDANCE:
The following were present: Chairman Tracy Watson, Clerk Phil DeCologero, Licensing
Commissioner, Richard Vaillancourt, Rosemary Smedile, Donald Stewart, Town Manager Andrew Maylor,
Assistant Town Manager, Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 25
members of the public were in attendance.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Phil DeCologero made a MOTION, seconded by Rosemary Smedile, to approve the Open Session
minutes of March 21, 2016, as presented. Vote approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:
Retirement Recognition
Gerry Brown, Inspector of Buildings was present to receive a Certificate of Recognition from the Board for
his 10 years of service.
Swearing in-Police Officer William Enright
Town Clerk, Joyce Bradshaw, administered the oath to Police Officer William Enright.
Introduction of new staff member- Brian LaGrasse, Director of Public Health
Town Manager, Andrew Maylor, introduced Brian LaGrasse, the new Director of Public Health.
Job posting/vacancy log
Included in the packets was the job posting/vacancy log from the Human Resources department.
Certificate of Achievement for Excellence in Financial Reporting for FY15
The Certificate of Achievement for Excellence in Financial Reporting for FY15 has been awarded to the
Town of North Andover by the Government Finance Officers Association (GFOA) for its comprehensive
annual financial report. The Certificate of Achievement is the highest form of recognition in the area of
governmental accounting and financial reporting.
Budget Status Report-2 nd Quarter FY 2016

Finance Director, Lyne Savage, provided a summary of the 2 Quarter FY2016 Budget Status Report.
Update on National Grid utility undergrounding surcharge
Assistant Town Manager, Ray Santilli, indicated that the National Grid utility undergrounding surcharge
that began in 2003, which was for the work done around the Town Common, will now be removed from
-4 years.
Rick Gorman, Director of Youth and Recreation Services, provided the Board with a schedule for the
Stevens Pond update and 2016 fees (taken out of order)
Rick Gorman, Director of Youth & Recreation Services, presented the Board with an update regarding
Stevens Pond, including proposed fees for 2016. Mr. Gorman recommends an increase in all fees, except
the daily adult passes.
Rosemary Smedile made a MOTION, seconded by Donald Stewart, to keep the fees for Stevens
Pond for 2016 the same as they were in 2015. Vote approved 5-0.

PUBLIC HEARING
Street Layout Hearing Hitching Post Road
Rosemary Smedile made a MOTION, seconded by Donald Stewart, to open the public hearing on
the street layout of Hitching Post Road. Vote approved 5-0.
Included in the packets were the street layout plans for Hitching Post Road along with recommendations
from Town Counsel and relevant departments. Jean Enright, Assistant Director of Community and
Economic Development, explained the reasoning for the hearing. Town Counsel reviewed and
recommended acceptance of the layout.
Rosemary Smedile made a MOTION, seconded by Donald Stewart, to close the public hearing on
the street layout of Hitching Post Road. Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen
recommend acceptance of Hitching Post Road as a public way, and declare that public necessity
and convenience require the aforesaid way to be laid out and do hereby order and direct that said
way be

Mass., applicant Charles McLaughlin, 1046 Great Pond Road, North Andover, MA, August 6, 1987,
North Essex District Registry of Deeds as Plan No. 11013, and upon acceptance by Town Meeting,
to accept deeds to the street and all related restrictions and easements shown on said plan. Vote
approved 5-0.
Street Layout Hearing-Stanton Way
Richard Vaillancourt made a MOTION seconded by Rosemary Smedile, to open the public hearing
on the street layout of Stanton Way. Vote approved 5-0.
Included in the packets were the street layout plans and recommendations from Town Counsel and

present to answer any questions. Town Counsel recommended acceptance of the layout.

