Special Meeting
The PLANNING BOARD held a special meeting on Monday evening, February 11, 1981
at 7:30 p.m. in the Town Office Meeting Room with the following members present
and voting: William Chepulis, Chairman; Joseph D'Angelo, Clerk; Michael P.
Roberts; and John J. Burke. Highwa~v Surveyor William Cyr and Town Planner
Susan St. Pierre were also present. The meeting w~s moved ahead because of
a holiday (Washington's Birthda~) falling on the second Me, day of the month.
Public Hearin~ - Amendments to Rules and Regulations - continued from Februa~r 2
After discussion with the Board and the members of the audience, it was agreed
to postpone the public hearing until a full Board is present.
Plans Not Rec~iring Approval
Haddow - Marblehead Street
A variauoe was granted by the Board of Appeals on February 9, 1981. The applicant
wishes to divide her property and convey two separate dwellings to two separate
daughters, thereby changing the lot line.
Motion: by Mr. Roberts tb~t the plan of land located in North Andover, M~ss.
prepared for Mary Haddow, dated January, 1981, be approved under Sub-
division Control Law Not Required.
Second: by Mr.. Burke
Vote: Unanimous in x~avor of the motion
Strobel - Middlesex Street
This plan was previously approved with the condition that more information be
submitted from the County Engineer.
The adjacent lot is now defined and Mrs. Strobel presented a plan she obtained
from the Registry of Deeds. In addition, Mr. Chepulis read a letter from the
County Engineer, dated February 6, 1981, addressed to Mr. William Cyr.

H~¥es - Chestnut Street
This plan was previously approved subject to the engineer signing the plan over
his stamp and a notation was to be plaoed on the plan showing the old and new
lot lines. Also, the Planning Board stamp is now on the plan. The corrections

and ~dditions have been m~de and Mr. Roberts signed the plan and application.

Because some members of the audience were expected at the Conservation
Commission's meeting this evening, it was agreed to take up matters on
the agenda out of order.
Lakeside - discussion with John Turtle - sil~ati.on at Stevens Pond
Mr. Tuttle stated that he has met with Mr. Cyrand members of the Conservation
Commission and ham received their ideas as to what can and should be done about
the problem.
He has cleared up the sumps to the catch basins. He has also installed about
60 hay bales and will install another 25 tomorrow.
In addition, he has agreed to file a Notice of Intent with the Con. Com.
Mr. Burke stated that he viewed the area toda~v and found no silt.
Prsliminar~ Plan Submittal - George Barke~ - set discussion date
Mr. John Callahau, the engineer, addressed the Board. The property is zoned
Industrial and is located on Route 125.
Mr. Burke suggested that this discussion be postponed because of the fact
that this is the last Planning Board meeting for Mr. Chepulis and Mr. D'Angelo.
The two members are not running for election and when the Board meets again,
there will be two new members present, and the discussion will have to be repeated.
However, Mr. Chepulis and Mr. D'Angelo expressed interest in the ~ubdivision.
The Board and Mr. Callahan viewed the plans and discussed zone lines, easements,
countour, etc. Concern was raisedabout speed on the ro~d and the width of the
entry.
The Board set the site walk for S~turday, March 14, 1981 at 9:00 a.m. Mr. D'Angelo
asked to be included as a consultant.
The discussion date was set for Narch 16, 198~ and the name of the subdivision
is to be Commerce P~rk of North Andover.
Willows Industrial Park - release
The clerk read a letter from Hutchins and Wheeler, attorneys for the buyer of
Lot D at the industrial park. They are requesting a release of Lot D. There
is some confusion as to whether the lot was ever released. The Board reviewed
the release from the file and other documents.
Motion: by Mr. Burke to release Lot D on Willows Industrial Park from the
covenant.

Monteiro Na~v - verification o.f str.eet name
There has been confusion about the name of the street. Mr. Cyr said he favors
Monteiro Way as the new name of the street located in the Rocky Ridge Subdivision.

In further discussion, ~usan reminded the Board that they agreed to adopt a
policy on naming new streets. Mr. Roberts stated that it has been the practice
in the past that unless a street name conflicts with another, the Planning Board
has accepted the recommendation of the developer and he would like to continue
this policy.
He instructed the secretary to draf~ a letter to all town departments and inform
them that this practice will continue and also to inform them that the Planning
Board voted to name the street in the Rocky Ridge Subidivison Menteiro Way.
Advisor~ Board - Meetin$ of..Februar~ 12, 1981 -Budget
Mr. Chepulis stated that since this is his last meeting, the Vice-Chairman should
represent the Beard to discuss the l~adget with the Advisory Board.

Greenwood East - one drivewa~v serving three lots - request for waiver
Mr. ~"rank Gelinas w~s present tonight and presented a new set of plans, showing
the existing grade on plan viewand on profile ~iew. The planned gradingand
the existing g~ing are almost the same. The plan also shows the lonation of
the sewer coming from the three lots as well as a cross-section at the bottom
of the pa~, the guardrail at the foot of the intersection, and the detail at
the intersectic~ of the driveway with the gutter line on Greenwood East. He
stated that the plan meets the requirements of the ~ard of ~h~blic Works and
the Highway Department.

