Folks,
I just had a meeting with Jeff Sheehy(owner of 102 Peters St.) and the potential day care center operator, Kerri
Fantasia. I had many concerns about traffic at 102 Peters St.with a Day Care Center Use. As you know,there were
many questions regarding traffic the last time you reviewed this project for office use.The new traffic report from
Dermot Kelly does show an increase in traffic for the day care center.
Attached are two forms:
A Drop-Off and Pick-Up Form. Parents are expected to choose a specific time for drop-off and pick-up. The Center has a
specific number of slots open for each half hour and when the slots are full, they do not accept a new registration,
unless the families choose another half-hour slot. They are also asked to be as specific as possible (7:15?, 8:10?, etc.) so
that the operator of the center can determine staffing and also to alleviate traffic problems.
A Sign-in and Pick-up Sheet from the Tewksbury Day Care Center owned by Kerri Fantasia. This sheet shows actual drop-
off and pick-up times and as you can see,they vary from 7:10 AM to 9:38 AM for drop-off and from IPM to 6PM for pick
up. The center's policy is to fine parents by the minute if they are late. And they are not allowed to continue at the
center of they are late more than three times.
Kerri will be at the meeting to answer all of your questions about the center's policies and Demot Kelly,the traffic
engineer will be at the meeting as well.

The 2nd bullet was intended to have them submit the drop off/ pick up schedule based on the
approved number of students. To a large degree, the timing will be self regulating, as parents will all
want to avoid congestion and will tend to arrive a few minutes early or late within their time slot to
ensure smooth going. I do not believe we need enforcement by us or the Town.
I wasn't trying to force a vote at the next meeting. I think if we agree on an approach, and convey that
to the applicant, then they'll have decisions to make. If they want to continue, then draft the decision
for a vote.

As we discussed after the meeting the other night, we have already approved a Special Permit
for the site. The current request is for a modification to that SP. In my opinion, we aren't under
the same obligation to approve the modification as we were to grant the SP to begin
with. Given that they now have the right to conduct business on the site, the requested Mod
should meet Zoning requirements for the proposed use. Therefore, my
recommendations would be:
• limit the number of students to the number allowed by the current number of parking
spaces. That would reduce the number from 39 to something less.
• stagger the drop off/ pick up times as discussed
• incorporate the signage, and right turn only restriction as suggested at the last
meeting.
Advise the applicant of those conditions to see if they want to continue. If yes, then draft a

Folks,
I have put a list of considerations for you regarding 102 Peters St:
Parking spaces: The site does not have the required number of parking spaces. According to
Section 8.4 "Table of Off-street Parking Regulations", Day Care Centers are required to have .35
spaces per licensed capacity. I talked with the Building Inspector and he said that "licensed
capacity" is interpreted as the number of enrolled students. In this case, that number is 39 and
it equates to 14 spaces (.35 Z 39 = 13.65). The Board can deny the application on this basis
alone, since the project does not meet the requirements of the zoning by-law.
The peer consultant has stated in his last report that the size of the building (2,745 sq. ft.)
would result in 11 vehicle trips per day at weekday mornings and evening peak hours. He
stated that "this level of activity would be equivalent to a day care center serving 15 students."
The Board could decide to grant the Special Permit, on the condition that the maximum
number of students would be 15.
The Board could also condition the decision so that the traffic mitigation measures suggested
by Dermot Kelly (and by Lora) be implemented (do not block entrance sign, right turn only sign,
etc.)
Another condition would be that a management plan would be put in place to monitor the
drop-off, pick-up activity and traffic issues, including queuing on Peters St. and blockage of the
intersection of Peters St. and Route 114. This condition would be difficult to enforce. The
activity would have to be monitored by a third party and reports would come back to the
Planning Department. Based on the findings in that report, I could make recommendations to
the Board that the applicant come back to the Planning Board for a modification of the Site Plan
Special Permit, however, that compliance would depend on the cooperation of the applicant.

The Planning Board has no authority to change the operation of or to close an existing business
based onnon-conlp|iance, other than acivil lawsuit. (as in8OSaileWay)
Lt. Foulds has expressed his Concerns regarding the intersection of Route 114 and the lack of
maneuverability iD the parking lot. | agree with his assessment. | think the lot is too small; it
lacks adequate parking spaces; it also lacks a separate entrance and exit, as is common with
most day care centers.
The latest plan shows a fenced in area in the rear of the building for the play area. The plan
shows only grass and no structured play equipment with appropriate surface treatments. Also
note that there is8catchba5in within that play area and that there isanunderground
stnrnovvate[system located beneath the grassed area.

Drop Off and Pick Up Procedure
Please follow these procedures and all will be happy!!
Please adhere to your contracted time of drop off and pick up, which is attached.
When entering the driveway, please observe the 5 mph speed limit. Enter the driveway on
the right, to allow for exiting vehicles.
Pull into any parking spot, except for the employee parking spaces which are clearly marked.
Please turn off engine while dropping off or picking up your child. This is a must!!! As it is a
safety issue for all.
A staff member will be at the entrance to receive your child. The adjustment to school is easier
when a teacher is there to help you get your child into school. Be firm and tell them it is a
school rule!
Please be advised it is very important to sign your child into and out of school each day. The sign
in sheet is located just inside the door way. Locate your child's name, notate the time of drop off
and initial your name. The same will be done during pick up. Good byes are best said at the
sign in area. Your child will then put his/her belongings away.
When exiting the driveway, please observe the right turn only onto Peters Street and the 5 mph
speed limit.
Failure to adhere to any of the drop off/ pick up proceedures will first result in a warning, then
a meeting with the director regarding our safety policies.

POLICIES
Important general information you must be aware of. PLEASE INITIAL EACH LINE.
1. Tuition will remain the same throughout the year despite absences from school due to illness, holiday closings and
a day at the end of the year for graduation show.
2. There are three weeks during the year that tuition is NOT required. Those weeks include Christmas week,
February and April vacation weeks. It is permissible for vacations to be taken at other times other than these,
however PARENTS ARE STILL RESPONSIBLE FOR TUITION PAYMENTS.
3. A two-week paid notice is required for permanent withdrawal from the program. If you withdraw during the
summer, you will lose your security deposit.
4. We DO NOT HAVE DELAYED OPENINGS. School closes when North Andover Public closes their schools.
5. Drop off times are scheduled in 15 minute increments between 7-9. If you are late and do not arrive at the
contracted time slot it will result in a warning for the first occurrence, and a fine the second occurrence, the third
occurance will result in a meeting with the director. Late pick up of a child will result in a warning for the first
occurrence, $1.00 per minute for the second occurrence and $5.00 per minute for the third. Any after that, a
meeting will be held to find a solution that works for everyone.
6. Tuition must be paid monthly or weekly. If you choose the weekly payment plan you must pay Thursday or Friday
for the FOLLOWING week. Monthly payments must be paid at the beginning of the month.
7. There is a $20.00 late fee per week when and if tuition is more than ONE WEEK behind.
8. There is a $20.00 returned check fee.
9. Building Blocks does not dispense over the counter medicine without doctors permission in writing.
10. My child CANNOT RETURN to school for 24 hours after being given an antibiotic.
11. The security deposit of$ will be applied to the last week of school in June or in the event that you
withdraw from the program; the security deposit will be applied to the second week of your two-week notice.
12. Accounts two weeks in arrears may result in immediate termination of service. Upon payment, enrollment may be
reinstated with applicable paid tuition and a registration fee. I am aware that I will be responsible for the balance
of my account and any reasonable collection and attorney fees and costs associated with the collection of the
account.
