CONSERVATION 'SS' DIVISION OF PLANNING PLANNING & COMMUNITY DEVELOPMENT June 2, 1993 Mr. Daniel Long, Town Clerk Town Building 120 Main Street North Andover, MA 01845 Re: Site Plan Review First Methodist Church Dear Mr. Long: The North Andover Planning Board held a public hearing on May 18, 1993 in the Senior Center behind Town Building upon the application of the Trustees of the First Methodist Church requesting Site Plan approval under Section 8 . 3 of the North Andover Zoning Bylaw. The legal notice was properly advertised in the Lawrence Eagle Tribune on May 3 , and May 10, 1993 and all parties of interest were duly', notified. The following members were present: Richard Nardella, Chairman, John Simons, Vice Chairman, Joseph Mahoney, Clerk, Richard Rowen, and George Perna. Mr. Paul Minor, architect, and Jerry Foley, engineer, were present. Ms. Bradley gave an overview of the Technical Review Committee Meeting. There was a discussion of the parking with Mr. Bob Nicetta, Building Inspector and a discussion of the drainage with Mr. Bill Hmurciak, D.P.W. Mr. Minor discussed the existing structure and gave an overview of the planned expansion. Mr. Simons wanted to know the extension of the foot print. There was not much extension of the existing foot print. Mr. Nardella asked if there were any repairs or repainting planned. Mr. Minor ' s answer was "yes" . Some. repair and repainting was planned. The architect is planning to maintain the current lines and windows in the expansion. Page 2 : First Methodist Church The average attendance is between 120 and 140, • including the choir on Sunday. At least 220 parking spaces are needed. The site plan shows 110 parking spaces. Mr. Simons asked if they needed new parking spaces. Mr. Minor answered "no" , the church does not feel that it needs any new parking. Mr. Nardella questioned the lighting. Mr. Minor stated that there would be four lights up at .the steeple, three exterior lights at the entrance, facing down, on tall wooded poles, 12-14 ft. high, to delineate area of entrance. These lights would be focused down on the steps. Mr. Nardella told the applicant he needs to change the design of the lights because it looks as though the lights will project' outward. The. applicant to work with Planning Staff on choice of lights. Mr. Nardella asked 'what the height of the spire was. The answer was 22 . 5 ft. from the ground. Mr. Perna would pfefer to have a future parking area designated instead of having the applicant request a variance from the ZBA. Planning staff to work with the applicant and Building Inspector on the number of parking spaces needed. Landscaping to be -shown on the plans. A new sprinkler system to be installed. Fire hydrants located on plans. The time-frame on construction is starting in July, continuing until January. A construction schedule is needed. On a motion by Mr. Simons, seconded .by Mr. Rowen, the Board voted to continue the public hearing until June 1, 1993 and directed Ms. Bradley to draft a •decision for their review. The Board would like to see landscaping along Route 114 and the type of building material to be used, they want it to match the existing building. On. June 1, 1993 the Planning Board held a regular meeting. The following members were present: Richard Nardella, John Simons, Joseph Mahoney, Richard Rowen, George Perna and John Draper. Ms. Bradley reviewed the issues from the last meeting with the Planning Board. Additional trees to be added along Route 114 as shown on plans submitted to the Board this evening. There are 350 parishioners, with 100-125 every Sunday. Page 3 : First Methodist Church On the parking issues, Paul Minor reviewed his calculations of needed spaces. There are 86 spaces, 220 spaces are needed based on building code specifications. Mr. Simons questioned if there were enough spaces to cover the present use. The answer was yes and that there is a flat surface to create additional parking. Mr. Draper questioned striping of existing spaces and future expansion if necessary as determined by the ZBA or Planning Board. Additional 25 spaces to be added now. Mr. Mahoney recommended to make a suggestion to the ZBA on the number of spaces . The applicant to stripe 86 spaces now, 25 additional spaces to be constructed and future parking to be shown on plans. Because of current use, expansion of sanctuary, a limited number of new spaces is needed. A total of 110 spaces will be constructed. The applicant to construct 110 parking spaces with future parking shown on plans for remaining, number of spaces. A bond of $5, 000 will be held in an escrow account. On a motion by Mr. Mahoney, seconded by Mr. Simons the Board voted to close the public hearing and take the matter under advisement. On . a motion by Mr. Perna, seconded by Mr. Draper the Board voted to approve the draft decision as amended. Attached are those conditions. ' Sincerely, North Andover Planning Board Richard A. Health Agent Assessors Police Chief Fire Chief Applicant Engineer File First United Methodist Church 47 Peters Street, North Andover, MA SITE PLAN REVIEW, SECTION 8.3 OF THE NORTH ANDOVER ZONING BYLAW. The Planning Board makes the following findings regarding this Site Plan Review for the. construction of a 3 , 648 sq. ft. addition to the existing church as required ' by section 8 . 