In response to your request,Coler&Colantonio,Inc, has reviewed the submittal package for the
above referenced site. The project has been reviewed for conformance to the requirements of the
"North Andover Zoning Bylaws"in North Andover as well as standard engineering practice.
The submittal package included the following information:

The site is located on a triangular parcel bounded by Route 125 and Barker Street. The current
zoning of this parcel is General Business. The abutting property to the north is in a Residential 2
'Lone. The parcel is currently developed and contains an existing vacant building and impervious
parking areas. The site slopes from a higher elevation along the easterly property limits to lower
grades at the corner of Route 125 and Barker Street. Reportedly no wetlands have been
identified on the plans.
We offer the following comments:
Zoning Bylaws
1. It is our understanding that Sections 8.3.5.e)ii,iii;iv-x,ix,x_x,xxii and xxiii, are typically
reviewed by Town Staff.
2. Section 8.3.5.e.iv_ It is unclear if easements exist or are required for the existing gas line and
telephone line on the proposed lot.
3. Section 8.3.5.e.v. The contours on the site plali do not extend 50' beyond the site
boundaries.

4. Section 8.3.5.e.vi. The Zoning information should include proposed conditions.
5. Section 8.3.5.e,vii. The proposed work on the site appears to reduce the semi-impervious
areas and replaces it with grassed areas. Runoff calculations were not performed since the
curve number would reportedly be reduced under proposed conditions. Proposed pavement
expansion appears to be limited to the parking area described as full-depth pavement
i construction. It appears that curbing is proposed in the parking area. This will result in a
ponding condition in the southwest comer. A catch basin should be installed in this area to
reduce any ponding affects. Additional spot grades should be shown to assure stormwater
will enter the catch basins and not cause a ponding problem in the parking area corners.
6. Section 8.3.5.e.x. It is unclear if access to the building complies with ADA requirements.
7. Section 8.3.5.e.xii. The proposed height and material of the sign should be indicated on the
drawing.
8. Section 8.3.5.e.xiii. The distance to adjacent curb cuts should be specified.
9. Section 8.3.5.e.xiv. All outdoor storage/display areas should be identified on the plans if
applicable. An existing chain link fence and concrete wall are located within the Barker
Street right-of-way.,
10. Section 8.3.5.e.xv. It is unclear if the landscape plan conforms to Town requirements. It is
unclear if a sufficient buffer exists along the northern property/Zoning boundary
11. Section 8,3.5.e.xvi. The dumpster does not appear to be screened.
12. Section 8.3.5.e,xviii. A drainage basin study has not been provided. At a minimum a pre
and post runoff curve number analysis should be performed. The plans should clearly show
where the drainage pipes tie into the existing road system.
13. Section 8.3.5.xix_ A,state curb cut permit may be required for this project.
14. Section 8.3.5.e.xxi. The gas and telephone line connections to the building should be shown
on the plan.

The Division of Public Works has reviewed plans dated July 21, 1997 for a
Proposed Retail Florist at 1211 Osgood Street drain by VHB Inc. We have the following
comments.
1. Any guardrail to be removed along Barker Street which is in good condition shall
be stockpiled for removal by the D.P.W.
2. The existing chain link fence and concrete wall to the rear of the property is
encroaching on Town Property.
3. Multiple underground utilities including two town water mains have been installed
in the proposed 20,949 sq. ft. lot which apparently is to be conveyed to the
property owner by M.H.D. Twenty foot wide easements should be provided for
the two water mains.

Thank you for giving me the opportunity to speak at a very well managed hearing last
Tuesday evening.
I am pleased that the board chose to study the site plan a bit further, I am very concerned
about the plan to build, such an extensive 6 foot high chain-link fence surrounding the site.
Such a fence, l feel, would not only be a distraction.(even with covering)but a signal.
of an area that is vulnerable to theft, Furthermore, I personally feel, having such an area for an
open display of sales items would cause our business and surrounding like businesses to expand
their selling areas to compete for sales, thus causing a worsening of already traffic congestion we
have.
To keep the letter brief,I cite only a couple of reasons to why the plan should be
modified. I truly appreciate that you and the board will take this under advisement. Thank you
for your consideration in this matter.

This Department has reviewed the above proposal and find that it will not significantly
impact traffic on Osgood Street or Barker Street, nor, is there data supporting the concern
for accidents at that location. Previous use as a business did not show an increase in the
accident rate. It has been our experience that Frank Terranova has always been cooperative
with traffic concerns at McLay's Florist on Route 114 and we would expect the same
cooperation at the new location. This Department would recommend approving the plan.

