Regular Meeting
The Planning Board held a regular meeting on May 18, 1981 in the
Town Office Meeting Room with the following members present and
voting: Paul A. Hedstrom, Chairman; John J. Burke; and Erich W.
Nitzsche. Town Planner Susan M. St. Pierre and Highway Surveyor
William Cyr were also present.
PLANS NOT REQUIRING APPROVAL

Board of Appeals action - subdivided land.
MOTION:
by Mr. Burke that the variance plan of J.Y. Realty, lo-
cated in North Andover, Mass. dated January 30, 1981 be
approved under Subdivision Control Law Not Required.
SECOND: by Mr. Nitzsche
VOTE: Unanimous - motion carries
B&R Construction - Bonny Lane
Change in lot lines
MOTION: by Mr. Burke that the plan of land in North Andover, Mass.
prepared for B&R Construction dated Ma~ 15 1981 be approved
under Subdivision Control Law Not Required.
SECOND: by Mr. Nitzsche
VOTE: Unanimous - motion carries
ABBOTT MEADOWS - Decision- Definitive Subdivision Plan
Letters from Board of Health and Frank Gelinas were read. Mr.
Gelinas' letter included calculations, work sheets, a locus map,
topographic section and another letter dated 3/24/81. Mr. Gelinas
present and stated that there seems to be no significant impact on
the brook.
MOTION: by Mr. Burke to approve the Definitive Plan of Land entitled
"Abbott Meadows" by Frank C. Gelinas and Associates and
dated January 15, 1981 with the following conditions:
1. That the record owners of the subject land forthwith execute
and record a "covenant running with the land" or otherwise
provide security for the construction of ways and the installation
of municipal services within said subdivision, all as provided
by G.L.c. 41, S. 81-U.

2. That all such construction and installations shall in all
respects conform to the governing ~ules and regulations of
the Board.

That, as required by the North Andover Board of Health in its
report to this Board, that individual septic system permits
must be obtained prior to the issuance of a building permit
from the Board of Health under the Rules and Regulations of
Title "V" of the State Sanitary Code~ and that the developer
shall, prior to the sale of individual lots to individual
owners, submit to the Board of Health percolation tests showing
the suitability of said lots for the installation of subsurface
disposal systems for sin.ole family dwellings; however, such
restriction shall not prevent the mortgate of said lots or the
sale to developers or home builders against whom this condition
shall also remain applicable and enforceable until complied with.
That no work shall be done in the subdivision until security
in the form of a bond or covenant has been duly recorded and
the plans are signed and recorded.
That any changes made to the definitive plan by other town
a~encies or Officials shall be submitted to the Planning
Board by the applicant.
All street trees shall conform to Tree Warden's specifications.
A Notice of Intent, if applicable, shall be filed with the
North Andover Conservation Commission pursuant to M.G.L.
Ch. i31, Sec 40. If applicable, a Certificate of Compliance
shall be obtained from the Conservation Commission for any
order of conditions prior to the final release of any bond
or covenant.
All water improvements shall be in accordance with the Board
of Public Works letter dated December 1) 1980.
A bond shall be retained in the amount of $2,000 for the
purpose of ensuring compliance with street trees regulations
in accordance with the Tree Warden's letter dated February 26,
1981.

All drainage easements shall be.deeded to the Town of North
Andover. Said easements shall be submitted to the Planning
Board in written form prior to Planning Board's endorsement
of said subdivision plan.

11. Sheet 1 of 1 of said subdivision shall be revised in the
following manner:

a. Length of new water line on Abbott Street shall be indicated.
b. Size of proposed water line on Road A shall be indicated.
c. Location of percolation tests shall be shown.
d. The 6dge of pavement on Abbott Street (North) shall be
shown on plan as well as any existing structures within
subdivision.
Road A will be given a street name.
The developer shall clear the Right-of-Way~ prepare subgrade;
install below grade drainage; install water line on Abbott
Street and proposed street~ install fire hydrants; install
gravel base; and install binder course no later than Novem-
ber 15, 1981 if any work begins before such date.
13. All improvements in said subdivision shall be completed no
later than November 1, 1982.
14. Grade of cul-de-sac shall not exceed 2%.

The drainage at the intersection of Abbott Street and Road A
will consist of one basin positioned on the Southwest corner
so that no part of the drainage line will be within 5' of
the street line; there will be a catch basin/manhole added
at approximately 1+25, with the remainder of the drainage
as per the definitive plan.
16. The engineer will superimpose elevation 61,0 contour on the
definitive plans per the request of Dr. Vincent Turano.
