Special Meeting
The Planning Board held a Special Meeting on Monday evening, November 24,
1980, at the Middle School at 6:15 p.m. prior to the Special Town Meeting.
The purpose of this meeting is to make a recon~mendation to Town Meeting
concerning George Schruender's request for a zoning change on Chickering
Ro~d. The request appears as A~icle 4 on the warrant.
The public hearing was held by the Planning Board on November 17, 1980,
at which time it was voted to take under advisement.
The following members were present and voting at this Special Meeting:
William Chepulis, Chairmmu; Joseph D'Angelo, Clerk; and John J. Burke.
The vote taken tonight will have to be unanimous, because there are only
three members present.
Motion: by Mr. Burke to approve the article and give a favorable recommendation
before Town Meeting.
Reasons: By re-zoning to B-1 from R-B, the applicant is just trying to carry
on his business. The land in question abuts General Business and will not be
detrimental to the area. Also, the recommendation is being made on the basis
that Mr. Schruender will use the property for a real estate office only, even
though the Planning Board cannot bind him to this. Also, that he will put a
buffer zone in the rear to ~protect the abutters.
Second: by Mr. D'Angelo.
Vote: In favor: D'Angelo and Burke
Opposed: Chepulis
Reason: The land in question is less th~nthe required amount and it woudd
be detrimental to the established residential district surrounding the greater
part of the parcel. There have been no new reasons presented as to why this
request should be gr~nted, and zoning changes should be brought before an
Annual Town Meeting and not a Special Town Meeting. The motion, since it does
not earry a unanimous vote, is lost. Therefore, the recommendation of the
Planning Board is unfavorable.
The meeting adjourned at 7:10 p.m.
At the Special Town Meeting held the same evening, Attorney Charles Trombly
represented Mr. Schruender and asked those present to vote for the zoning ch~uge.
Mr. Robert N~scol~, 281Andover Street, spoke in opposition.