Removal of Public Shade Trees-National Grid
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to open a public hearing
for the removal of public shade trees per MGL c87, §3 as requested by National Grid. Vote
approved 5-0.
Mathew Deterling of National Grid presented the request to remove twenty-one (21) public shade trees
and prune six (6) Town trees along Sutton Street, Chadwick Street, Osgood Street, and Clarendon Street.
Tree Warden, John Lavin, has reviewed the trees in the request and recommends removal.
A resident of 133 Chadwick Street asked if the stump would be removed. The Town Manager indicated
the DPW will remove the stump.

Selectmen DeCologero asked if National Grid would be willing to replace some of the trees. Mr. Deterling
indicated National Grid has a program that will pay for new trees and he would find out whether the
program is still running and if any trees could be replaced.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to close a public hearing
for the removal of public shade trees per MGL c87, §3 as requested by National Grid. Vote
approved 5-0.
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen
approve the request of National Grid to remove twenty-one (21) public shade trees and prune six

CONSENT ITEMS:

The Youth Sports Groups made their annual donations, based on their respective program registrations,
elds/Facilities.
Richard Vaillancourt made a MOTION, seconded by Donald Stewart, that the Board of Selectmen
the amount of $41,520. Vote approved 5-0.
Columbia Gas requests to excavate
Included in the packets were several requests from Columbia Gas to excavate. Vincent Luciano from
Columbia Gas was present to answer any questions. The Board asked that for the projects where the
gas mains are being replaced that residents be notified when work is to begin.
1. Massachusetts Avenue, Putnam Road, Lyman Road, Young Road, Little Road and
Greene Street for the purpose of replacing gas mains
2. Chadwick Street, Moody Street, Prospect Street, Wentworth Ave., Highland View,
Brightwood Ave. and Furber Ave. to replace existing gas mains
3. 9 Peachtree Lane for the purpose of maintaining service line
4. 15 Peachtree Lane for the purpose of maintaining service line
5. 25 Peachtree Lane for the purpose of maintaining service line
6. 29 Coachman Lane for the purpose of maintaining service line
Rosemary Smedile made a MOTION, seconded by Donald Stewart, that the Board of Selectmen
approve, subject to the conditions of the Department of Public Works, the six requests of
Columbia Gas of Massachusetts to excavate, as presented. Vote approved 5-0.
LICENSING COMMISSIONERS:
Rosemary Smedile made a MOTION, seconded by Phil DeCologero, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.

Cigar Night on Thursday, June 16, 2016 from 6:00pm-11:30pm
Donald Stewart made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen,
acting as Licensing Commissioners, approve a One Day All Alcohol license for St. Gregory
-11:30pm and
waive the application fee. Vote approved 5-0.

Dolly Miller of Psychic Readings, 163 Turnpike Street, requests to renew Fortune Teller license
Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen, acting
as Licensing Commissioners, approve the Fortune Teller license renewal for Dolly Miller of
Psychic Readings. Vote approved 5-0.
Paul and Alexandra Dedoglou of Star Pizza & Family Restaurant request a Common Victualler License
and an Entertainment License
Phil DeCologero made a MOTION, seconded by Donald Stewart, that the Board of Selectmen,
acting as Licensing Commissioners, approve the Common Victualler and Entertainment licenses
for Star Pizza & Family Restaurant of North Andover, Inc. Vote approved 5-0.
Residents of 25 Mass. Ave spoke regarding non-compliance issues with the previous owner and raised
their concerns about the number of cars and where they will be stored.
Tracy Watson made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen,
acting as Licensing Commissioners, approve the Class II license for John J. Eleftherakis d/b/a/
-0.
Donald Stewart made a MOTION, seconded by Rosemary Smedile
to close the meeting of the
North Andover Licensing Commission. Vote approved 5-0.

PUBLIC COMMENT:
Phil Lahey of the Merrimack Valley Prevention and Substance Abuse Project invited the public to attend
their next annual membership meeting on Thursday at 6:30PM at the North Andover Senior Center.
Tom Schiavone asked about a licensing hearing for Smolak Farms. The Town Manager indicated that
hearing was postponed.
Selectmen Stewart asked the Town Manager to call National Grid about a pole on Chadwick Street that is
leaning.
