BOARD OF SELECTMEN MINUTES May 10, 2016
CALL TO ORDER:
ChairmanTracy Watson called the meeting to order at 6:05 PM at North Andover
High School, Room 1108.
ATTENDANCE:
The following were present: Chairman Tracy Watson, Clerk Phil DeCologero, Licensing
Commissioner, Richard Vaillancourt, Rosemary Smedile, Donald Stewart, Town Manager Andrew Maylor,
Assistant Town Manager Ray Santilli, Executive Assistant, Laurie Burzlaff and Town Counsel Thomas
Urbelis. 3 members of the public were in attendance.
PLEDGE OF ALLEGIANCE
Pledge will be done at Town Meeting.
APPROVAL OF MINUTES:
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, to approve the Open
Session Minutes of April 25, 2016 and the Executive Session minutes of March 21, 2016 and April
25, 2016, as presented. Vote approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:
Update from Community Preservation Committee-John Simons
John Simons, Chair of the Community Preservation Committee gave an update on the 45 Milk Street
property. He indicated that the CPC brought in Joe Pelich, a local developer, to broker a deal with the
owner to buy the property and then sell the land to the town. CPC is reducing the amount of that line item
in Article 28 from $1,200,000 to $900,000 but actual purchase price will be based on the appraisal.
Chairman Watson asked what Mr. Pelich is paying for the property. Mr. Simons indicated he did not
know.
CONSENT ITEMS:
The Board voted their recommendations on Articles 15, 16 and 28.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, that the Board of
Selectmen recommend favorable action on Article 28. Motion defeated 2-3. Selectmen Watson,
Decologero and Stewart voted to take no action.
Phil DeCologero made a MOTION, seconded by Donald Stewart that the Board of Selectmen
recommend favorable action on all items in Article 28, except 45 Milk Street. Vote approved 5-0.
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen
recommend unfavorable action on Article 15. Vote approved 5-0.
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen
recommend favorable action on Article 16. Vote approved 5-0.
Request of Brooks School to use the Town Common on May 24, 2016 from 2:15pm-2:45pm for a senior
group photo
Shaunielle McDonald of Brooks School submitted a request use of the Town Common on May 24, 2016
from 2:15pm to 2:45pm to take a senior group photo around the Phillips Brooks statue. All relevant
departments reviewed the request and have no issues.
Phil DeCologero made a MOTION, seconded by Donald Stewart, that the Board of Selectmen
approve the request of Brooks School to use the Town Common on May 24, 2016 from 2:15pm to
2:45pm for a senior group photo. Vote approved 5-0.
Request of North Andover Patriotic Observance and Marching Committee to conduct Memorial Day
Parade and Ceremony on Monday, May 30, 2016 from 10:00 am-12:00pm
Included in the packets was a request from Gerry Maguire, Director of Veteran Services, to hold the
annual Memorial Day Parade on May 30, 2016 from 10:00 am-12:00pm. The parade route will be from
Osgood Street to Mass Avenue to Salem Street ending at Ridgewood Cemetery. All relevant departments
have reviewed and have no issues.
Donald Stewart made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen
approve the request of the Patriotic Observance and Marching Committee to hold the annual

Memorial Day Parade on May 25, 2016 from 10:00am to 12:00pm starting at Osgood Street. Vote
approved 5-0.
LICENSING COMMISSIONERS:
Phil DeCologero made a MOTION, seconded by Donald Stewart, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Paul Gallant of Merrimack College requests One Day Wine and Malt licenses for the following events:
Graduation ceremony on Tuesday, May 17, 2016 from 4:30pm-7:30pm at Deegan West 47 Lounge
Brunch for Higher Education Program on Wednesday, May 18, 2016 from 11:00am-2:30pm at Cascia
Hall

Road Race Celebration on Saturday, July 16, 2016 from 9:00am-2:00pm at Mendel Lawn
Road Race Celebration on Sunday, July 17, 2016 from 9:00am-2:00pm at Mendel Lawn
Tracy Watson made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen, acting
as Licensing Commissioners, approve the 5 One Day Wine and Malt licenses for Merrimack
College as presented. Vote approved 5-0.
Stacey Adamsan and Jennifer Maguire request a One Day All Alcohol license for a Wedding Reception at
Smolak Farms on Friday, May 27, 2016 from 4:00pm-10:00pm
Chad Marianelli and Tracey Lamper request a One Day All Alcohol License for a Wedding Reception at
Smolak Farms on Saturday, May 28, 2016 from 5:00pm to 10:00pm
Aaron Zadalis and Kaitlyn Zadalis request a One Day All Alcohol License for a Wedding Reception at
Smolak Farms on Sunday, May 29, 2016 from 4:00pm-10:00pm
Phil DeCologero made a MOTION, seconded by Donald Stewart that the Board of Selectmen,
acting as Licensing Commissioners, approve the 3 One Day All Alcohol license requests for
wedding receptions at Smolak Farms on May 27, 28, and 29, 2016, as presented. Vote approved 5-
0.
Phil DeCologero made a MOTION, seconded by Donald Stewart, to close a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
recess to the auditorium for the 2016 Annual Town Meeting and return to open session at the
conclusion of Town Meeting. Vote approved 5-0.

Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt, to adjourn the meeting at
