Concept S-7
I have reviewed Concept S-7 for the property located at 701 Salem Street note the following
zoning violations:
• Scction 8.1(7) requires that off street parking be accessible over unobstructed driveways of
not less than 25' wide. 25' driveways have not been provided for all areas of the site.
• Section 8.4 requires the following:
• for all off-street parking lots with more than 6 parking spaces or which abut a
residential neighborhood, a 6 foot wide strip with trees or shrubs densely planted to
create an impervious screen at least 4 feet high at the time of planting must be planted.
This has not been provided on site however it is provided in the fifty foot ROW of
both Salem and Abbott
• for all off-street parking lots with 20 or more parking spaces, there shall be one tree
for every 30 linear feet planted on at least three sides
• Table 2 requires a side and front setback of 25'. The building violates this requirement on the
Abbott Street side.

Subject: Strip mall on Salem St, at Abbott St,
It is the understanding of this Department that there are plans to develop a strip mall on Salem Sreet
at Abbott Street. Although this Department is not opposed to this development we do feel strongly
that such an undertaking would add sufficient motor vehicle and pedestrian traffic to the area and
public safety improvements should be included in the developers plans to accomodate this
anticipated increase in traffic flow. Specifically the police department has concerns based on;
1. Salem Street which is a extremely busy road with commuter traffic.
2. Abbott Street at Salem Street acts as a gateway to the Sargent School increasing traffic flow
to that area.
3 Safety improvements that include granite curbing and sidewalks should be constructed in the
area of the proposed mall due to pedestrian traffic, especially, school children.
a. Granite curbing allows vehicles to be deflected away from walkers
b. Granite curbing holds up to snow plows and other abuses
4. A blinking yellow light should be installed at Salem and Abbott Streets to help slow traffic
and alert motorists to the presence of the mall, pedestrians and exiting vehicles.
A traffic study should be completed to assess to impact of the mall on this area. I would like an
opportunity to be heard on these issues at the next meeting in which this proposal is discussed.

The Planning Board will continue its discussion of the proposed project located at 701 Salem
Street on September 3. In order for the Town Staff to make recommendations to the Planning
Board, all revised plans and documents must be submitted to the Planning Office by noon on
Thursday. The Planning Board will not review plans at their meeting that have not already been
reviewed by the Staff I would also like to remind you that the revised plans must be sent to out
our drainage consultant, John Chessia, at Coler& Colantonio.

Dear Mr. Sullivan:
The applicant and his architech have appeared before the North Andover
Planning Board numerous times in the past few months for approval of plans
for a small shopping center at the above-cited address. They've been highly
responsive to the board's concerns and requirements. They've made many
changes to their original plans, mostly at our request, and now have a
project which the board thinks would be an asset to the conmunity.
Therefore, the planning board wishes to endorse the applicant's request
for a variance. Any violation of zoning setbacks would be minor, at best.
Also, given the location and the shape of the lot, a variance would
certainly be in accord with the statutory requirements.

Dear Mr. Xenakis,
I received your message today regarding the submission of drainage calculations. The
management of storm water is an important part of the overall site plan. The Planning Board must
be assured that the storm water will be controlled such that there is no increase in the rate or
amount of runoff from the site onto adjacent properties and streets. This is not something that can
be dealt with as a condition in the site plan review decision.
The review of storm water drainage has been an issue from the start of this application process.
Our consultant reviewed the original p?gin- n June however he has not yet received a response. I
have continually reminded you via phone, letter and personal conversation that the drainage
review was very important to the overall process and that information to our consultant must be
submitted as soon as possible.
Our consultant needs approximately two weeks in order to review and comment on drainage
calculations and designs. At this point it is doubtful that he could respond in a timely fashion for
the November 19`h meeting. The Town Staff must also review the final plans for issues of traffic,
landscaping, lighting, utility connections, etc. prior to the close of the public hearing by the
Planning Board.
If the plans are submitted by the end of this week, I will request review by the Town Staff in time
for the November 19"'meeting. If I do not receive the plans by the end of the week, I suggest
that you request a continuance of the public hearing to the December 3 meeting. I have attached

