BUILDING CONTRACT This Agreement made this�day of vq-e, by and between Boyle Construction Company, Inc. of 24 Winslow Drive,Atkinson, NH, Rockingham County(hereinafter called"Contractor") and Norman &Janet Wallace, 103 High Street,Andover, MA 01810, ( hereinafter called "Purchaser) WITNESSETH: In consideration of the mutual covenants set forth herein the parties undertake and agree as follows, to wit; RECITALS AND PURPOSES: Contractor intends to build and sell a custom home on Lot 9/10 Hillside Road, North Andover, MA and Purchaser intends to purchase said house. 2. BASIC AGREEMENT: Purchaser agrees to purchase and Contractor agrees to build and sell to Purchaser the aforementioned house for a selling price of$635,218.00. Payments will be made in accordance with Addendum C as aqreed upon by Contractor and Purchaser. A deposit of Twenty-five-thousand dollars ($25,000.00) is hereby acknowledged with the balance of the payments to be made in accordance with Addendum C. Payments are due upon presentation of invoice. It is further agreed that Purchaser will not move into the home until the construction of the home is complete and the Town of North Andover has issued an Occupancy Permit. 3. DESCRIPTION OF THE PREMISES: Said residential dwelling shall be constructed pursuant to the plans shown on (Addendum B) The said home is to be built of good and substantial materials in accordance with the drafts, plans, explanation and specifications (Addendum A) It is agreed between the parties that Addenda A and B shall be signed and executed by all parties to the Agreement. 4. TIME OF PERFORMANCE: The said home is to be completed approximately twelve (12) months after the commencement of construction. In order to maintain the construction schedule, Purchaser agrees to make selections i.e. siding color, paint colors, plumbing fixtures, etc within three (3) days of notification form Contractor. Time is of the essence. 5. PURCHASER'S INSPECTION: Contractor agrees to make the property available at all reasonable times during construction and prior to closing to the Purchaser for the purpose of conducting a building inspection. Any defect in workmanship or material shall be known to Contractor upon verbal notification and to be followed by notification within five(5) days. Contractor further agrees to promptly correct any defect in workmanship or prior to closing. 6. AFFIDAVIT: The Contractor agrees to execute at the time of completion an affidavit verifying the nonexistence of mechanics and materialmen's liens and rights, tenant rights and security interest in the property herein described 7. WARRANTY: Contractor warrants that the building structure shall be reasonably free of defects for one year from the date of closing. For additional warranty coverage refer to Addendum D 8. CONTRACT DOCUMENT: The contract documents which contain the complete contract between Contractor and Purchaser are attached hereto and made a part hereof and consists of the following; a. This Agreement, pages 1, 2 and 3 inclusive b. Addenda Nos A to inclusive; description of materials; scale plan-A", payment schedule, limited warranty, allowance schedule c. Any modifications including change order duly delivered after execution of this Agreement. However, modifications or change orders shall be mutually agreed by both the Contractor and Purchaser. the difference in price resulting from the change will be provided by the Contractor to the Purchaser prior to the implementation. The price difference will be agreed to by both Contractor and Purchaser in writing. 9. TERMS: The terms of the various coverage's of this limited warranty begin on the date on which your home is delivered to you. The date is referred to in this Limited Warranty as the "Delivery Date." WE WARRANT THAT: DRY BASEMENT: For a period of one year the basement will be free from seepage occurring during periods of NORMAL high water table or caused by springs or defects in materials or workmanship. TIGHT ROOF: For a period of one year the roof will be free from leaks around the chimney and under the shingles caused by defects in materials or workmanship. HEATING AND AIR CONDITIONING SYSTEM: For a period of one year the heating system will be capable of heating the home to a temperature of 70 degrees F at the thermostat when the temperature is 0 degrees F outside Additional adjustments to the heating system will be made for a period of one(1)year for malfunctioning controls and components. All air conditioning systems shall be warranted against defect in materials and workmanship for one(1) year. PLUMBING: For a period of one (1)year the plumbing system will be free of defects in materials or workmanship. EXTERIOR DOORS: For a period of one (1)year exterior doors will be free from warping over three eighths of an inch (%) due to defects in materials or workmanship TRENCHES: For a period of one (1)year trenches for water and sewerage will be free from cave-in due to defects in materials and workmanship / f ! 7 ASPHALT DRIVEWAYS AND WALKWAYS: For a period of one(1)year asphalt driveways and walkways will not disintegrate, heave or depress due to defects in materials or workmanship COUNTER TOPS: For a period of one(1)year countertops will not separate due to defects in materials or workmanship EXTERIOR PAINT AND/OR SIDING; For a period of one(1)year exterior painted surfaces and/or siding will be free from blistering, peeling,warping, looseness and fading due to defects in materials or workmanship INTERIOR WALLS: for a period of one(1)year interior walls will be free from cracks caused by structural failures and free from protruding nails or cracked seems due to defects in materials or workmanship. Settling cracks are considered normal and will be repaired ONCE at no charge up to six(6)months after the delivery date. DOORS, WINDOWS AND INTERIOR FINISH: For a period of one (1)year doors,windows and interior finish will be free from warping sticking or looseness caused by defects in materials or workmanship. Additionally for a period of one (1)year items which become inoperable will be exchanged. Doors sticking caused by settling is normal and for will be adjusted at no charge up to six (6) months after the delivery date. STRUCTURE: For a period of one(1)year the structural components of the building are warranted against defects in materials and workmanship. MANUFACTURERS' WARRANTY: It is the BUYER'S responsibility to obtain a Manufacturer's Warranty on all appliances at the time of purchase. CLAIMS PROCEDURE: If a defect appears which you think is covered by this Limited Warranty, you must in writing either through the United States Postal or e-mail describing the defect. All parties hereto will make themselves available at reasonable times &mutually cooperate so that we can schedule service calls appropriately.
