Dear Mr. Ea,
Upon inspection of your property located at 163 Turnpike Street it was brought to my
attention by the Planning Board that they are not pleased with the way you have let the
grounds on your property run down.
Please by advised that you are required to maintain the grounds in an appropriate manner,
by cutting the grass on a regular basis, Your property detracts from the surrounding
property in the area.
Please take action to rectify this situation and maintain your lawn in an appropriate
manner.
It has also been brought to my attention that you have neglected to record your Site Plan
Special Permit decision at the Registry of Deeds. I urge you to get the decision recorded
as it is an important part of the application process.

Subject: 163 Turnpike Street—Site Plan Special Permit
Planning Board Members;
This application is made to the North Andover Planning Board to allow the creation of 8 parking spaces for a
mixed use property at 163 Turnpike Street. The applicant has received approval from the Zoning Board of
Appeals to convert the existing building into first floor office space and a second floor residential unit per
ZBA case#2006-016. The property is located in a R-4 zoning district at the intersection of Turnpike Street
and Peters Street and consists of 18,238 square feet of land area. The owner, Seng Ea,purchased the property
a little over a year ago and is in the process of making major improvements to the interior and exterior of the
building.
The proposed site development will consist of a paved parking area with vehicular access off of Peters Street
utilizing the existing curb cut. Eight parking spaces will be provided,with one space being designated for
handicap parking. A handicap access ramp is proposed to provide access from the parking lot to the structure.
A crushed stone trench is proposed along a portion of the pavement area to capture storm water runoff from
the paved surface. A total of 7 evergreen trees will be planted as a landscaped buffer along the northerly
boundary line. An existing 6' high stockade fence runs along the westerly boundary line.
The applicant is requesting the following waivers from the Planning Board:
1) A waiver from a traffic impact study.
This project will generate minimal vehicular trips per day and will have no measurable impact on
the existing level of service of Peters Street.
2) A waiver from a storm water analysis and design.
This project will produce a limited increase in impervious coverage and insignificant grading
changes for the construction of the parking area. A 3' x 3' crushed stone trench will provide for
the capture and storage of the majority of storm water runoff associated with the parking lot. It
should be noted that storm water runoff will not be introduced to Peters Street or Turnpike Street.
The applicant also requests a waiver from the consultant fee for this project. Please find attached the
completed Site Plan application and certified abuttors lists for this project.

Re: review 163 Turnpike St. site plan by Sullivan Engineering dated June 28, 2006
As the design engineer knows, the DPW Engineering Dept. is extremely understaffed and our
review is limited to town road issues and not the site as a whole. This is made difficult by not having
traffic and hydrology information provided. I offer the following comments about the site as proposed:
I. The driveway entrance would be safer if located further from the intersection of Peters St. and
Rte 114.
2. The negative pitch of the drive off Peters St. is an essential component of the design. A
condition of occupancy should be compliance with grades as shown on the design plan.
3. A stop sign should be installed at the drive exit.

Re: Riverview Preliminary subdivision responses from Graham Associates dated June 30, 2006. I offer
the following comments about the response as presented:
1. The minimum water main size required in the town of North Andover is 8"
2. We do not recommend granting the proposed waivers in order to further develop the locus.
3. Riverview St., as it presently exists, is inadequate to handle additional dwelling units.

SUBJECT: Special Permit for 163 Turnpike Street
The Zoning Board of Appeals agrees that the appropriate section of the North Andover
Zoning Bylaw is Section 4, Paragraph 4.3. for the proposed mix use structure at 1.63
Turnpike Street, and that the applicant will need to re-apply to the Zoning Board under
that section.
Section 4.3 RESIDENTIAL,ALDAPTIVE RE-USE BYLAW
1. Intent
The residential Adaptive Re-Use Special Permit is hereby established as a Special Permit
in the Rl, R2, R3 and R4 residential districts on lots that are directly contiguous to lots in non-
residentially zoned districts established by this Bylaw.
3. Applicabilit /y Eligibility
A lot is eligible to receive a Residential Adaptive Re-Use Special Permit based on the
provisions of Section 4.3(6)of this Bylaw,only if at the time of application(and based on
the Zoning Map in effect at that time)the subject lot is:
A) within the Rl,R2,R3 and R4 districts; AND
B) is directly contiguous(i.e. directly touching and not separated by a roadway or
another parcel)to a parcel in a non-residential district(B1-B4,VC, GB, I1-3 and IS).
4. Permitted uses by Special Permit include:
A) Existing residential uses;
F) Personal service office;
G) Professional offices;
H) Business offices;
I) Medical offices;
L) Any appropriate combination as determined by the ZBA of the uses stated above.