Please be advised that Section 6.6(3) of the Sign By-Law allows one (1) sign
oriented to each street on which the premises has access, either attached or
ground, pertaining to an apartment development or a permitted non-residential
principal use of the premises, such sign not to exceed ten (10) square feet in
area. As such, the building is allowed one (1) sign pursuant to Section 6.6(D)
(1) and two (2) additional because of access from Main and Park Streets for a
total of three (3) building signs.
The Applicant has agreed to re-configure the parking (spaces numbered 1-9, 18,
25, 28) in order to eliminate the spaces extending into the right-of-way and, if
necessary, request a variance of the 25 ft. wide driveway.

Please be advised that the site plan submitted for review did not include a
"restaurant" and the applicant stated a video, cleaner, convenience store,
delicatessen and a bank as occupants. The applicant never intended to have a
"restaurant" and the parking was estimated accordingly.

Dear Ms. Colwell:
The following final items of concern are addressed relative to the Conditions of Approval issued
for this site.
1. DRAINAGE
Refer to a letter from Mr. Hmuricak regarding the existing drainage system on Salem
Street being of adequate capacity to handle the outflow from the detention basin,
which will mitigate any increase in runoff due to the site development.
2. SITE WORK
Refer to the site plan for the proposed sidewalk, which has been expanded or
extended to the property line of the abutter(Campolini) on Abbott Street, and will
now be built constructed along the entire frontage of the site, exclusive of the two
driveway openings.
A note on the plan regarding "the existing trees within 10' of the property line to
remain" has been removed, as these trees have been recently removed. They will be
replaced with a fence and a uniformly spaced row of pine trees along the property
line common to the abutters, as indicated on the plans.
The plan has been revised to indicate a"Not an Exit" sign (access only) at the
driveway entrance on Abbott Street. There will be painted arrows at the entrance
and at the travel lanes and passing lanes at the drive-up teller, as indicated on the
plans.
The landscaping plan has been revised previously to address the concern about
visibility in vicinity of the passing lane, which should adequately address this
concern.

The following is our response regarding a white picket fence along the property frontage. Given
that there were variances granted which greatly minimize the setback between the property line
and pavement, a fence may not be best recommended or advised to be installed along the
property line, citing visual restrictions and potential damage by vehicles as likely detractions. As
such, this item may best be waived from the Conditions of Approval, or modified in some manner
to allow some other aesthetic treatment, in addition to the proposed vegetative landscaping, to
enhance the "curb appeal" of the site.

Attached you will find two memos dated 7-23-96 and 9-6-96 concerning the proposed strip
mall at 701 Salem Street. This Department still has grave concerns over this project because
it is designed to be a high volume business which is located within residential areas and the
Sargent School.
It appears that many of the recommendations offered were not used. It was also made
extremely clear that this Department had strong feelings concerning these public safety
issues and requested an opportunity to discuss these concerns at open meeting. On
September 3, 1996 Officer Driscoll presented the Department's concerns. Somewhere
between September 3” and December 17, 1996 a decision was made by the Planning Board
that the lights were excessive. Once again, I would like to point to the September 6, 1996
memo from the Department which demonstrates the strong concern the Department has
with the safety of motor vehicle traffic and children in the area. For instance,the lights were
an important issue. Trucks and other vehicles in "no parking" areas that block the view
cannot be ticketed consistently as it would require continual monitoring. A yellow light
would have slowed vehicles and would be consistent with the lights that were installed on
Johnson Street at the school. The lights could also have been on timers to expedite the
movement of traffic when the mall was closed. Surely, for the amount of time that the
Planning Board discussed this project, more opportunity could have been provided for
police input.
I hope that in the future, this Department, is afforded a more active role when we have
rigorously expressed such serious concern over a project prior to the Planning Board
finalizing a project. Please feel free to call my office to discuss this matter further.