The Board reviewed the plans.
Mr. Gelinas stated that they are continuing the existing gutters, allowing
the water to pass over the driveway, a standard that the town has set.
Mr. Chepulis questioned why Lots 4A, 5B, and 6B ? Gelinas - Form A's.
There was further discussion about water lines and fire pro~ec~ion. Mr.
Gelinas stated that these matters were looked into at the time the subdivision
was approved.
The clerk then read a letter from Dennis Currier, Acting Fire Chief, dated
January 22, 1981, in which he cites several problems for the fire department
maneuvering their apparatus on the driveway. Both Mr. Roberts and Mr. D'~Eelo
expressed concern over this letter. Mr. Gelinas responded that it does not
matter if there are three driveways or one - the fire department will still
have a problem.
Mr. Gelinas stated that there are no regulations governing the grade of the
driveway - his client is seeking a waiver and this should be the issue here.
Mr. Chepulis questioned what alternatives there are andwhat led to this
problem. Mr. Gelinas stated that if the town demands three driveways, there
will be three driveways parallel, but the losers will be %he neighbors and
theneighborhoed.
Attorney Jim Hyde, representing the Kalutions, who abut the property, then
spoke. He stated that it is unfortunate that the members of the Board did not
forsee this problem. He feels that this subdivision, while a mini one, should
come under the Subdivision Control Law. He is also very concerned about fire
pro%ectien and raised the question - '~ssuming you do get a fire engine up there,
how do you get it do~?"
Atty. t~vde also presented a copy of a case with similarities in Nantucket, in
which the court ruled that although you have frontage, you do not have accessi-
bility. He stated that it is not the Board's concern to maximize lots - safety
should be the issue and the Subdivision Control Law should apply to this street.
Mrs. Devon, an abutter, also expressed concern. She feels that her son is in
danger because of the trucks and because of the steepness of the hill. She
also feels there is a drainage problem in the area.
Mr. Gelinas then asked - '~here does my client stand?" He stated that since
the Rules and Regulations have been adopted for common driveways, his office
has brought forward at least two and possibly three plans whereby the wisdom
of a common di, iveway was approved by the Board. Mr. Chepulis asked where and
Mr. Gelinas replied off Chestnut Street toward Blueberry Hill Road and also
on WinterHill. Mr. Chepulis argued that Conservation Commission OK'd them
and Gelinas disagreed and insisted it was the Planning Board.
Nr. Gelina~ then stated that his client is going to go ahead and build the
lots because of economics. He said he will talk to the fire chief about
maneuverability.

Atty. H~de stated there are other factors here - all things under Subdivision
Control Law are pertinent here. In addition, you have an abutter who h~s
doubts about the drainage and the grade of the road. Mr. D'Angelo replied
that these t~ings are under the control of the Highway Surveyor, but he personally
would like to see the road widened.
Nr. D'Angelo then asked if it would be possible to write into the deeds of the
future home owners that they are not to expect fire protection. Atty. Hyde
warned that y~u have a letter on record warning the Board of this very problem.
Mr. Chepulis stated the old cliche - "Buyer Beware."
Benny 0sgood told the Board that they are overlooking the fact that he did not
do this for economics only - the lots are buidable, but constructing three
driveways would have devastated the area.
No action on the waiver request.
French F~rm Village.- Decision
Mr. Gelinas presented a fact sheet to the Board. Mr. D'Angelo asked what are
the Board of Public Works plans for extending the sewer -Mr. Gelinas replied -
no immediate plans for extending the sewer - only to increase the size of it.
In ~dditien, a discussion followed between Mr. Gelinas and the Board on the cost
of operating pumping stations in North Andover. The Chairman instructed the
secretary to write a letter to Mr. Borgesi for a breakdown of these costs, and a
copy of the reply is enclosed with these minutes.

by Mr. Roberts to approve the Preliminary Subdivision Plan entitled
French Farm Village, prepared by Frank C. Gelinas Associates, dated
December 4, 1980, with the following modifications:
1. In accordance with the Board of Fire Engineers letter dated
January 8, 1981, ~he distance between h~rants shall be no greater
than 500 feet;
2. All requzirements for street trees shall be enforced and a bond shall
be posted at the Definitive Subdivision stage for this purpose in
accordance with the Tree Warden's letter dated jann_~vy 15, ~981;
3. Water and sewer improvements shall be in accordance with the
Board of Public Works letter dated January 16, 1981. Additionally,
a detailed design for the sewage pumping station and force main shall
be sumbitted with the Definitive Subdivision Plan and a Flow Study
on the existing sewer on Sutton Street shall be submitted prior to
the submittal of the Definitive Subdivision Plan;
4. In accordance with the Highway Surveyor's letter dated January 19, 1981:
a. Adequate slope easements shall be sho~ on the Difinitive Sub-
division Plan aocomedating an eight foot shoulder area and a 2.1
slope. Said easement shall also be submitted in a written,
recordable form; and
b. Bank gravel shall be used on roadway. If bank gravel is not
available, a top dressing of six inches of processed gravel shall
be required.

Miscellandous Matters
Town Planner St. Pierre presented correspondence from the Middleton Planning
Board regarding the re-zoning of Route 114 at the North Andover line. The
proposed re-zoning is to Industrial and General Business. The Board instructed
her to reply to the Middleton Planning Board that the North Andover Planning Board
has no objection to this proposal, since it is in harmony with our zoning in
that area.

Dear Bill:
Persuant to your letter of February 12, 1981, we have
investigated the two sewage pump stations now in service and have
the following results:
Johnson Circle electricity cost 1980 $750.87
Sandra Lane electricity cost 1980 __~29.62.
$1180.49
The total cost for parts and service at both stations was $750.00
We presently have plans to eliminate both the Sandra Lane and Johnson
Circle lift stations by making them part of our gravity flow system.
The annual 1981 Town Meeting warrant will contain an article to extend
the sewer on Salem Street through the Ridgewood Cemetery to Johnson
Circle. The construction of the sewer from Kieran Road to S~andra Lane
has been held up due to easement problems. ---
We do not have any Plans to enlarge the sewer on Sutton Street or to
extend the existing Suttou Street sewer to 0sgood Street. If you have
any further cruestions please do not hesitate to call.
