Regular Meeting
The PLANNING BOARD held a meeting on Monday evening, April 6,
1981, at 7:30 p.m. in the Town Office Meeting Room. The following
members were present and voting: Paul A. Hedstrom, Michael P.
Roberts, Erich Nitzsche, John J. Burke, and Vincent Turano, who
arrived late.
Town Planner Susan St. Pierre and Highway Surveyor William Cyr
were also present.
Before the meeting came to order, members of the Board presented
a plaque and gifts to Mr. William Chepulis, who served on the
Planning Board for 20 years.
PUBLIC HEARINGS
1. Amendments to Rules and Regulations
Governing
the
Subdivision
of Land
Motion: by Mr. Burke to table until May 5, 1981

2. Re-Zone Turnpike Street - Petition of Edward Phelan
The legal notice was read.
Mr. Phelan was present and told the Board that the State took
some of his land several years ago for industrial purposes, but
that it is not suitable for indistrial use. He would like to
revert back to Residential so that his son can build a home on
the property. The house would front on Chestnut Street, which
is zoned Residential.
No one spoke in favor or opposition to the petition.
Motion: by Mr. Roberts to recommend favorable action at the
Town Meeting on Article 67.
Second: by Mr. Burke
Motion carries.
3. Table 2 Corrections in Zoning By-Law - Petition of Planning
B'o~rd
The legal notice was read.
Town Planner St. Pierre told the Board that there is an error in
the current Zoning By-Law, and the purpose of this article is to
clarify those errors.

Town Meeting on Article 76.
Second: by Mr. Burke

4. Re-Zone Bradford Street - Petition of C. Lincoln Giles
The legal notice was read.
Mr. Giles was present and told the Board that he wishes to
change the zoning so that multi family units can be made out
of an old nursing home. The land is currently zoned R-2 and
he wishes to change it to R-5.
Mr. Andrejs R. Strikis, the architect, gave a slide presentation.
Some of the highlights are:
- To restore the exterior and subdivide the main building and add
a new wing.
All the necessary set-backs are there, as well as the floor area
ratio.
- Fire trucks and the ambulance will have adequate access.
The tax breakdown is:
Existing $ 1,249.00
Razed 320.00
18 units (condos)S30,672.00
He also showed another building on Chestnut Street which Mr.
Giles converted to condominiums several years ago.
Member Nitzsche asked the applicant if he had contacted the
Board of Health and he replied - Yes, there is some question
as to the present state of the old leaching field and the
problem will have to be addressed.
Member Roberts asked about the traffic flow because of the
sharp corner. Mr. Strikis replied that it is not that bad
you can go either from Bradford Street or Great Pond Road.
Motion: by Mr. Roberts to take the matter under advisement.

5. Driveway Definition Petition of Fire Engineers
The legal notice was read.

Driveway definition continued
The purpose of this amendment is to have one driveway servicing
one lot. Fire Chief Dennis Currier told the Board that if there
is mo~'e than one house off a driveway, it creates problems for
his department. Town Planner St. Pierre recommended that the
Board act favorably on this article.

by Mr. Roberts that the Planning Board recommend favorable
action at the Town Meeting on Article 69, with the addition
of "except by Special Permit, with the Planning Board being
the Special Permit granting authority."
Second: by Mr. Burke
Motion carries.
6.~ Re-zone Riverview/Ashland Streets - Petition of Planning Board
The legal notice was read.
Town Planner St. Pierre explained that the area is currently zoned
I-S, and the purpose of the article is to zone it R-4. The town
has a housing re-hab grant for the area and it must be rezoned in
order to use the money.
She also wants two parcels excluded: Landers and Finnocharrio.
Motion:
by Mr. Roberts that the Planning Board recommend favorable
action at Town Meeting on Article 77, with the amendment
that two parcels of land, owned by Landers and Finnocharrio,
be excluded.
Second: by Mr. Burke
Motion carries.
PLANS NOT REQUIRING APPROVAL
Richards - Turnpike St.
Motion:
by Mr. Burke that the plan of land in North Andover, prepared
for G. McCormick, dated 3/11/81 and revised 3/28/81, be
approved under subdivision control law not required.
Second: by Mr. Roberts
Motion carries.
Scott Follansbee Paddock Estates - Table until April 13, 1981
Andrew Circle Realty Trust - Sharpner's Pond Road Scott Follansbee
gave the B~ard a presentation, and asked them to review the plan and
postpone their decision.

Scott also told the Board that if he brings this plan in as a
subdivision, it would have 60 house lots; as a Form A, you only
have 13 lots. A discussion followed on rubbish pick up, fire
protection, etc.
Motion: by Mr. Roberts to take under advisement.
Second: by Mr. Burke

LAKESIDE - Discussion with John Tuttle
Paul asked for an update. Member Turano abstained from the discussion.
Mr. Tuttle said that he has taken care of all the things that needed
to be done. There were some springs, which he picked up. He is
ready to gravel and hottop, and he installed a sedimentation pond.
He further said that the Conservation Commission is not unhappy
with the situation.
Mr. Nitzsche asked if a Notice of Intent had been filed and Tuttle
replied "I don't know - I gave it to my engineer."
There was some confusion as to who should file - the developer or
the town. Mr. James Lafond, Chairman of the CC, was present and
told the Board that the Notice of Intent has NOT been received.
Buddy Cyr said he wants to stabilize the slopes and told Tuttle
he wants it started this week.
Mr. Roberts wants another update at the next meeting and Mr.
Turtle agreed to attend.

