Emergency Meeting
The Planning Board held an emergency meeting on Thursday evening,
April 16, 1981, in the Town Office Meeting Room for the purpose of
rendering a decision on the Sharpner's Pond Road Form A plan for
Andrew Circle Realty Trust. The f~llowin~ members were present
and voting: Paul A. Hedstrom, Chairman; Vincent S. Turano, Clerk;
John J. Burke, and Erich W. Nitzsche.
The meeting came to order at 7:30 p.m. with Attorney Reginald Marden
speaking for the applicant, Scott Follansbee. Atty. Marden has
prepared a covenant and presented a draft to the Board.
Moti on:
by Mr. Burke to approve the plan of land prepared for
Andrew Circle Realty Trust located in North Andover, Mass.
subject to the covenant being recorded with the Plan.

Motion fails.
Member Turano had the following comments:
I don~t like something put down in front of me for immediate
action;
2. I would like to see the word "required" in No. 4 changed;
Note: Atty. Marden said it should reed "requested"
I would like to see the 6th paragraph concerning safety to read:
"A plan demonstrating that adequate fire protection be afforded
to the future residents of the homes in question which meets the
approval of the Fire Chief and the Planning Board."
Mr. Follansbee responded that the Fire Department cannot provide
adequate protection without a water supply.
Member Turano asked "What about the pond?" and Follansbee responded
"They won't use it."
A discussion followed concerning the width of the road and the problem
of the fire department making an error because of the driveways.
Mr. Follansbee argued that the town has the same situation on Lac~ St.
The houses are numbered for every 25 feet and there are many missing
numbers.
Motion:
by Mr. Nitzsche that the North Andover Planning Board has
determined that said plan shows a subdivision, as defined
by G.L.c. 41, S. 81-L, and must therefore be re-submitted
to it for approval under the Subdivision Control Law.

Discussion:
Atty. Marden again brought up the Gifford vs Nantucket case and
stated that it was the exception and not the rule. The connecting
portions of the lots were turning at very odd angles, thus making
it a necessity that other lots be used for access. It does not
mean that every lot with a long neck is a subdivision.
Member Turano then asked Mr. Follansbee if he had 60 lots on the
plan, would he bring in water - response - "No."
Member Turano then asked - "Would you be willing to put in a sixth
paragraph in the covenant concerning safety and submit a plan to
be approved by the Fire Chief and the Planning Board?"
Mr. Follansbee responded - "I don't know what you are driving at.
If I wanted to live with all the conditions, I wouldn't be submitting
it as a Form A."
Mr. Follansbee further stated that this is a development for large
lots, and on the question of driveways, he stated he would make them
25 feet wide with a good gravel base and will allow for good access.
As far as identification of the houses, he will demand name signs.
Vote on Motion: In favor: Nitzsche, Turano
Opposed : Burke
Motion carries.
The meeting adjourned at 8:30 p.m.