Per our discussion on 9-5-96 I would like to clarify several points
from my 7-23-96 memo. Sidewalks should be installed on both Salem
Street and Abbott Street . It is important to do this now before the
land in made unavailable because of parking allocations .
The installation of the blinking yellow light is a critical visual
to the effective control of traffic in an area that will have
significant increases of vehicle and pedestrian traffic .
As per our discussion, a deceleration lane on Salem Street leading
into the Mall is appropriate and a definite traffic safety
addition. The intersection of Salem Street and Abbott Street should
be squared off to clearly delineate and structure traffic patterns
replacing the informal, haphazard pattern that now exists .
Due to traffic safety issues I must vehemently oppose a drive-up
coffee window. This proposal will back traffic onto Abbott Street
causing impediments to vehicular traffic which will be forced to
enter the oncoming lane and to school pedestrian traffic which will
make walking school children not only difficult to see but will
force them to move between vehicles waiting to patronize the coffee
window.
I will certainly make myself available to address these issues in
person.

Re: 701 Salem Street - Site Plan Review
Thank you for your memo of January 27, 1997 outlining your concerns regarding the Planning
Board's review of the 701 Salem Street project. I would like to point out that the application for
this project was submitted on May 1, 1996 and the plans were submitted to your Department on
that date. The TRC for the project was held on May 23, 1997. However the Planning
Department did not receive comments from your Department until July 23, 1996 after the
Planning Board had held five public hearings. I then met with Officer Driscoll at the end of
August and discussed the need for sidewalks on Salem and Abbott Streets, restricting the access
on Abbott Street to entrance only with appropriate signage, and a flashing yellow light at the
entrance to the site on Salem Street. The Planning Board required all of the items except for the
flashing yellow light which the Board felt was excessive for a retail complex of this size. I did not
receive your memo of September 6, 1996 addressed to William Scott, Director of Community
Development and Services.
The issue of the drive-up window has been addressed by both the Zoning Board of Appeals and
the Planning Board. Any change of use from a bank drive-up window will have to come before
both boards for review. Due to the lack of queuing space, I doubt the Planning Board would
approve such a change.
The Planning Board and Department are interested in your comments on all plans. The Technical
Review Committee was set up to facilitate such communication. The last time we had
representation from the Police Department was in June. Although it is helpful to have a
representative from the E911 program, he cannot address all of the public safety issues under the
purview of the Police Department. It would be helpful to the overall review process if you would
send a representative to those meetings to discuss your Department's concerns.

The Planning Board has several large projects under review at this time that may have significant
impacts on traffic safety on both Rt. 125 and Rt. 114. The Planning Board would particularly
appreciate your timely comments on both the 200 Chickering Road (Rennes) site plan review
application and the Forest View Estates (100 lots) definitive subdivision plan.

Dear Mr. Mahoney:
The Division of Public Works has reviewed the issue of the Salem Street drainage
system capacity and the systems ability to convey the post development storm water run
off from the 701 Salem Street site.
The existing drainage system discharges into Mosquito Brook at a headwall on the
north side of Salem Street adjacent to the culverts which convey the brook under the road.
The invert elevation of the 18 inch pipe at the discharge point is 140.21. The pipe
extends up Salem Street approximately 440 feet to the manhole at the intersection of
Abbott Street into which the drainage system from the 701 Salem Street site is connected
at an approximate elevation of 146.50.
There is no historical record of flooding problems along this section of Salem
Street. There we no observed problems with the drainage system during the October 20,
1996 rain event at a time when the flow in Mosquito Brook was almost over topping
Salem Street.
We feel that the drainage system in Salem Street has sufficient capacity to convey
the proposed flows from the site and we will permit the connection.

