The owner intends to submit a warrant article for the May,2005 Town Meeting requesting a zoning map amendment for the parcel above from Industrial 1 (1-1)to Business 2(B-2)and we are requesting the Board's input on the same. The Property The Property known as 1503 Osgood Street is a 6.1-acre parcel of land which is located at the comer of Osgood Street and Orchard Hill Road on the easterly side of Osgood Street across the street from the Lucent Facility. The site is also located across Orchard Hill Road from the Merrimack Valley Credit Union and the AAA building. The Property is currently not in use and includes two existing residential dwellings along with a number of old outbuildings,all of which is in general disrepair. In June, 2003,the owner acquired the property with the intent of constructing an indoor soccer facility. To this end, the owner also went through the Town's Technical Review Committee process on April 10,2003 for the proposed indoor soccer facility. Thereafter,based upon a number of factors,including site constraints&%well as market concerns,the owned decided not to pursue the proposed indoor soccer facility. Since that time,the owner has been actively marketing the property for lease and for sale but has not attracted the type of uses desired because of the current industrial-1 zoning. SMOLAK&VAUGHAN LLP March 11,2045 The Proposed Rezoning On March 9,the owner met with representatives of the Community Development and Services Department to discuss the proposed rezoning and they suggested an informal discussion with the Board concerning this matter. As noted above, the owner desires to rezone the Property from Industrial-1 to Business-2 because such rezoning will provide it with greater flexibility to redevelop the Property where Business-2 uses would be more suited to the area. Such a rezoning is consistent with the vast majority of rezoning efforts which have occurred over the past 5 years as most rezoning occurring along this stretch of the Route 125 corridor have resulted in a rezoning to B-2. With such a rezoning,the owner feels the Property can be used in a manner which will complement the adjacent uses and proposed future uses along this area of Osgood Street.