GREENWOOD EAST - Correspondence from Town Boards and Abutters
Letters from the Board of Public Works (2), the Fire Department,
and the abutters were read.
Benny Osgood was present and s'aid that he has swept the street
and that he intends to clean the catch basins and stabilize the
slope. Once the site has vegetation, the problems should be
resolved.
The following voiced concern tonight: Linda Kalution, Mrs. Jones,
Mr. DiFruscio, Carl Pomeroy, any Atty. James Hyde, who represents
several abutters.
Highway Surveyor William Cyr had the following comments to make:
As long as things are done according to plan, he has no problems,
and that we should have something in writing stating that the
developer will proceed according to plan.
Motion:
by Mr. Roberts that the Planning Board draw an order of
conditions in reference to the waiver request from the
Rules and Regulations and that these conditions be
presented to the petitioner and other various abutters
so that the Planning Board may take action on this w~iver
on April 13, 1981.

COMMERCE PARK OF NORTH ANDOVER - Input from Town Boards
Motion: by Mr. Burke to table

GILMAN LANE- Discussion with Mr. Patrick Cone
Member Turano abstained.
Mr. Cone was present and said that there is a restriction recorded
with the 1972 plan.
William McLeod, the engineer told the Board that:
1. He has gone to the Conservation Commission and submitted a
plan to them.
2. They wish to deedLot 27 to the CC.
3. There was a 50' easement for future access to the F. Rockwell
property, which has been subdivided.
He also said that Mr. Cone has agreed to construct the roadway
according to the Highway Surveyor's specifications.

Gilman Lane - Continued
Town Planner St. Pierre told Mr. Cone that it is necessary to
supply the Planning Board with some t~pe of security.
There is some confusion over a covenant, and McLeod said that
there must have been a covenant because the plan was filed.
Mr. Cyr then said that he would like to see a drainage easement
and Mr. Cone replied that the drainage is in according to plan.
Mr. Cone also stated that he wishes to change the lots lines between
Lots 25 and 26 so that 26 could move further to the North and
that less wetlands would have to be filled.
The Board has not yet recieved a reply from Town Counsel on
whether a public hearing is necessary on this subdivision.
Motion:
by Mr. Roberts to refer the plan to Town Counsel to make
a determination on the public hearing and about th~
easement.

WINTER HILL ESTATES - Cg.r.res.pondence from Town Counsel and Atty.
Hatch
The clerk read letters from the Police Chief, Atty. Hatch, and
the Town Counsel.
Highway Surveyor Cyr recommended that the Planning Board take the
necessary steps to get the money from the bank to be put in an
account with the Town Accountant to finalize the work as shown
on the plan.
Motion: by Mr. Turano to issue a letter to enforce the bond on
Phase I of the Winter Hill Estates.Subdivision.
Second: by Mr. Burke

WILLOWS INDUSTRIAL PARK - PHASE II - Tabled
INGALLS CBOSSING II - Correction
The plan numbers were referenced incorrectly. There is an
amendment stating that the plan number is incorrect, but it
has been misplaced.
Motion:
by Mr. Roberts tnat any member of the PlanniD§ Board
be authorized to sign the correction of Ingalls Crossing II
After review by the Town Planner.

SUBDIVISION UP-DA?E
Susan St. Pierre recommended that~ti~e Planning Board enforce the
bonds on Greenwood West, Great Pond Woodland, and Carleton Farms
West.
Motion: by Mr. Turano that the Planning Board wait for recommendations
from the Highway Surveyor before taking action.
Second: by Mr. Nitzsche

CONSERVATION COMMISSION Determination Form
Mo ti on:
by Mr. Turano that, henceforth, it shall b'e the policy
of the North Andover Planning Board to request a "Deter-
mination of Applicability" under the "Wetlands Protection
Act", (M.G.L. Chapter 131, Section 40, as amended), for
all definitive subdivision plans whic~ are submitted to the
Planning Board. Said request to be made at the time that
the legal notice of the subdivision's public hearing is
forwarded to all abutters as required under the "Rules
and Regulations Governing the Subdivision of Land" Said
request shall be prepared by tne Town Planner and/or
Planning Board Secretary and signed by one member of
the Planning Board on behalf or. the entire Planning Board.
Said request shall not be sent in the event that a request
for "Determination of Applicability" or a "Notice of
Intent" has already been submitted for the land in question.

Mr. Hedstrom discussed the request of the Town Counsel to raise
the salary of the position as he would like to make a recommendation
at the upcoming meeting.
Motion: by Mr. Roberts to give a favorable recommendation on the
request of Town Counsel to raise the salary of the position.
Second: by Mr. Burke
Motion does NOT carry.