Dear Mr. Rowen,
This letter is an update and request to proceed with occupancy, with conditions, for the McLay's
relocation proposal for 1211 Osgood Street. We have just recently closed, January2nd, on the
Stop & Shop property. This unfortunate delay has delayed our capital that we intend to use for
improvements to the Osgood Street site. As a result we are not in the position of being able to
construct some of the improvements due to the inappropriate construction season. Therefore we
would ask that we be allowed occupancy with the following construction items delayed until the
spring.
1. Paving in the parking lot: The asphalt plants are closed and we are unable to repave the
site. We are planning to repave the site. We will defer this work until the spring.
2. Fencing: We are unable to construct the fencing at this time due to the frost conditions. We
will construct the fencing at the earliest possible time in the spring.
3. Lightning: This construction is related to the reconfiguration of the parking lot. Therefore
the lighting will be constructed in the spring with the parking lot repaving.
I respectfully recommend that the Planning Board allow McLay's to proceed with occupancy and
condition the completion of the site against the $2,000 that the Planning Board is currently
holding.
I am committed to complete the project and improve the site to one that the Planning Board, the
McLay's organization and the Town can take pride.

Thank you for appearing before the Planning Board last night to discuss the status of your project
located at 1211 Osgood Street. Prior to occupancy of the building you must complete all items
required by the approved plan and decision other than the paving of the site.
If you are not able to complete all of these requirements, you may request an extension of time to
complete those items by submitting in writing the reasons why you are not able to complete the
items, a cost estimate for the completion of those items, and a date by which those items will be
completed. The Planning Board has given me the authorization to review those documents and to
make a determination as whether the time frame for completion may be extended and the amount
by which the bond for the project must be increased.

After examining your plot plan for the Osgood Street
location, was recommend you hold of putting lights in
the parking lot until the Spring. With your planned
opening date of January 19, 1998, was would not have
enough time to order lamps, light doles, and bases.
Also, we would need to dig up the existing hot top,
and this would create constants problems with trenches
sinking throughout the winter months.

installing some temporary lights on the side of the

I am writing to inform you that the majority of Board issues have been resolved for this project

afternoon that the lights will be installed by tomorrow.
• The entrance to the site from Barker Street and any low points in the parking area must be
graveled within 14 days, as soon as the weather allows.
The Planning Board is holding bond money for the remaining items required by the site plan

I have reviewed you request to replace the picket fence along Barker Street with four planting
boxes and to replace the sliding gate with a butterfly gate. I approve these changes, as the
planting boxes will provide a protective barrier between Barker Street and the parking lot for
your facility. The butterfly gate will serve the same purpose as the sliding gate and will be less
visible on the site and easier for your employees to manage.

Dear Mr. Terranova,
Thank you for meeting me on site yesterday to review the items that remain to be completed
prior to final bond release. The following items must be addressed:
1. The paving must be completed as shown on the plan with curbing around the entire site.
2. The parking lot must be striped according to the plan.
3. The dumpster must be screened with a 6' stockade fence and gate as shown on the plan.
4. The landscaping must be completed at the entrance to the site from Osgood Street, between
the picket fence and the edge of Osgood Street, and at the entrance to Barker Street as shown
on the plan.
5. The proposed sign must be submitted to the Planning Department for review and approval.
6. A copy of the Highway Access Permit from the Massachusetts Highway Department must be
submitted to the Planning Department. If the permit is not necessary than a letter confirming
such from the applicant will be required.

7. A final as-built plan showing the location of all on-site utilities, structures, curb cuts,parking
spaces and drainage facilities must be submitted to and reviewed and accepted by the
Planning Staff and the Division of Public works.
If you would like to modify the plan by revising the striping, paving and/or landscaping you
must submit a revised plan to the Planning Department for review and approval.
In my opinion you have sufficiently completed work on the site for final occupancy. I will
therefore send a letter to Robert Nicetta, Building Inspector informing him that you have
satisfied the Planning Board's site plan approval requirements for occupancy.
As you have completed the lighting and fencing as required by the plan, I will recommend
release of$15,000 of the total bond held for the completion of this site. The Planning Board will
discuss this issue at their meeting of June 16th at 7:00 p.m. in the DPW meeting room.

locatioh for a proposed retail florist.

Becau4e the proposed retail florist store should riot generate a significant arnomE of
additional vehicle trips per day and because the existing access is adequate,the
Massachusetts Highway Department(MassHighway)does not feel that an additional
access!Permit needs to be issued.

Re: 1211 Osgood Street - McLays Florist
I am writing to inform you that the majority of Board issues have been resolved for this project
such that an Occupancy Permit may be issued subject to the following conditions:
• The site lighting must be completed prior to occupancy. Mr. Terranova reported to me this
afternoon that the lights will be installed by tomorrow.
• The entrance to the site from Barker Street and any low points in the parking area must be
graveled within 14 days, as soon as the weather allows.
The Planning Board is holding bond money for the remaining items required by the site plan
review approval. If you have any questions please do not hesitate to call me at 688-9535.
