NOTICE OF DECISION (INSUBSTANTIAL CHAM,;E)

Premises Affected: 1320 Osgood Street, Assessors Map 34 Lot 30.
HISTORY AND BACKGROUND
On March 2, 2012, 1320 Osgood Street Corp. filed an Application for a Site Plan Review
Special Permit with the Planning Board pursuant to Section 8.3, 10.3 and 10.31 of the Town of
North Andover Zoning Bylaws. On May 23, 2012,the Planning Board unanimously voted to
grant the Applicant a Site Plan Review Special Permit approving the Project,
On June 15, 2012, Scanlon Engineering,represented by Frank Emery,provided an
updated plan with respect to certain changes requested by the town of North Andover Health
Department. (as outlined in the memo from S. Sawyer, Health Director, dated June 14, 2012).
The changes were requested due to the location of an existing subsurface disposal system located
on the eastern side of the existing dwelling unit. Specifically, the Applicant is providing the
following changes:
9 The driveway is now shown as two-way on the southern side of the existing building,
entering from Osgood St, and connecting to the parking lot at the rear of the building.
The driveway along the northern side of the building has been eliminated
® The drainage swale that had been proposed along the northern side of the parking area
has been eliminated.
FINDINGS OF FACT
The proposed revisions fall into the categories outlined in Section 8.3.8.a of the Town of North
Andover Zoning Bylaws, which are as follows:
i.) A change of location and layout of any parking area(s), signs, storage or accessory
buildings, provided that no Town Bylaws are violated by the change;
ii.) A change of egress and ingress provided the same is in compliance with Town Bylaws
and the requirements of the Commonwealth.
iii.)The applicant has provided an updated plan set dated June 26, 2012. A 'Vitie Copy

iv.)The updated plan set was reviewed by the town's stormwater consulting engineer, L.
Eggleston, who approved the changes made by the applicant.
v.) The updated plan set was reviewed and approved by the Town of North Andover Health
Director, S. Sawyer, in an email dated June 26, 2012.
The proposed changes are therefore deemed,,insubstantial and not materially different that the
approved plan,referenced in the May 23,2612 Special Permit Decision.
CONDITIONS
The Town Planner's finding of no substantial change is conditioned on the following:
• This Decision shall be recorded with the Registry of Deeds and evidence of
recording is to be provided to the Planning Department.
