Regular Meeting
The Planning Board held a regular meeting on May 6, 1981 with
the followin~ members present and votinp: Michael P. Roberts,
Vincent S. Turano, and Erich W. Nitzsche. Town Planner Susan
M. St. Pierre and Highway Surveyor Buddy Cyr were also present.
PUBLIC HEARING
Amendments to Rules and Reaulations Governing the Subdivision of
Land - cont'i'nu-~-~-a-~r6m previous meeting
The Town Planner suggested that the Board take up the amendments
at a special meetina when a full Board is present. She suggested
May 21 or 26 - Boar~ to check with Chairman Hedstrom and Member
Burke and get back to her.
PLANS NOT REQ.UIRING APPROVAL
Raleigh Tavern Lane - Atty. John McGarry
MOTION: By Mr. Nitzsche that the plan of land prepared for Coolidge
Realty Trust dated April 29, 1981 be approved under Subdivi-
sion Control Law Not Required.
SECOND; by Mr. Turano
VOTE: Unanimous motion carries.
Raleigh Tavern Lane J. Barbagallo
MOTION: by Mr. Turano that the plan of land located in North Andover,
Mass. prepared for General Store Realty Trust and dated
April 29, 1981 be approved under Subdivision Control Law
Not Required.
SECOND: by Mr. Nitzsche
VOTE: Unanimous - motion carries
Raleigh Tavern Lane - Alvin Maillet
George Fart owns Lot 20 and General Store Realty Trust owns Lot 21,
but it is under agreement to A. Maillet.

Farr dated April 24, 1981 be approved under Subdivision
Control Law not required subject to obtaining joseph

Mr. Barbagallo present and signed the Form A - Board signed

Member Turano abstained.
It has been determined that a public hearing will be required and
the Town Planner recommended that the Board not act tonight - no
quorum for this agenda item - put on agenda for May 18th.
WILLOWS II - Bond amounts
Hi.ohway Surveyor Cyr changed his figures and corrected his letter.
MOTION:
by Mr. Turano to accept the bond amounts of $35,500 and
$18,400 and endorse the Subdivision Control Agreement as
security in lieu of a covenant in the amount of $53,900
subject to the Chairman signing the form.
SECOND: by Hr. Nitzsche
VOTE: Unanimous motion carries
GREENWOOD EAST - status of driveway servicing three lots
Highway Surveyor Cyr reported that nothing has been done. He
wants to see some action. If no action, he will not authorize
any permits for service.
MOTION:
by Mr. Turano that the Waiver be amended to say that the
revised plan be submitted by May 22, 1981 and that the
Planning Board proceed to have this Waiver recorded at the
Registry of Deeds and a copy to be sent to the applicant
by certified mail.
SECOND: by Mr. Nitzsche

RALEIGH TAVERN II Bond Release
Letters from the developer and the Highway Surveyor were read.

Surveyor's recommendation.

TRAFALGAR ESTATES Progress report
Highway Surveyor Cyr said that When the original proposal came
in, the concerns were Becky's Pond and the surrounding area and
Mr. Flatley gave us money to preserve this property. The development
is moving too slowlY and Mr. Cyr wants it up to binder grade.
MOTION:
by Mr. Turano to send a certified letter to Ambrose Flatley
stating that the Planning Board is concerned with the pro-
gress of the subdivision and request that he attend the~
next meeting in light of the fact that the completion date
of July 23, 1981 is approaching and failure to respond will
initiate the Planning Board to contact counsel to enforce
the bond. Also, ask Mr. Flatley to bring his counsel and
enaineer with him and send a carbon copy of the letter to
th~ Conservation Commission and ask them to attend.

BOARD OF APPEALS Recommendations from Planning Board
Rea, Gilbert Renewal of Earth Removal Permit
MOTION: by Mr. Turano to recommend favorable action on Mr. Rea's
petition.
SECOND: by Mr; Nitzsche
VOTE: Unanimous - motion carries.
Polizzotti, Josephine - Variance
MOTION: by Mr. Nitzsche that no recommendation be made because
no plans are available for viewing.
SECONDI by Mr. Turano
VOTE: Unanimous - motion carries
Gordon, James -variance
MOTIONI by Mr. Nitzsche to recommend favorable action to the Board
of Appeals on Mr, Gordon's petition for a variance.