Notes: I met with Matthew Xenakis yesterday to discuss the final resolution of issues at 701
Salem Street. I have an as-built plan from Merrimack Engineering that has questionable accuracy
however it may be accurate enough for our purposes. Mathew would like to put a wooden guard
rail around the site instead of a picket fence. There is not sufficient room on the site between the
parking lot and the sidewalk to fit a picket fence safely. I will be bringing this issue before the
Board on Nov. 17 however Mathew would like to put a guard rail around the detention pond now
before the winter season sets in. In my opinion a guard rail is necessary to prevent cars from
slipping into the pond both from the roadway and the parking lot. A picket fence would not work
in this location as it would block the view for cars from Abbott Street to Salem Street and would
not provide sufficient support to a car sliding off the road. I would like your opinion on this and
would like to tell Mathew to go ahead and put up the guard rail in this location only. See the

I have discussed with Richard Rowen, Chairman of the Planning Board your request to place a
wooden guardrail around the detention pond at 701 Salem Street. We have determined that it
would be appropriate for you to install the guardrail in this location as the current situation
presents a safety hazard for cars traveling on Abbott Street and Salem Street and for cars parked
in the parking lot.
The guard rail must be installed as shown on the attached plan and described as follows:
The fence must begin an appropriate distance from the existing hydrant on Salem Street
and extend for one length. An appropriate species of evergreen must then be planted and
another length of guardrail etc. extending to the point where the parking lot touches the
edge of the property line on Abbott Street. A guardrail without shrubs must then be
installed along the edge of the seven parking spaces.
This work should begin as soon as possible so that it can be completed prior to the winter

I am writing to follow up on our conservation last week concerning the status of your project located at 701 Salem
Street. In order for you to receive a Certificate of Occupancy the following items per your approval must be
completed:
• Submit a letter from the architect and engineer of the project stating that the building,signs, landscaping,
lighting and site layout substantially comply with the decision and plans approved by the Board.
• The Town Planner must review all lighting
• Fire sprinklers must be installed
In order for you to receive your bond money the following items must be completed:
• The Town Planner must review the site-any additional screening deemed reasonably necessary must be
added.
• A final as-built plan must be submitted.
As we discussed,you would like to alter the plan by removing the canopy and adding an ATM machine. I have
placed this request on the December 2, 1997 Planing Board agenda for discussion. At that meeting you or your
representative must make a brief presentation to the Planning Board outlining the proposed changes and the
reasons for the change.

I have reviewed the site, the site plan review approval issued by the Planning Board, the letters
submitted to the Planing Office from Robert C. Daley, P.E., Merrimack Engineering and John M.
Daly, Project Architect. Prior to my authorizing the issuance of a Certificate of Occupancy based
on the Planning Board approval the following items must be completed:
• The traffic signs as required by the decision and plan must be installed.
• The roof gutters and down spouts must be in place and connected to the drainage system.

A field inspection was made last month on the above listed site. I found with actual
measurements made in the field, that the horizontal distance from the building to the top
of the curb is seventeen (17) feet. This measurement was taken from the closet point of
the building to the curbing.
This distance requirement is shown on "Site Plan of Land"...at 701 Salem Street. Dated
December 16, 1998. The distance requirement is shown from curb to curb. However, the
inside curb was not built and the distance I measured is building to top of curb. Please
see attached copies for details. I hope this information assists you.

