HomeMy WebLinkAboutInsubstantial Change - 601 MAIN STREET 5/18/2010 RT�j 0 Town of North Andover Office of the Planning Departmegtj 2 4 2: 2�;-) Community Development and Services Division 1600 Osgood Street S CWJS North Andover, Massachusetts 01845 NOTICE OF DECISION (INSUBSTANTIAL CHANGE) Date of Decision: May 18, 2010 Application of: North Andover Public Schools 1600 Osgood St., North Andover,MA 01845 Premises Affected: Kittredge School, Main Street, North Andover, MA 01845, within the Residential - 4 Zoning District HISTORY AND BACKGROUND On or about April, 26, 2010, the Applicant,North Andover Public Schools filed an Application for Site Plan Review Special Permit with the Planning Board pursuant to Section 9.3 of the Town of North Andover Zoning Bylaws. On May 18, 2010,the Planning Board unanimously voted to grant the Applicant an insubstantial change to a previously approved Site Plan Review Special Permit for the Premises affected, which had been issued on November 3, 2009. By application, dated April 26 2010, the Applicant requested a determination of insubstantial change with respect to certain proposed adjustments to the approved Site Plans in accordance with the Site Plan Special Permit Decision, as well as Section 8.3 of the North Andover Zoning Bylaws, which authorize the Town Planner to make a determination of whether certain changes to the site plans constitute substantial changes. Specifically, and as outlined in the Application, the proposed plan adjustments are related a change in the State Building Code which would require that any addition to an existing building which would create a combined total of more than 7,500 sq. ft., sprinklers would be required in both the addition and the building. The School Department was then obligated to request funds from Town Meeting to provide a sprinkler system and such funds were approved at the Annual Town Meeting held on May 11 —May 12, 2010. The School Department then proposed the following insubstantial changes to the previously approved plan to: (1) the footprint of the addition has changed to 2800 sq. ft.; (2) improvements to the stonriwater management system will be incorporated into this decision,based on the plan provided by Gene Willis, town engineer, dated May 21, 2010 (3)the location of the addition will be situated slightly to the south of the prior location, FINDINGS OF FACT Pursuant to my authority as Town Planner pursuant to Section 8.3 of the Zoning Bylaw, I have reviewed the application for Site Plan Review with regard to proposed adjustments to be Kittredge School - North Andover School Deaprtinent Site Plan Special Permit(Insubstantial Change Decision) May 18,2010 made to the approved Site Plans identified in the above-referenced Site Plan Special Permit Decision and prior determinations, have met with the Applicant and its consultants concerning proposed improvements and have presented the facts to the Planning Board at a duly noted public hearing, Based upon the foregoing, and after consultation with the Planning Board, I have determined that the proposed plan adjustments shown on the plans entitled "Site Plan," dated December 23, 2009 prepared by Gary Marshall, LLC, are not substantial changes but are in fact minor, insubstantial changes, subject to the following conditions. CONDITIONS The Town Planner's finding of no substantial change is conditioned on the following: 1. That this Decision is recorded with the Registry of Deeds and evidence of recording is to be provided to the Planning Department; and, 2. Except as modified as described above, the Site Plan Decision made on November 3, 2009 shall remain in full force and effect.
