BOARD OF SELECTMEN MINUTES May 23, 2016 CALL TO ORDER: ChairmanTracy Watson called the meeting to order at 6:00 PM at the School Administration Building Meeting Room. ATTENDANCE: The following were present: Chairman Tracy Watson, Clerk Phil DeCologero, Licensing Commissioner, Richard Vaillancourt, Rosemary Smedile, Donald Stewart, Town Manager Andrew Maylor, Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. 15 members of the public were in attendance. EXECUTIVE SESSION : Richard Vaillancourt made a MOTION, seconded by Phil DeCologero that the Board of Selectmen enter into executive session for Reason No. 3 under MGL Chapter 30A, Section 21(a) to conduct strategy session with respect to litigation and strategy session with respect to collective bargaining. collective bargaining positions. Chair Watson announced that the board will reconvene in open session at the conclusion of executive session. Roll call vote. Vaillancourt-Yes, Stewart-Yes, Smedile- Yes, DeCologero-Yes, Watson-Yes Vote approved 5-0. The Board returned to open session at 7:00PM. The meeting was recorded. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, to approve the Open Session Minutes of May 10, 2016 as presented. Vote approved 5-0. COMMUNICATIONS AND ANNOUNCEMENTS: New Business Recognition-The Cleaning Authority Kwame Ofori-Asante, owner of The Cleaning Authority was recognized by the Board for opening a new business in North Andover. Annual update from Conservation Commission Chapter 7, Section 13-3 of the Town Charter requires all appointed Boards to meet with the Board of Selectmen at l begin this practice and invite the chairmen of the major boards to a Board of Selectmen meeting. Lou Napoli, chairman of the Conservation Commission, gave an update from the Conservation Commission. Annual update from Board of Health Dr. Thomas Trowbridge, chairman of the Board of Health, updated the Board about the Board of Health. Job posting/vacancy log Included in your packets is the most recent job posting/vacancy log submitted by Cathy Darby, Human Resources Director. CONSENT ITEMS: Request of Christopher Marshall of the Borderline Running Club to use streets in North Andover to conduct the 4th of July Road Race on July 4, 2016 beginning at 7:00 a.m. Christopher Marshall of the Borderline Running Club was present to request permission to hold the 4 th of July Road Races beginning at 7:00 a.m. There are three races- - that start and finish at the Common. The routes were outlined on the maps included in the packet. Richard Vaillancourt made a MOTION, seconded by Donald Stewart, that the Board of Selectmen th approve the request of the Borderline Running Club to hold the 4 of July Road Races beginning at 7:00 a.m. at the Town Common, as presented. Vote approved 5-0. Board of Selectmen Minutes May 23, 2016 2 Request of North Andover Merchants Association to use the Town Common and close a portion of Massachusetts Avenue for the Fall Festival on Saturday, September 24, 2016 from 7:00am to 5:30pm Sylvie Foulds from the North Andover Merchants Association was present to request the use of the Town Common for their annual Fall Festival on Saturday, September 24, 2016 from 7:00 a.m. to 5:30 p.m. and to close Mass Ave. from Osgood Street to Andover Street from 8:00 a.m. to 4:00 p.m. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen approve the request of the North Andover Merchants Association to use the Town Common for their Fall Festival on Saturday, September 24, 2016 from 7:00 a.m. to 5:30 p.m. and to close Massachusetts Avenue from Osgood Street to Andover Street from 8:00 a.m. to 4:00 p.m. Vote approved 5-0. Request of Diana Flahive of Neurofibromatosis Northeast to use streets in North Andover for the 6th Annual Coast to the Cure bike ride on Saturday, September 10, 2016 Included in the packet was a request from Neurofibromatosis Northeast for approval to use streets in North Andover for 6 th Annual Coast to the Cure Bike Ride on Saturday, September 10, 2016. The three routes (24, 66 or 100 miles) will all start and finish at Stage Fort Park in Gloucester. The streets in North Andover that are on the route are: Salem, Ingalls, Forest, Boxford, Foster, Winter and Dale. All relevant Town Departments recommend approval. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen approve the request of Neurofibromatosis Northeast, to use streets in North Andover th for the 6 Annual Coast to the Cure Bike Ride on September 10, 2016. Vote approved 5-0. Request Main Street for a church picnic on Sunday, September 11, 2016 from 12:00pm to 5:00pm was present to request permission Sunday, September 11, 2016 from noon until 5:00 p.m. for their annual picnic. All relevant departments have reviewed the request and have no issues. The Police Department recommends a detail be hired to monitor vehicle and pedestrian traffic. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen approve the request of Saint Gregory Armenian Apostolic Church to close a portion of September 11, 2016 from noon to 5:00 p.m. Vote approved 5-0. Request to surplus equipment and vehicle-Fire Department Included in the packet was a request from Fire Chief William McCarthy to surplus a 2002 Ford F-550 brush truck, 12 AEDs and 2 stretchers. All will be traded in for credit toward a new ambulance, new AEDs and a new stretcher. Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen approve the request of Fire Chief William McCarthy to surplus a 2002 Ford F-550 brush truck, 12 AEDs and 2 stretchers, as presented. Vote approved 5-0. Request to surplus material-DPW Included in the packet was a request from Bruce Thibodeau, Director of DPW, to surplus materials at the DPW yard that are of no use to the Town. Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen approve the request of DPW Director, Bruce Thibodeau, to surplus materials at DPW yard, as presented. Vote approved 5-0. reel carts Stan Limpert was present on behalf of the North Andover Historical Society and asked the board to accept a donation of Society requests return of these items if and when the town is no longer interested in keeping them. Rosemary Smedile made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen accept the donation of a lion hand pump fire engine and two hose reel carts from the North Andover Historical Society. Vote approved 5-0. Board of Selectmen Minutes May 23, 2016 3 Request for qualifications for legal services Included in the packet was a memorandum from Chairman Watson regarding the appointment of Special Town Counsel. Assistant Town Manager, Ray Santilli, explained the process for issuing the Request for Qualifications. Richard Vaillancourt made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen direct the Town Manager to issue a Request for Qualifications for legal services. Vote approved 5- 0. Appointment of Special Town Counsel for cable license renewal process with Verizon New England Included in the packet was a scope of services from Attorney William H. Solomon to provide legal services to the Town for the cable license renewal process with Verizon New England. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen appoint William H. Solomon as Special Town Counsel to handle the license renewal process with Verizon New England. Vote approved 5-0. Affordable housing unit resale-3 Harvest Drive, Unit 211 (Oakridge Village-Maplewood Reserve) The Citi housing unit at 3 Harvest Drive, Unit 211 (Oakridge Village-Maplewood Reserve) is up for sale. It is recommended the Board not exercise its right of first refusal. Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen decline the right of first refusal to purchase the affordable housing unit at 3 Harvest Drive, Unit 211 (Oakridge Village-Maplewood Reserve). Vote approved 5-0. Accept donation in the amount of $200 from Cheryl Phillips to Veterans Services May 29, 2016. Phil DeCologero made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen accept the donation in the amount of $200 from Cheryl Phillips to Veterans Services to be used for Vote approved 5-0. National Grid Amendment to Easement Deed- Included in the packet wa needs to install a pole at the Pump Station for the guy wire that is currently connected to the stump of a tree and not a pole. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen sign the Amendment to Easement Deed from National Grid for 1653 Great Pond Road, as presented. Vote approved 5-0. PUBLIC HEARING: National Grid Conduit Petition-Andrew Circle Chris Wellington from National Grid presented the petition to the Board to install underground electrical conduits for Andrew Circle. Richard Vaillancourt made a MOTION, seconded by Donald Stewart, to open a public hearing for National Grid Petition #20863798-Andrew Circle. Vote approved 5-0. Denise Desmond of 18 Andrew Circle asked about secondary cables and wanted to make sure the damage to the landscaping would be repaired. Mr. Wellington indicated any landscaping damage would be repaired by National Grid. Town Manager, Andrew Maylor, confirmed with Mr. Wellington that any damage to the subsurface utility lines or cracking to the roadway will be repaired by National Grid. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to close a public hearing for National Grid Petition #20863798-Andrew Circle. Vote approved 5-0. Rosemary Smedile made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen approve the conduit petition #20863798-Andrew Circle with conditions as set forth in the letter dated April 27, 2016 from the Department of Public Works. Vote approved 5-0. Board of Selectmen Minutes May 23, 2016 4 LICENSING COMMISSIONERS: Donald Stewart made a MOTION, seconded by Rosemary Smedile, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Request of Gregg Gregg Ryan was present to request a Mobile Food Truck license truck would be parked in his parking lot so he would be able to serve his customers while the restaurant is being renovated. Tracy Watson made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen, acting Vote approved 5-0. Request of Ashley Piazza of Smolak Farms to extend hours of Entertainment License from 10pm to 11pm on Saturday, July 30, 2016 and Friday, October 7, 2016 Michael Smolak was present to request an extension of hours for two specific nights. Donald Stewart made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Smolak Farms to extend hours of their entertainment license from 10pm-11pm on Saturday, July 30, 2016 and Friday, October 7, 2016. Vote approved 5-0. Request of Ankit Patel of Den Rock Wine & Spirits for an Entertainment License Phil DeCologero made a MOTION, seconded by Donald Stewart, that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Den Rock Wine & Spirits for an entertainment license. Vote approved 5-0. Vote approved 5-0. Rosemary Smedile made a MOTION, seconded by Donald Stewart, to close a meeting of the North Andover Licensing Commission. Vote approved 5-0. OLD BUSINESS: None NEW BUSINESS: None PUBLIC COMMENT: None TOWN MANAGER The Town Manager announced that representatives from the town spent five hours with the bond rating agency staff explaining why North Andover deserves an AAA rating.