To Whoin It May Concern:
We are Kevin and Janice Spicer and live at 677 Salem Street, North Anoover. We are presently
out of the country on vacation but would like to voice our opinion regarding the J&M Country
Stores Plaza, Located on Salem Street in North Andover.
It is of our personal opinion that the idea of installing a fence and/or Guard Rails directly in front
Of J&M Country Stores would pose more of a hinderance to pedestrians as well as drivers.
If a fence was installed in front of JA M's Plaza and was connected to the fence runnning
alongside the property this would box the store in and therefore would make it only accessible to
pedestrians by using the paths designated for cars entering and exiting the plaza, which could
prove to be dangerous. Presently pedestrians can gain access into the plaza easily. A Guard
Rail and/or a fence would prohibit this from happening. We would not feel comfortable having
our children walk to a store; where they can only gain access by using a designated entry way for
cars.
We also believe that a fence and/or guard rails installed on Salem Street would block the view
of drivers who are exiting the plaza,
We like the idea of looking down Salem Street and seeing no boundaries this would make the
store stick out more instead of blending in which is we feel is important. J & M has been more
than considerate in his plans for his plaza with the neighborhood since day one i.e.,keeping the
neighborhood informed of his plans for the development, even down to the color scheme. We
appreciate their consideration in keeping the neigborhood eye pleasing but having a successful
business located within it. They have accomplished this remarkably and we believe that if this
was truly a necessity for safety reasons it would be done, no question in our minds In actuality it
would also make the sidewalk more narrow which is unnecessary, we believe.
We like the idea that the store blends in well with the surrounding houses. Being the parents of
two small children who do frequent this plaza, we would never make this stance if we thought
for safety reasons that a fence would be of any help. In fact we believe that a fence and/or Guard
Rails would add safety concerns regarding the pedestrians gaining access to the plaza and also
possible obstruction of view for drivers.
Actually we have to say that we opposed to aGuard.Rail and/or a fence being installed oil Salem
Street in front of J&M Country Stores- this Guard Rail and/or fence we feel would hinder safety
and would also not fit in asthetically with the natural road of Salem Street.

1. You must submit to the Board a proposal for the section of your property between the
parking lot and the sidewalk along Salem Street. The Board suggests a fence or landscaping
which will soften the overall appearance of the building.
2. The driveway at the entrance to Salem Street must be flared out slightly to create a better
turning radius for the cars entering and exiting the site.
3. Landscaping must be added to the parking area at the entrance to Salem Street.
4. The stop sign at the entrance to the site on Abbott Street must be removed, as this is an
entrance only.
5. The dumpster must be enclosed and must not remove any parking spaces.
6. A guardrail and shrubs will be installed around the detention pond as previously discussed in
my letter of November 2, 1998.
7. The Abbott Street side of the property does not need any additional work.

Reference is made to your letter to Mr,Mathew Xenakis dated November 18, 1998.
Relative to Item I we propose to construct precast concrete curbs inside the parking
area to prevent j cars from Prot- -ding over the side walk. The neighbors would not
like a fence and landscaping would take away excessive square footage.

Prior Minutes:Richard made some corrections they are in the box.
New Minutes :The minutes will be typed by the stenographer.I used a tape recorder. You will need to
listen to the tape and insert the names ofpeople speaking. She will have the minutes today.
Heritage Estates:The planning board did not like the slopes. They are planning a site visit for Saturday
October 16d'at 8:30 am on site. Post the site visit as a ineeting at least two days in advance. At the end of
the meeting they discussed the possibility of a PRD.
Form A: I forgot to file the decision. However the applicant provided a letter extended the review until
October 19d'. I would recommend that the applicant withdraw the plan without the loss of fees until they
get the special permit. File the applicants letter with the Town Clerk.
Ben Farnum: The board discussed the possibility of the special permit in perpetuity or Master Plan special
permit,as per my memo.They seemed to like the idea.The attorney for AT&T indicated that they will
provide us with an example from another community. Call Tom Urbeleis and ask if he can track down the
information from the AT& Tattorney. They did not close with any significant motion,

Site Plait Review waiver: They waived site plan review. Someone needs to do a zoning review to make
sure that they comply with zoning and determine the capacity based on available parking. Write a decision
for the waiver with the zoning review information.
1160 Great Pond Road Brooks: They liked the plan. They continued the plan until the following
information was presented:Further drainage modeling,lighting plan, landscape plan.
492 Sutton Street: Storage facility: They liked the plan so much that they closed the hearing. They are
expecting to work out the details before the next meeting on October 19d.In told Phil C to make an
appointment with you as soon as possible and get you the revised plans. The Board is anticipating a
written decision by the next meeting October 19"'.
475 Dale Street:The applicant showed up and told the Board that he sent a letter requesting another
extension. I could not find the letter,it might be in your mail. If the letter is not available call him for a

1270 Turnpike: He sent in a letter and they accepted the postponement.
