2. Developments Which Require Site Plan Review
a) Site Plan iorequired when:

6> The following deve|opmonKa)are exempt from Site Plan Review:
i> Single family dvvoUiog(m)and two family dwelling(s);
ii) Small structures or additions which donot exceed two thousand (%,O00) square feet nf gross floor
area and dn not require five(5)oc more parking spaces.
iii) Routine repairs and maintenance that do not exceed the provisions of Section(1)(c).
o} Waiver nf Site Plan Review
8 When in the opinion of the Planning Board, the alteration or reconstruction of an existing
structure or new use or change in use will not have u significant impact both within the site and in
relation to adjacent properties and streets; on pcdcabinu and vehicular traffic; public services and
inkmmtnucturo; environmental, unique and historic resources; abutting properties; and community
needs,the Planning Board may determine, without a public hearing,that submission of a site plan
review application h not required.
iD The applicant must request u waiver from Site Plan Review in writing and may be required to
submit supporting documentation that Site Plan Review is not required. The waiver request will
be discussed a1u regular session ofthe Planning Board.

Hi Justin:
I found the email I sent previously on 701 Salem Street and the condition in the decision which stated that:
"Sufficient parking does not currently exist for a restaurant. The parking calculations are based upon retail
and office space and a delicatessen. Any changes to these proposed uses must come back before the
Planning Board for review and may require a modification to the site plan review.".
I think what you will need to clarify from Bob is if there is a difference in the required parking calculations
for"restaurant" and "take-out restaurant" [with no tables]. I ask that Bob submit a memorandum to you
and present it to the board at the meeting that night explaining if such a difference exists.

Felipe et al,
I have copies of Mr.Xenakis' brief letter that I will distribute to you tonight as well as a copy of condition 5 of
the decision, which I copied for in the annotated agenda.
The approved plans contained the following parking calculations: 5 spaces(5400sf)/1000sf=26 + 14 spaces for
the deli and bank for a total of 41 spaces.
42 spaces were provided consisting of 25 standard spaces, 15 compact spaces, and 2 handicap spaces.
Per the Building Commissioner,the proposed pizza parlor will need 15 spaces/1000sf. Therefore the
parking calculations would be require a total of 51 spaces:
14 spaces for the deli and bank
5 spaces(4400sf)/1000sf=22 spaces
15 spaces(1000sf)/1000sf=15 spaces
The site is short 9 spaces that would be required. The position outlined in the letter is that a pizza store will be
busiest during the evening hours, when the other businesses are closed or slow and will therefore not have a
significant impact on other property. They are not proposing to add trash receptacles, change the lighting, or add
any new parking.

Re: 701-707 Salem Street, North Andover, MA
As the owners of the J&M Country Stores at the property above, we request a waiver of
site plan review for the change in use at the property based on the following facts:
- All employees of the plaza will park in the rear parking lot.
- All delivery trucks belonging to the pizza shop will park in the rear parking lot.
- All delivers to the plaza will be made to the rear of the stores.
- There will not be seating inside the pizza shop.
- The pizza shops hours will be approximately from 11:00 am to 9:00 pm.
- No additional dumpsters will be required for this occupant.
- No additional lighting will be required for this occupant.
We feel that a waiver is appropriate based upon the above conditions. In addition there is
no significant impact to traffic flow and the surrounding neighborhood. The addition of a
pizza shop will further enhance the services provided to the community.

My name is Paul Ciesielski, I am the homeowner living at 740 Salem Street, directly
across the street from J&M. Mathew Xenakis has informed me that he may be putting a
Pizza Shop into the property at 701-707 Salem Street. I appreciated Mathew making me
aware of his intentions, as he has always been a very courteous neighbor.
Mathew and his family run a quality,respectable business. I have found them to be
respectable to their customers as well as their neighbors living in close approximation to
their store.
I believe the Pizza Shop would be a welcome addition to the area.