3 of the North Andover Zoning Bylaws: FINDINGS OF FACT: 1. The proposed use and site design for this- lot are appropriate, as the church currently exists on the site. 2 . Adequate vehicular and pedestrian access into the surrounding site has been provided 'with the adherence to the approved .plans. 3 . The landscaping plan as shown and revised, meets the requirements of section 8 . 4 of the Zoning Bylaws, with the addition of the enclosed conditions. 4 . The site drainage system is designed in accordance with the Town. Bylaw requirements. 5. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8 . 3 of the Zoning Bylaw. 6. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally, the Planning Board finds that this modification generally complies with the Town of North Andover Zoning Bylaw requirements as listed in section 8 . 35 but requires conditions in order to be fully in .compliance. Therefore, in order to fully comply with the approval necessary to construct the facility as specified in the Site Plan Review application before us, the Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1. Prior to the endorsement of the plans by the Planning Board and recording with the Registry of Deeds, the applicant shall adhere to the following: a. All conditions listed herein shall be placed on the final sheet of the record plans. 1 2 Prior to any construction a bond in the amount of $5000. 00 shall be posted for the purpose of insuring that a final As- Built plan showing location of all on site utilities, structures, curb cuts , parking spaces and drainage facilities be submitted. This bond shall be in the form of a check made out to the Town Of North Andover. This check will then be deposited into an interest bearing escrow account. 3 . Prior to FORM U verification (Building Permit Issuance) : a This decision shall be recorded at the Essex North Registry of Deeds and a recorded copy delivered to the Planning Staff. b. The applicant shall place erosion control measures on site as directed by the Town Planner. C. The North Andover • Division of Public Works shall approve all plans. Any changes to the plans approved by the Planning Board shall be reviewed by the Town Planner. Any changes which the Town Planner may deem as major shall be- approved by the Planning Board. d. The Town Planner shall approve of the material to be used in the exterior construction. The material is to be consistent with the existing building. 4 . Prior to verification of the Certificate' of Occupancy: a. The building 'shall have fire sprinklers installed per order of the North Andover Fire Department. b. The applicant must install a fire alarm system with a new control panel, annunciator and all appurtenances as .required by the North Andover Fire Department. c. The site shall be reviewed by the Planning Staff. Any screening as may be reasonably required by the Planning Staff and/or Tree Warden will be added at the applicant 's expense. nd A final as-built showing the location of all on site utilities, structures, curb cuts, parking spaces and drainage facilities must be submitted to and approved by the Division of Public Works. e. All artificial lighting used to illuminate the site shall be approved by the Planning Staff. All lighting shall have underground wiring and shall .be so arranged that all direct rays from such lighting falls entirely within the site and shall be shielded or recessed so as 2 not to shine upon abutting properties or streets. The site shall bs" reviewed by the Planning Staff. Any changes to the approved lighting plan as may be reasonably required by the Planning Staff shall be made at the owners expense. 5. An application must be made to the Zoning Board of Appeals to determine a sufficient quantity of parking spaces to accommodate the use. In the interim period, the Planning Board recommends that the applicant construct an additional 24 parking spaces to create a total of 110 spaces. The applicant must designate* on the plans to be endorsed by the Planning Board an area designated for future parking containing the amount of parking spaces required under the Town of North Andover Zoning Bylaw. 6. Any Plants, Trees or Shrubs that have been incorporated into the Landscape Plan approved -in this decision, that die within one year from the date of this approval, shall be replaced by the owner. 7 . The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 8 . Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 9. All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction. 10. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 11. No underground fuel storage shall be installed except as may , be allowed by Town Regulations. 12. All signs within the project shall be of wood or stone, with uniform lettering and design. The signs shall in no way be interior illuminated. (Neon or other -means) 13 . No mechanical devices (ie: HVAC, vents, etc. . . ) which may be visible from any surrounding roadways shall be placed on the roof. 14 . The applicant, in conjunction with the Town Planner and/or the Tree Warden, shall mark all trees to be preserved prior to any construction on site. 3 .p 15. The provisions of this conditional approval shall apply to and be binding upon the applicant, it' s employees and all successors and assigns in interest 'or control.
