Site Plan Special Permit Application
Dear Sirs:
Enclosed are 10 copies of site plans and an application for a site plan special permit for
the above referenced property. Also enclosed are the required stamps and application fee.
A review fee has not been enclosed. At the last meeting the Board indicated that a special
permit application should be made to give the neighbors a chance to review and comment
upon the proposal, however the process should be simple. I have interpreted this to mean
that a full review by the boards consultant would be waived and that waiver is hereby
requested.
I will be at your first meeting in January to discuss this matter.

I have reviewed the site plan for the referred location and have the following coimnents:
1. The site is located in the B-4 district and the proposed office use is allowed,
2. The site is non-conforming in the district having 14,104 square feet of area and street frontage of 135.01
feet. All work to be performed on the site will require a Special Pernut,and as necessary,Variances from the
Zoning Board of Appeals(ZBA).
3. A variance is required for the 23 feet driveway width at the street property line as the zoning by-law requires
a 25 feet driveway width,
4. The site plan does not indicate any Handi-Cap Parking.
5, The applicant must use caution not to drain driveway surface water onto the State Highway,
6, The site plan indicates two(2)proposed ground signs. Pursuant to Section 6,6,Paragraph D"No lot shall
be allowed to have more than one(1)ground structure". The applicant will have to submit a sign
application to the Zoning Enforcement Officer for compliance to the Sign By-law.
7, The Commonwealth of Massachusetts 1988 Transportation Bond Issue(copy enclosed)states in part"that a
permit is required for a change in use for an existing curb cut for developments which generate a substantial
increase in or impact on traffic". I am of the opinion that there will be a substantial impact on the traffic
circulation at the intersection of Peters Street(Route 133)and Turnpike Street(Route 125)with access and
egress of a seven(7)vehicle parking area. I am also of the opinion that the ZBA and the Building
Department will not issue permits without evidence that the Commonwealth Of Massachusetts has been
consulted and is in agreement of the site compliance with the above.

Dear Mr. Stocking:
The 1988 Transportation Bond Issue contained a section which clarifies and strengthens
the Massachusetts Department of Public Works Curb Cut Statute.
Perhaps the most important change made by the 1988 Amendment is to clarify that a '

This request has become necessary since many developers have performed work without
obtaining the proper permits.
I am also requesting that yaur planning board make the developers aware of this curb
cut policy.

The following application is to allow the conversion of an existing residential dwelling to an office. The existing
building is 1500 SF and will not be altered. Currently there are two parking spaces and a garage. The garage is to
be razed and additional parking added. My review is as follows:
i.NORTH ARROW/LOCATION MAP: This has been provided.
ii. SURVEY OF LOT/PARCEL: This has been provided.
iii.NAME/DESCRIPTION OF PROJECT: This has been provided.
iv.EASEMENTS/LEGAL CONDITIONS: An existing easement is depicted on the plan.
v. TOPOGRAPHY: This has been provided in spot grading.
vi.ZONING INFORMATION: The lot is located within the B-4 Zoning District and has a lot area of 14,104 SF.
The proposed use is allowed within the B-4 zoning district. Please see Robert Nicetta,Building Commissioner
memo dated January 4,2002 for more detailed information.
vii. STORMWATER DRAINAGE:The drainage pattern will remain the same and flow from the rear of the parking
lot onto Peters Street.
viii.BUILDING LOCATION: The building is an existing building with 27' of frontage.
ix.BUILDING ELEVATION: Elevation plans have not been provided but the existing dwelling will not be
altered and is 30' in height,
x.LOCATION OF PARKING/WALKWAYS: Seven parking spaces are proposed with an existing
entrance/egress of 23'. Handicapped parking needs to be provided with access to the building.
xi.LOCATION OF WETLANDS/NOTICE OF INTENT: This has not been provided.
xii.LOCATION OF WALLS/SIGNS: Two signs are proposed outside of the easements area. Section 6.6d2 of
the Zoning Bylaw allows for only one permanent ground sign.

xiii.LOCATION OF ROADWAY/DRIVES: This has been provided. The Zoning Bylaw allows for the
driveway to be 25', the existing driveway is 23' a variance would be required. If a curb cut is required for 25' a
Mass Highway Permit should be obtained.
xiv. OUTDOOR STORAGE/DISPLAY AREAS: No outdoor storage is proposed. The office use will not
require outdoor storage.
xv.LANDSCAPING PLAN: The site is fully landscaped,no existing trees or shrubs are to be removed.
Additional 2'/z'Maple trees are proposed for the two small islands. All disturbed areas will be loamed and seeded.
xvi.REFUSE AREAS: No refuse area is proposed due to the proposed use of the building,refuse will occur
weekly with the standard curbside pick up.
xvii.LIGHTING FACILITIES: One parking lot light is proposed with additional lighting being provided by the
existing wall lights at the entrance. Information of hours of operation should be provided to ensure that the lighting
will not affect the abutting residential property.
xviii.DRAINAGE SYSTEM: No drainage system is proposed.
xix. TRAFFIC IMPACT SYSTEM:A traffic impact study has not been provided. A waiver request should be
submitted.
xx. COMMONWEALTH REVIEW: The applicant needs to apply to the Mass High Department because of
the close proximity to Route 114.
xxi. UTILITIES: The site has existing utilities.
xxii. FISCAL IMPACT: A study has not been provided,a waiver should be requested.
xxiii. COMMUNITY IMPACT: A study has not been provided,a waiver should be requested.

This letter is written in response to your submittal of a plan with a permit application for
the subject project. The District Permits Engineer has reviewed your submittal and determined
that Route 133 is not State Highway at this location. Therefore, a permit from the Massachusetts
Highway Department (MassHighway) will not be required.
